HomeMy WebLinkAboutRESOLUTION - 32-06 - 7/18/2006 - INTERGOV AGREEMENTRESOLUTION NO. 32-06 A RESOLUTION AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND THE HIGHWAY DIVISION OF ELK GROVE TOWNSHIP (NORTH PARKWAY, DIERKING TERRACE, MARTHA AND LINCOLN STREETS) NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Mayor be and is hereby authorized to sign the attached documents marked: INTERGOVERNMENTAL AGREEMENT a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Mayor. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 18th day of July 2006. Johnson Village of Elk Grove Village INTERGOVERNMENTAL AGREEMENT This Intergovernmental Agreement made and entered into this 18th day of July, 2006 by and between the Village of Elk Grove Village, an Illinois Municipal Corporation (hereinafter referred to as "Village" and the Highway Division of Elk Grove Township, an Illinois Municipal Corporation, (hereinafter referred to as "Township". WITNESSETH: WHEREAS, the Township has maintained certain streets that now, as a result of annexation, are within the corporate boundaries of the Village, namely North Parkway, Dierking Terrace and the streets in the Itasca Meadows Sub -division known as Martha and Lincoln; and WHEREAS, the streets have been previously maintained for many years by the Township at no expense to the Village; and WHEREAS, Public Act 94-0884 provides that the roads forming a part of a Township Road District include those roads maintained by a District, regardless of whether or not those roads are owned by the Township; and WHEREAS, the Village and the Township agree that it would be beneficial to the Village and the Township that the Township continue to maintain these roads and include same in their mileage report filed with the County of Cook. NOW, THEREFORE, in consideration of the mutual promises and agreements hereinafter set forth, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereto agree as follows: 1. That the Township continue to maintain those portions of North Parkway, Dierking Terrace and Martha and Lincoln Streets as identified on Group Exhibit A, attached hereto, and the Township shall be able to include the distance of said roads in its annual mileage report submitted to the County of Cook. 2. That either parry may terminate this Agreement by giving notice of such termination, in writing, at least six (6) months in advance of the date set forth for termination. 3. That this Agreement shall be in full force and effect for a period of five (5) years from the effective date of this Agreement as set forth herein, and shall be automatically renewable for additional five (5) year periods until terminated as herein provided.
