HomeMy WebLinkAboutRESOLUTION - 50-10 - 8/17/2010 - CLASS 6B/1510 LUNT AVENUERESOLUTION NO. 50-10 A RESOLUTION DETERMINING THE APPROPRIATENESS FOR CLASS 6B STATUS PURSUANT TO THE COOK COUNTY REAL PROPERTY CLASSIFICATION ORDINANCE AS AMENDED FEBRUARY 15, 2006 FOR CERTAIN REAL ESTATE LOCATED AT 1510 LUNT AVENUE, ELK GROVE VILLAGE, ILLINOIS WHEREAS, the Village of Elk Grove Village desires to promote the development of industry in the Village of Elk Grove; and WHEREAS, the Cook County Assessor is operating under an ordinance enacted by the Cook County Board of Commissioners, and amended from time to time, the most recent amendment becoming effective as of February 15, 2006, which has instituted a program to encourage industrial and commercial development in Cook County known as the Cook County Real Property Classification Ordinance; and WHEREAS, in the case of abandoned property, if the municipality or the Mayor and Board of Trustees, finds that special circumstances justify finding that the property is "abandoned" for purpose of Class 613, even though it has been vacant and unused for less than 24 months, that finding, along with the specification of the circumstances, shall be included in the resolution or ordinance supporting and consenting to the Class 6B application. Such resolution or ordinance shall be filed with the eligibility application. If the ordinance or resolution is that of a municipality, the approval of the Board of Commissioners of Cook County is required to validate such shortened period of qualifying abandonment, and a resolution to that effect shall be included with the Class 6B eligibility application filed with the Assessor; and WHEREAS, the Petitioner has applied for or is applying for Class 6B property status pursuant to said aforementioned ordinance, for certain real estate located at 1510 Lunt Avenue, in the Village of Elk Grove Village, Cook County, Illinois, with the Property Index Number 08-34-203-003-0000, has proven to this Board that such incentive provided for in said ordinance is necessary for development to occur on this specific real estate. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1: That the request of the Petitioner to have certain real estate located at 1510 Lunt Avenue, Elk Grove Village, Cook County, Illinois, legally described as follows, and with the Property Index Number 08-34-203-003-0000 declared eligible for Class 6B status pursuant to the Cook County Real Property Classification Ordinance as amended February 15, 2006, is hereby granted in that this Board and the Village of Elk Grove Village, Illinois, has determined that the incentive provided by the said Class 6B Tax Incentive Ordinance is necessary for the said development to occur on the subject property: Lot 71 in Centex Industrial Park Unit No. 42 being a subdivision of part of Section 34, Township 41 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois Section 2: That the Special Circumstances as outlined by the petitioner are attached hereto as Exhibit "A" and made a part thereof. Section 3: That the Village of Elk Grove Village, Illinois hereby supports and consents to the Class 613 Application and approves the classification of the subject property as Class 6B property pursuant to the Cook County Real Property Classification Ordinance and the Class 6B tax incentives shall apply to the property identified as Permanent Real Estate Index Number 08-34-203-003-0000. Section 4: That the Mayor and Village Clerk are hereby authorized to sign any necessary documents to implement this Resolution. Section 5: That this Resolution shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 17th day of August 2010. Johnson Village of Elk Grove Village Exhibit ".A" Special Circumstances. Applicant 1510 Lunt Ave. LLC believes that special circumstances justify the finding that the Property is "abandoned" for the purposes of Class 613, even though it has been vacant and unused for less than 24 months, on the following grounds: a. There are many other vacant and abandoned industrial buildings located in Elk Grove Village in the area around the Property — 2 are down the street from the Property. Industrial property remains in a depressed state throughout this area. b. Designed Equipment Corporation ("DEC").. the tenant of Applicant (both DEC and Applicant are owned by Jeffrey S. Hughart and his wife, Laura.P. Peterson) current leases about 21,000 square feet in a building, with 15,000 square feet of storage yard, at 6700 W. Touhy Ave., Niles, IL 60714 from an unrelated party. DEC has outgrown that space due to sales growth and new product introduction, and needs the larger 25,000 square feet of building space, and 22,000 square feet of storage yard available at the Property. The Property has 130% of the total building and storage yard space of DEC's current premises. c. The Property provides DEC with a better layout, expanded facilities, closer proximity to suppliers; better access to interstate highways, and additional manufacturing capabilities. Applicant intends to renovate the Property by reconfiguring the office, replacing the roof, remodeling the locker room and Iunch room, and repainting. In addition, Applicant intends to improve the fence system, add landscaping, add signage. paint the exterior of the building, and resolve the drainage issue at the back of the lot. The total budget for this work is $275.000. e. The construction at the Property proposed by Applicant would create 10-15 construction jobs. f. DEC currently has 46 full-time and 2 part-time employees, most of whom live in Cool: County. If this Application is approved and the Incentive is granted, DEC expects to hire ail additional 10 full-time and 2 part-time employees, for a grand total of about 56 full-time and 4 part-time employees. In contrast, %ve understand that the previous tenant of the Property employed only about 30 persons. ;000332191 g. The Property is affordable to Applicant and DEC only if the Class 6B Real Estate Tax Incentive is granted by Elk Grove Village and the Cook County Assessor. Without the Incentive, Applicant will be forced to exercise its right under its Real Estate Purchase Agreement to terminate the Agreement and not buy the Property. Without the Incentive, DEC will have to consider relocation to an area where the real estate taxes are lower, such as DuPage or Lake County; or even northern Indiana. The construction jobs, manufacturing jobs, construction projects, and increased real estate tax base would all be lost to Elk Grove Village and Cook County. ;00033219)
