HomeMy WebLinkAboutORDINANCE - 3148 - 12/11/2007 - DEVON AVENUE IMPROVEMENTS/PARK DISTRICT PROPERTYORDINANCE NO. 3148 AN ORDINANCE DECLARING THE NECESSITY AND CONVENIENCE OF THE USE- AND OCCUPANCY OF CERTAIN PROPERTY CLEARLY OWNED BY THE ELK GROVE PARK DISTRICT FOR DEVON AVENUE IMPROVEMENTS WHEREAS, the Village of Elk Grove Village is a Municipal Corporation and body politic of Cook County, Illinois and is organized for the purpose of establishing, developing and maintaining all municipal functions within the corporate limits of the Village of Elk Grove Village, including the installation and maintenance of public rights- of-way; and WHEREAS, the Village of Elk Grove Village and the Elk Grove Park District are municipalities as defined in the "local government property transfer act" (50 ILCS 605/0.01); and WHEREAS, the territory of said municipalities is wholly in, co -extensive with, partly within and partly without, or contiguous to the corporate limits of the other; and WHEREAS, the Elk Grove Park District is the present owner of a parcel of land for which it has no further use, which land is legally described on Exhibit A attached hereto and by this reference incorporated herein and made part hereof; and WHEREAS, the Village of Elk Grove Village has found and determined that it is necessary and convenient that the Village of Elk Grove Village use and occupy the parcel for Village purposes. NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage Illinois as follows: Section 1: That it is necessary and convenient for the Village of Elk Grove Village to use and occupy the subject real estate for municipal purposes, specifically for Village right-of-way and road purposes, said property being a portion of the Village roadway expansion and improvement. Section 2: That the Village of Elk Grove Village hereby indicates the intent of the Village to accept a conveyance of said property from the Elk Grove Park District subject to restrictions and conditions of record and subject to such reservations and rights as said Elk Grove Park District shall impose in such conveyance, if any. Section 3: That the Village Manager and Village Attorney are hereby_ authorized and directed to take such steps and to execute such documents as shall be necessary to accomplish the intent of this Ordinance. Section 4: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 11th day of December 2007. Walsh, Village Clerk Ord inanceparl districtconveyance.doc EXHIBIT A That part of Lots 2 and 3 in Babbitt"s Division, being a subdivision of Lot 2 in Addison Township Supervisors Assessment Plat Number 15 of part of the East Half of Section 5, Township 40 North, Range 11 East of the Third Principal Meridian, according to the part of said Babbitt's Division recorded December 3, 1956 as document number 825499, in DuPage County, Illinois, described as follows: Beginning at the southwest corner of said Lot 3; thence on an assumed bearing of North 1 degree 33 minutes 25 seconds East along the west line of said Lots 2 and 3, a distance of 148.16 feet to a north line of the grantor; thence North 88 degrees 46 minutes 40 seconds East along a north line of the grantor, a distance of 8.01 feet to a point 8.00 feet normally distant East of the west line of said Lot 2; thence South 1 degree 33 minutes 25 seconds West along a line 8.00 feet normally distant East of and parallel with the west line of said Lots 2 and 3, a distance of 148.16 feet to the south line of Lot 3; thence South 88 degrees 44 minutes 21 seconds West along the south line of said Lot 3, a distance of 8.01 feet to the point of beginning.
