HomeMy WebLinkAboutORDINANCE - 3221 - 12/8/2009 - CENTERPOINT PROPERTIES / REZONINGORDINANCE NO. 3221 AN ORDINANCE REZONING APPROXIMATELY 6.11 ACRES OF PROPERTY LOCATED AT 1400 BUSSE ROAD FROM B -2/I-2 SPLIT ZONING TO TWO (2) SEPARATE PARCELS WITH 4.44 ACRES ZONED I-2 AND 1.7 ACRES ZONED B-2 (CENTERPOINT PROPERTIES) WHEREAS, the Plan Commission of the Village of Elk Grove Village, acting as a Zoning.Commission, at a Public Hearing duly called and held according to law, considered the question of rezoning approximately 6.11 acres of property located at 1400 Busse Road, Elk Grove Village from the B-2 and I-2 split zoning to two (2) parcels with I-2 and B-2 zoning respectively; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having reviewed the recommendation and finding of said Plan Commission, including a two (2) year sunset provision, find and believe that it is in the best interest of the Village to grant the rezoning as requested. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the Village does hereby rezone approximately 6.11 acres of property currently legally described as follows: Lot 1 in Taco Bell Resubdivision, Being a Resubdivision in Section 34, Township 41 North, Range 11, East of the Third Principal Meridian, According to the Plat thereof Recorded November 5, 1987 as Document 87598938, in Cook County, Illinois from its present split Zoning into two (2) separate zoned lots as follows: I-2 Zoning Lot 3 of the First Resubdivision of the Taco Bell Resubdivision Being a Resubdivision in Section 34, Township 41 North, Range 11, East of The Third Principal Meridian According to the Plat thereof recorded December 16, 2009 as Document Number 0935034053 in Cook County, Illinois. Containing 193,347 sq. ft. or 4,439 Acres More or Less. B-2 Zoning Lot 4 of the First Resubdivision of the Taco Bell Resubdivision Being a Resubidivion in Section 34, Township North, Range 11; East of the Third Principal Meridian According to the Plat thereof recorded December 16, 2009, as Document Number 0935034053 in Cook County, Illinois. Containing 72,951 sq. ft. or 1.674 Acres More or Less. Section 2: That this rezoning is subject to the condition that the property owner apply for and receive a building permit and commence construction in accordance therewith within two (2) years from the date this Ordinance is signed and approved. Section 3: That this ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 81h day of December 2009.
