AN ORDINANCE AMENDING VARIOUS PROVISIONS OF ORDINANCE NO. 3081 WHICH ORDINANCE AMENDED VARIOUS SECTIONS OF THE VILLAGE CODE PERTAINING TO LICENSE FEES AND MINIMUM FINES FOR VIOLATIONS
WHEREAS, ON April 11, 2006 the Mayor and Board of Trustees of the Village of Elk Grove Village adopted Ordinance No. 3081, which Ordinance amended various sections of the Village Code
pertaining to license fees and minimum fines for violations; and
WHEREAS, Section 1 of said Ordinance amended certain fees for Coin Operated Automatic Food Vending Machines (Article 3-5J) from $10.00 to $25.00 with respect to Coin Operated Bulk
Foods/Novelties/Sundries and from $25.00 to $50.00 for Coin Operated Packaged Food/Beverage machines; and
WHEREAS, prior to amending the fees for various vending machines in the Village, it is necessary that an additional Hearing be held by the Mayor and Board of Trustees with respect
to said increase fees; and
WHEREAS, it has been recommended by the Finance Department that the amendment to Section 3-1-5 Term of License of the Village Code set forth in Ordinance No. 3081 be further amended
by requiring each applicant to pay any outstanding financial obligations to the Village before the applicant can become eligible for the issuance of a license.
NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
SECTION 1: That that portion of Section 1 of Ordinance No. 3081 which increased the fees set forth in Section 3-1-6 of the Village Code for various automatic food vending machines
be repealed so that the fee for Coin Operated Bulk Foods/Novelties/Sundries revert back to $10.00 and the fee for Coin Operated Packaged Food/Beverage Machines revert back to $25.00.
SECTION 2: That the amended paragraph set forth in Section 2 of Ordinance 3081 which amended Section 3-1-5 Term of License be further amended to read as follows:
All license fees shall be due and payable before June 1st of each year. Any person, firm or corporation who fails to pay the applicable fee on or before July 1st of each year shall
pay the fee established in Section 3-1-6 plus a late payment fee of an additional 50% of the established fee, provided that the amount of the late payment fee shall not exceed five
hundred dollars ($500.00). In addition, the Director of Finance or his/her designated agent shall review applicable Village records to determine whether the license applicant has any
outstanding financial obligations including the non-payment of any required business license for prior year or years to the Village. If unpaid financial obligations exist, that amount,
plus any interest or penalties which may have accrued thereon, shall be added to the license fee herein imposed. No license shall be issued until all fees are provided for herein are
paid.
SECTION 3: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form.
SECTION 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
