HomeMy WebLinkAboutORDINANCE - 3256 - 2/8/2011 - REZONING M TO B-3ORDINANCE NO. 3256 AN ORDINANCE REZONING PROPERTY FROM I-1 RESTRICTED INDUSTRIAL DISTRICT TO B-3 BUSINESS DISTRICT (WHITE CASTLE — 1800 OAKTON STREET) WHEREAS, the Plan Commission, acting as a Zoning Commission, at a Public Hearing duly called and held according to law, considered the question of rezoning property located at 1800 Oakton Street, Elk Grove Village from I-1 Restricted Industrial District to B-3 Business District; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having considered the recommendation and finding of said Plan Commission, find and believe that it is in the best interest of the Village that said property be rezoned as requested. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the property located at 1800 Oakton Street, Elk Grove Village Illinois be and the same is hereby rezoned from I-1 Restricted Industrial District to B-3 Business District, which property is legally described as follows: PARCEL I: LOT 1 IN LAQUINTA RESUBDIVISION IN THE SOUTHWEST QUARTER OF SECTION 23, TOWNSHIP 41 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS, ACCORDING TO THE PLAT THEREOF RECORDED SEPTEMBER 20, 1984 AS DOCUMENT NUMBER 27262582, IN COOK COUNTY, ILLINOIS. PARCEL 2: PERMANENT, NON-EXCLUSIVE EASEMENT FOR THE BENEFIT OF PARCEL 1 IN, TO, OVER, ACROSS AND THROUGH PARKING AND DRIVEWAY AREAS FOR USE BY TENANTS, EMPLOYEES, INVITEES, PATRONS, CUSTOMERS AND GUESTS, AS CREATED BY COMMON ACCESS AND CROSS -PARKING AGREEMENT DATED NOVEMBER 8, 1984 AND RECORDED DECEMBER 5, 1984 AS DOCUMENT 27361597, LOCATED ON PROPERTY AS DESCRIBED THEREIN. PARCEL3: PERMANENT, NON-EXCLUSIVE EASEMENT FOR THE BENEFIT OF PARCEL 1 FOR USING, INSPECTING, OPERATING, MAINTAINING, REPAIRING AND REPLACING UNDERGROUND SANITARY SEWER MAINS, STORM SEWER MAINS, AND WATER MAINS AND APPURTENANCES THERETO, AS CREATED BY DECLARATION AND GRANT OF EASEMENT AND AGREEMENT DATED APRIL 4, 1985 AND RECORDED MAY 16, 1985 AS DOCUMENT 85022730 BY AND BETWEEN LAQUINTA MOTOR INNS, INC., AND BOB EVANS FARMS, INC., IN, OVER, THROUGH AND UNDER THE PROPERTY DESCRIBED ON LOTS 2 AND 3 THEREIN. Section 2: That the Finding of Fact of the Plan Commission regarding property located at 1800 Oakton Street, Elk Grove Village, Illinois dated January 18, 2011 be and the same is hereby incorporated into this Ordinance. Section 3: That the Village Clerk is hereby directed to amend the official map of the Village in accordance with the rezoning set forth herein. Section 4: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 8th day of February 2011.
