HomeMy WebLinkAboutRESOLUTION - 43-10 - 7/13/2010 - AGREEMENTRESOLUTION NO. 43-10 A RESOLUTION AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE AN AGREEMENT BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND THE VILLAGE OF ARLINGTON HEIGHTS NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Mayor be and is hereby authorized to sign the attached documents marked: AUTOMATIC FIRE MUTUAL AID AGREEMENT BETWEEN THE VILLAGE OF ARLINGTON HEIGHTS, ILLINOIS AND ELK GROVE VILLAGE, ILLINOIS a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Mayor. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 13th day of July 2010. Keegan, Village Clerk fireMutualAidAH AUTOMATIC FIRE MUTUAL AID AGREEMENT BETWEEN THE VILLAGE OF ARLINGTON HEIGHTS, ILLINOIS AND ELK GROVE VILLAGE, ILLINOIS In accordance with 65 ILCS 5/11-6-1, which empowers municipalities and fire protection districts to enter into "Mutual Aid Agreements," and in accordance with the MABAS Agreement entered into by the Village of.Arlington Heights and Elk Grove Village in 1973, renewed in 1989, the Village of Arlington Heights and Elk Grove Village agree to provide Automatic Mutual Aid to each other on structural fire alarms as follows: GENERAL CONDITIONS Equipment responding on an automatic mutual aid response to the other community shall have a minimum of three (3) fire department personnel on fire apparatus. 2. Only one (1) unit from the fire department providing aid shall be required to respond at any one time. In the event that the unit due is unavailable (i.e., out of service, committed to another call), no back-up unit from another station shall be required to respond. 3. At all times, the municipality within which the emergency exists will be in charge and responsible for the operations at the emergency scene. If an automatic aid unit is the first on the scene, the company officer shall exercise his/her discretion as to the appropriate action to be taken. Upon arrival of a company officer from the community having jurisdiction, command of the emergency scene shall be transferred in a smooth and efficient manner to the fire department in whose municipality the emergency exists. 4. Each municipality agrees to provide and participate in quarterly training between the two fire departments. 5. Each municipality agrees that the general provisions of the MABAS Mutual Aid Agreement apply to this agreement, except as modified by this agreement. 6. Each jurisdiction agrees to waive all claims against the other party for compensation for any loss, damage, personal injury or death occurring as a result of performance in conjunction with this agreement. General liability insurance, personal injury insurance, and property/vehicle insurance shall be the responsibility of each individual jurisdiction/department. The Village of Arlington Heights Fire Department agrees to provide the Elk Grove Village Fire Department, subject to the provisions of Number Two (2) of the general conditions listed above: Engine 3 will respond on all AFAs and Code 3s within the following boundaries: NORTH: All addresses south of 1-90, with the western boundary of Arlington Heights Road. EAST: All addresses on Gaylord Street, including all addresses on Benet to King Street. SOUTH: All addresses to Oakwood Drive (includes all addresses to the one known as 53 S. Arlington Heights Road [currently occupied by Elk Grove Bowl]). Also all addresses on Higgins Road east to King Street. WEST: Arlington Heights Road 2. The Elk Grove Village Fire Department agrees to provide the Village of Arlington Heights Fire Department, subject to the provisions of Number Two (2) of the general conditions listed above: Engine 8 will respond on all AFAs and -Code 3s within the following boundaries: WEST: Tonne from Algonquin Road to Seegers Road NORTH: Seegers Road from Tonne to Goebbert Road EAST: Goebbert Road from Seegers Road to Algonquin Road SOUTH: Algonquin Road from Tonne to Goebbert Road ENTIRE AREA: Brook Drive and Clearbrook Drive TERMINATION OF AGREEMENT Either the Village of Arlington Heights or Elk Grove Village may terminate this agreement by notifying the Fire Chief of the other fire department, in writing, sixty (60) days prior to the requested date of termination. TERM OF AGREEMENT This agreement shall be effective as of the 13th day of July 2010, and shall continue in full force until terminated, in writing, by either party.
