HomeMy WebLinkAboutORDINANCE - 3187 - 10/14/2008 - VARIATION/STORAGE OF GAS CYLINDERS/FENCE/1601 NICHOLASORDINANCE NO. 3187 AN ORDINANCE GRANTING VARIATIONS OF SECTION 7 -E -8-6:C, SECTION 7E -9:A AND SECTION 7E -1:F OF THE ZONING ORDINANCE TO PERMIT THE OUTDOOR STORAGE OF FLAMMABLE GAS CYLINDERS LESS THAN FIFTY (50') FEET FROM ANY LOT LINE, THE, STORAGE OF NOT FLAMMABLE GAS CYLINDERS IN THE REQUIRED FRONT YARD AND THE CONSTRUCTION OF A SIX (6') FOOT TALL PLUS ONE (1') FOOT OF BARBED WIRE FENCE IN A REQUIRED FRONT YARD FOR SCREENING PURPOSES (1601 NICHOLAS BOULEVARD) WHEREAS, the Zoning Board of Appeals, at a Public Hearing duly called and held according to law, considered the question of granting various variations of the Zoning Ordinance to permit the storage of flammable and not flammable gas cylinders in various locations on property located at 1601 Nicholas Boulevard, Elk Grove Village; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having reviewed the finding of said Zoning Board of Appeals, find and believe that sufficient hardship exists so as to justify the granting of the variations requested. NOW, THEREFORE BE IT ORDAINED, by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a variation'of Section 7E -8-6:C of the Zoning Ordinance pertaining to the storage of flammable liquids and gas storage tanks less than fifty (50') feet from any lot line to permit the location and storage of flammable gas cylinders in bunkers twenty-five (25') feet from the east property line and ten (10') feet from the south property line on property located at 1601 Nicholas Boulevard, Elk Grove Village. The storage bunkers will be eight (8') feet in height and constructed of concrete masonry blocks providing a two-hour fire resistance rated assembly. Section 2: That there be granted a variation of Section 7E -9:A of the Zoning Ordinance to permit a six (6') foot tall fence with one (1') foot of barbed wire above the fence in the required front yard along Greenleaf Avenue on property located at 1601 Nicholas Boulevard. Section 3: That there be granted a variation of Section 7E-1 :F of the Zoning Ordinance as it pertains to the outdoor storage of materials, goods and products in required front yards to permit the storage of empty, full or partially full not flammable gas cylinders or new empty cylinders in the required front yard along Greenleaf Avenue on property located at 1601 Nicholas Boulevard. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. Section 5: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form.
