HomeMy WebLinkAboutORDINANCE - 3274 - 7/19/2011 - SPECIAL USE WINGFOOTORDINANCE NO. 3274 AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO WINGFOOT COMMERCIAL TIRE SYSTEMS, LLC TO PERMIT AN AUTOMOTIVE REPAIR FACILITY IN AN I-1 GENERAL INDUSTRIAL ZONING DISTRICT ON PROPERTY LOCATED AT 300 BUSSE ROAD ELK GROVE VILLAGE ILLINOIS WHEREAS, the Plan Commission of the Village of Elk Grove Village, acting as a Zoning Commission, considered the petition of Robert Silverstein on behalf of Wingfoot Commercial Tire Systems, LLC for a Special Use Permit to operate an automotive repair facility in an I-1 General Industrial Zoning District for property located at 300 Busse Road, Elk Grove Village, Illinois; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village after having considered the recommendation and finding of said Plan Commission, find and believe it to be in the best interest of the Village that such Special Use Permit be granted. NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the Finding of Fact of the Plan Commission regarding property located at 300 Busse Road, Elk Grove Village, Illinois dated June 13, 2011 be and the same is hereby incorporated into this ordinance. Section 2: That there be granted a Special Use Permit to Wingfoot Commercial Tire Systems, LLC to permit the operation of an automotive repair shop in an I-1 General Industrial Zoned District located at 300 Busse Road, Elk Grove Village and legally described as follows: PARCEL]: LOT 1 IN SIXPENCE INN SUBDIVISION UNIT 3, BEING A RESUBDIVISION OF LOTS 2 AND 3 IN SIXPENCE INN SUBDIVISION UNIT 2, IN THE NORTHEAST 1A OF SECTION 27, TOWNSHIP 41 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED APRIL 17, 1996 AS DOCUMENT NUMBER 96289336, IN COOK COUNTY, ILLINOIS. PARCEL 2: EASEMENT FOR INGRESS AND EGRESS AS SET FORTH IN THE PLAT OF SIXPENCE INN SUBDIVISION RECORDED JULY 03, 1984 AS DOCUMENT 27157786, AND AS SET FORTH IN THE PLAT OF SIXPENCE INN SUBDIVISION UNIT 2 RECORDED SEPTEMBER I7, 1985 AS DOCUMENT 85192910, OVER A PORTION OF LOT 1 IN SAID SIXPENCE INN SUBDIVISION UNIT 2, ALL AS SET FORTH AND DELINEATED THEREON, AND AS RATIFIED AND RECREATED BY RATIFICATION AND RECREATION OF EASEMENT AGREEMENT DATED MAY 15, 1994 AND RECORDED OCTOBER 19, 1994 AS DOCUMENT 94895028 AND AS AMENDED BY THE AMENDED RECIPROCAL EASEMENT AGREEMENT DATED SEPTEMBER 8, 1995 AND RECORDED SEPTEMBER 28, 1995 AS DOCUMENT 95661359, BY AND AMONG SIXPENCE INN OF ELK GROVE VILLAGE, A PARTNERSI-IIP, MCGRAW-EDISON COMPANY, A DELAWARE CORPORATION, AND MOTEL 6 OPERATING L.P., A DELAWARE LIMITED PARTNERSHIP. PARCEL 3: PERPETUAL EASEMENT FOR INGRESS AND EGRESS AS SET FORTH IN AND CREATED BY EASEMENT AGREEMENT DATED NOVEMBER 01, 1973 AND RECORDED NOVEMBER 07, 1973 AS DOCUMENT 22538601 MADE BY AND BETWEEN MCGRAW-EDISON COMPANY AND O'HARE INTERNATIONAL BANK, N.A., AS TRUSTEE UNDER TRUST AGREEMENT DATED MAY 15. 1973 AND KNOWN AS TRUST NUMBER 76L131.
