HomeMy WebLinkAboutORDINANCE - 3098 - 9/26/2006 - SPECIAL USE/MEACHAM/GGULLO/AMERBANKORDINANCE NO. 3098 AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO PERMIT A FINANCIAL INSTITUTION (BANK) WITH DRIVE-THRU FACILITIES AND TO AMEND A PREVIOUSLY APPROVED ANNEXATION AGREEMENT TO PERMIT DRIVE-THRU FACILITIES FOR PARCEL 1; TO PERMIT A USE WHICH IS NOT CONDUCTED COMPLETELY WITHIN AN ENCLOSED STRUCTURE; TO PERMIT A MULTI-TENANT RETAIL STRIP OR SHOPPING CENTER AND TO PERMIT THE SCREENING OF ROOF-TOP MECHANICAL EQUIPMENT WITH A MATERIAL OTHER THAN THAT OF THE PRINCIPAL STRUCTURE, AND TO APPROVE A REVISED SITE PLAN FOR PARCELS 1,2 AND 3 ON PROPERTY LOCATED ON THE EAST SIDE OF MEACHAM ROAD, SOUTH OF BIESTERFIELD ROAD, ELK GROVE VILLAGE ILLINOIS (FIRST AMERICAN BANK/GEORGE GULLO DEVELOPMENT CORPORATION)_______________________________________ WHEREAS, the Plan Commission of the Village of Elk Grove Village, acting as a Zoning Commission, at a Public Hearing duly called and held according to law, considered the question of granting a Special Use Permit to permit a financial institution with drive-thru lanes in a B-2 Business District and to amend a previously adopted Annexation Agreement on property located on the east side of Meacham Road south of Biesterfield Road; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having considered the recommendation and finding of said Plan Commission, and after considering the following requirements and conditions for a Special Use permit for a financial institution: (1) esthetics, (2) compatibility with surrounding uses, (3) the need for the use in the area proposed, (4) the benefit to be derived from the granting of the Special Use Permit and (5) that the traffic generated from the use will not have a deleterious effect on existing uses in proximity to the proposed use nor on the private streets, find and believe that the foregoing requirements and conditions are satisfied, and that the granting of the Special Use Permit to permit a financial institution with drive-thru lanes in a B-2 Business District and the amending of the Annexation Agreement are in the best interest of the Village. NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a Special Use Permit to permit a financial institution (bank) and a Special Use Permit to permit drive-thru facilities in a B-2 General Business District on Parcel 1 (Lot 2 in First American Bank Subdivision, recorded in the Office of the Cook County Recorder of Deeds on April 10, 2003 as Document No. 0030482078) which property is located on the east side of Meacham Road south of Biesterfield Road in Elk Grove Village. The granting of the Special Use Permit is subject to the condition that construction for the banking facility be commenced no later than one year from the approval date of this Ordinance. Section 2: That the Annexation and Development Agreement between the Village of Elk Grove Village and the DRH Cambridge Homes, Inc., Chicago Trust Company, as Trustee under Trust Agreement dated March 23, 1964 and known as Trust No. 46684 and Thomas R. Schreiner IRA Rollover and First American Bank as Trustee under Trust Agreement dated December 28, 1992 and known as Trust no. 1-92-051 and Thomas R. Schreiner (“the Annexation Agreement”), which Annexation Agreement has previously approved by the Village, be amended in the following manner: Amended to permit the use of Parcel 1 (Lot 2 in First American Bank Subdivision) for the drive-thru facilities. Amended to permit a use which is not conducted completely within an enclosed structure. Amended to permit a multi-tenant retail or strip shopping center. Amended to permit the screening of roof-top mechanical equipment with a material other than that of the principal structure. Amended to approve a revised site plan for Parcel l (Lot 2 in First American Bank Subdivision), Parcel 2 (Lot 1 in First American Bank Subdivision) and Parcel 3 (Lot 2 in Steak N Shake re-subdivision), which site plan was prepared by Norman J. Toberman & Associates, copies of which are on file in the Office of the Village Clerk for property located on the east side of Meacham Road, south of Biesterfield Road. Section 3: That Parcel 1 (Lot 2 in First American Bank Subdivision) be permitted full access to Dakota Road, if and when Dakota Road is constructed or other development is established south of Parcel 1. Section 4: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 26th day of September 2006.
