HomeMy WebLinkAboutORDINANCE - 3085 - 5/9/2006 - TEXT AMEND/BANKS SPECIAL USEORDINANCE NO. 3085 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE ESTABLISHING FINANCIAL INSTITUTIONS AS SPECIAL USES IN VARIOUS ZONED DISTRICTS WHEREAS, the Plan Commission of the Village of Elk Grove Village, at a public hearing duly called and held according to law, considered the question of amending various sections of the Zoning Ordinance in order to establish Financial Institutions as a Special Use in various zoned districts of the Village; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having reviewed the recommendation and finding of said Plan Commission, find and believe that it is in the best interest of the Village to amend the Zoning Ordinance accordingly. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Chapter 7 Zoning Districts of the Zoning Ordinance of the Village of Elk Grove Village be and the same is hereby amended as follows: Section 7B-1-2:B Permitted Uses is hereby amended by deleting therefrom “Banks (except drive-in facilities)” 2. Section 7B-1-2:C Conditional Uses Permitted is amended by deleting therefrom “Drive-In Banking Facilities”. 3. Section 7B-1-2:E Special Uses is amended by adding thereto the following: - Financial Institutions (including drive-thru facilities) in granting a Special Use permit for Financial Institutions, the Village shall consider the following requirements and conditions: Esthetics Compatibility with surrounding uses The need for the use in the area proposed The benefit to the Village to be derived from the granting of the Special Use Permit That the traffic generated from the use will not have a deleterious effect on existing uses in proximity to the proposed use nor on the public streets. Section 7B-2-2:B is amended by the third paragraph being changed to read as follows: Retail sales and consumer service uses, except for Financial Institutions and those uses listed under Sub-Section D of this Section. Section 7B-2-2:E is amended by adding thereto the following: Financial institutions (including drive-thru facilities) in granting a Special Use Permit for financial institutions, the Village shall consider the following requirements and conditions: Esthetics Compatibility with surrounding uses The need for the use in the area proposed The benefit to the Village to be derived from the granting of the Special Use Permit That the traffic generated from the use will not have a deleterious effect on existing uses in proximity to the proposed use nor on the private streets. Amend Section 7B-3-2:B by deleting “drive-in banks” from the list of permitted uses. Amend Section 7B-3-2:E by adding thereto the following: Financial institutions (including drive-thru facilities) in granting a Special Use Permit for Financial Institutions, the Village shall consider the following requirements and conditions: Esthetics Compatibility with surrounding uses The need for the use in the area proposed The benefit to the Village to be derived from the granting of the Special Use Permit That the traffic generated from the use will not have a deleterious effect on existing uses in proximity to the proposed use nor on the private streets. Amend Section 7B-5-2:B by deleting “banks (except drive-thru facilities)” from the list of permitted uses. Amend Section 7B-5-2D Special Uses by adding thereto the following: “Financial Institutions – In granting a Special Use permit for Financial Institutions, the Village shall consider the following requirements and conditions: Esthetics Compatibility with surrounding uses The need for the use in the area proposed The benefit to the Village to be derived from the granting of the Special Use Permit That the traffic generated from the use will not have a deleterious effect on existing uses in proximity to the proposed use nor on the private streets” 10. Section 7C-2:B is amended by deleting therefrom “Credit Agencies” and further amended by changing “Investment Companies” to “Investment Companies, except Financial Institutions”. 11. Section 7D-2 is amended by deleting therefrom “Drive-in Business Facilities Exclusive of drive-in restaurants” and further deleting “Financial Institutions”. That Section 2-2 of the Zoning Ordinance is amended by adding thereto the following: BANKS: (See Financial Institutions FINANCIAL INSTITUTION: A bank, saving and loan, credit union or similar financial related institution. Section 2: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 9th day of May 2006.
