A RESOLUTION AUTHORIZING THE MAYOR AND VILLAGE CLERK TO
EXECUTE A LETTER OF AGREEMENT BETWEEN THE VILLAGE OF ELK
GROVE VILLAGE AND COOK COUNTY HIGHWAY DEPARTMENT (CCHD)
FOR CONSTRUCTION OF THE LIVELY BOULEVARD IMPROVEMENTS
(DEVON AVENUE TO TOUHY AVENUE)
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows:
Section 1: That the Mayor be and is hereby authorized to sign the attached document
marked:
LETTER OF AGREEMENT
a copy of which is attached hereto and made a part hereof as if fully set forth and the Village
Clerk is authorized to attest said document upon the signature of the Mayor.
Section 2: That this Resolution shall be in full force and effect from and after its
passage and approval according to law.

Village of Elk Grove Village
This Letter of Agreement, in duplicate, has been prepared to establish project and, cost
responsibilities of the Village of Elk Grove Village (hereinafter VILLAGE) and the County of
'Cook (hereinafter COUNTY) for traffic signal improvements at the intersection of Devon Avenue
at Lively, Boulevard. Previously, the Highway Department concurred to participate in the project
by funding fifty (50%) percent of construction costs (estimated County share $118,000.00) for
the modernization of the existing traffic signals at this intersection.
It is the practice of the COUNTY, that at intersections of County Highways and municipal
streets, the COUNTY will be responsible for the physical maintenance and timing/phasing of the
traffic signals and the municipal corporation is to bear a share of the signal's maintenance and
energy costs. This share is represented by the relative number of approaches to the intersection
for which the municipal corporation is responsible with respect to the total number of
approaches; in this case, two legs of four legs or fifty (50%) percent.
The VILLAGE and COUNTY agree to the following.
The VILLAGE shall:
a) Prepare design plans, obtain the necessary approvals, including from COUNTY for
improvements at Devon Avenue, construct, the improvements and provide
construction engineering;
b) Pay for or secure funding for fifty (50%) percent of the traffic signal costs at Devon
Avenue and for one hundred (100%) percent of new or upgraded emergency vehicle
pre-emptive devices (EVPD's) at Devon Avenue;
c) Have the new traffic signals .installed by an Electrical Contractor approved by the
COUNTY;

d) Furnish to the COUNTY one (1) copy of all approved catalog cuts prior to installation.
All traffic signal. equipment shall be of the type and brand that is acceptable to the
COUNTY;
e) Furnish to the COUNTY one (1) set of as -built reproducible mylars with MicroStation
compatible CADD files of the traffic signal design plans at the final inspection;
f) Have the COUNTY participate in the final inspection of the completed improvements
at Devon Avenue. The COUNTY contacts are Mr. Eric Petraitis, Construction
Supervisor, at 312-603-1612, and Mr. Richard Jezierny, Mechanical and Electrical
Division Head, at 312-603-1730;
g) Bill the COUNTY for.fifty (50%)_ percent of the traffic signal construction costs of
eligible items following completion of the project and based upon actual quantities
used and contract unit prices as awarded;
h) Pay to the COUNTY fifty (50%) percent of the maintenance charges for the traffic
signal within thirty (30) days of County's quarterly (3 month) statement of same.
Payments to the COUNTY shall be by check payable to the Treasurer of Cook
County, for deposit into the COUNTY's Motor Fuel Tax Account 600-600 and sent to
the COUNTY's Superintendent of Highways;
i) Assume fifty (50%) percent of the electrical energy charges payable directly to
ComEd in accordance with an electrical service contract to be entered into with that
Company;
j) Pay one hundred (100%) percent of the costs for VILLAGE infrastructure constructed
along Devon Avenue as part of the project, said items to include new sidewalk;
k) Own, operate and maintain the sidewalk included as part of this project; continue to
own the EVPD relocated as part of the project; and, this Agreement stands in lieu of
a separate COUNTY Highway Permit for. said infrastructure and the VILLAGE shall
be bound to the general terms of COUNTY Highway Permits as they exist the date of
execution of this Agreement by the COUNTY; and,
1) Acknowledge, by execution of this Agreement, that it shall not have access to or on
COUNTY's traffic signal. The COUNTY will monitor the operational status of the
EVPD at no charge to the VILLAGE and will inform the VILLAGE should it detect
fault with said operations. As such, the VILLAGE agrees to: either enter into a
separate agreement with COUNTY's Electrical Maintenance Contractor to pay for
repairs to VILLAGE's EVPD; or pick up, repair, and return repaired EVPD equipment
to COUNTY's Electrical Maintenance Contractor for reinstallation as it occurs and
pay directly to COUNTY's Electrical Maintenance Contractor for removal and
reinstallation.of VILLAGE's EVPD equipment on or in COUNTY's traffic signal.

2. The COUNTY shall:
a) Review and approve plans for improvements at Devon Avenue;
b) Pay to the VILLAGE fifty (50%) percent of the traffic signal costs at Devon Avenue,
excluding new or upgraded EVPD's, when invoiced by VILLAGE as previously
described in 1.g. hereinbefore (estimated total COUNTY share $118,000.00);
c) Participate in the final inspection of the completed improvements;
d) Upon completion and acceptance of the Traffic Signal System by representatives of
the COUNTY, cause it to be maintained and energized and be responsible.for all
settings and timings at this intersection; and,
e) Bill the VILLAGE quarterly for their share of signal maintenance costs.
The parties hereto agree that the traffic signal provisions of this Agreement shall remain in effect
so long as the traffic signals covered by the terms of this Agreement or any Amendment hereto
are owned, operated and/or maintained by the COUNTY and remain in place either in their
current or some modified configuration.
Should the Village of Elk Grove Village be agreeable to the terms of -this Agreement, please
countersign two copies of this letter and return them to this Department, Attention: Mr. Rodnev
Bettenhausen, Advance Planning and Agreements Division, Room 2340. Enclose a certified
copy of the Village Board minutes authorizing the signatory to commit for the Village.
We will then present the Agreement to the Board of County Commissioners with a Resolution to
be attached and made .part thereof, which will authorize and bind the Village of Elk Grove
Village and Cook County, their respective representatives, successors and assigns, to their
respective obligations herein.
