HomeMy WebLinkAboutORDINANCE - 3188 - 11/11/2008 - BONDS/VIOLATIONS OFWEIGHT AND IOAD REQUIREMENTSORDINANCE NO. 3188 AN ORDINANCE AMENDING SECTION 6-3-12B OF THE VILLAGE CODE AS IT PERTAINS TO THE SETTING OF BONDS FOR VIOLATIONS OF WEIGHT AND LOAD REQUIREMENTS BE IT ORDAINED, by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Section 6-3-12B, Bond and Bond Forfeitures pertaining to overweight and oversized vehicles be and the same is hereby amended to read as follows: B Bond and Bond Forfeitures: All persons charged with a violation of Section 6-3-12A of this Code or a violation of Chapter 15 of the Illinois Motor Vehicle Code or Section 5/3-401 D of the Illinois Motor Vehicle Code shall post a cash bond in an amount equal to the amount of the minimum fine established by the Motor Vehicle Code; plus administrative costs in the amount of twenty-five dollars ($25.00). The Defendant may, in lieu of cash bail, deposit a money order issued by a money transfer service company which has been approved by the Village.of Elk Grove Village. The money order shall be payable to the Village of Elk Grove Village. If a person who submits a bond or money order is found guilty of or pleads guilty to the offense or fails to appear for a hearing before the Administrative Adjudication Hearing Officer, the Hearing Officer may order the forfeiture of all or part of the bond or money order to the Village of Elk Grove Village. Section 2: That the Village Clerk is directed to publish this Ordinance in pamphlet form. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
