HomeMy WebLinkAboutORDINANCE - 3060 - 10/11/2005 - VARIATION GRANTED FOR CASTLETOWN SUBDIVORDINANCE NO. 3060 AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR A PROPOSED 9 LOT RESIDENTIAL SUBDIVISION LOCATED AT 325 LANDMEIER ROAD, ELK GROVE VILLAGE (CASTLETOWN SUBDIVISION) WHEREAS, the Zoning Board of Appeals at a Public Hearing duly called and held according to law considered the question of granting a variation of the Zoning Ordinance pertaining to floor area ratios to permit a floor area ratio of 0.43 for a lot proposed residential subdivision located at 325 Landmeier Road; and WHEREAS, the JPZ Sub-committee of the Village, at a Public Meeting duly called and held according to law considered the “DO NOT GRANT” finding of the Zoning Board of Appeals and explored additional facts and information from the developer; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after reviewing and considering the findings of the Zoning Board of Appeals as well as the JPZ Committee of the Village find and believe that sufficient hardship exits so as to justify the granting of said variation subject to certain other additional considerations. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a variation of the Zoning Ordinance pertaining to floor area ratios to permit a floor area ratio of 0.43 for a proposed 9 lot residential sub-division located at 325 Landmeier Road, Elk Grove Village subject to the following conditions: That the developer provide a cash donation in an amount equal to the cost of a sidewalk which would be located on the east side of the street, installation of said sidewalk to be deferred until such time as required by the vote of the Village Board. That the street to be installed in the sub-division be named Castle Drive. That the developer shall establish a Homeowners Association to maintain Lot 9 and advise all new homeowners of the Association, in addition to recording the Declaration of Association or similar documentation with the Cook County Recorder of Deeds. Section 2: That this Ordinance shall be in full force and effect from after its passage and approval according to law. VOTE: AYES: 4 NAYS: 2 ABSENT: 0 PASSED this 11th day of October 2005.
