HomeMy WebLinkAboutORDINANCE - 3279 - 12/6/2011 - SPECIAL USE - AUTOMOBILE SHOWROOM/INTERNET SALESORDINANCE NO. 3279 AN ORDINANCE AMENDING SECTION 7 -E -3.A OF THE ZONING ORDINANCE OF THE VILLAGE OF ELK GROVE VILLAGE PERTAINING TO SPECIAL USES IN 1-1 AND I-2 INDUSTRIAL DISTRICTS BY ADDING THERETO AUTOMOBILE SHOWROOMS FOR INTERNET BASED SALES AS A SPECIAL USE IN SAID WHEREAS, the Plan Commission of the Village of Elk Grove Village, at a Public Hearing duly called and held according to law, considered the question of approving a Text Amendment to the Zoning Ordinance of the Village by adding Automobile Showrooms for Internet Based Sales as a Special Use in I-1 and I-2 Industrial Districts; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having considered the recommendation and finding of said Plan Commission, find and believe it to be in the best interest of the Village that the proposed Text Amendment be added to the Zoning Ordinance as hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Section 7 -E -3.A, Special Uses in I-1 and I-2 Industrial Districts be and the same is hereby amended by adding thereto the following. Automobile Showrooms for Internet Based Sales. hi granting a Special Use Permit for Automobile Showrooms for Internet Based Sales the Village shall consider the following requirements and conditions: Except for the arrival and departure of automobiles, all activities shall occur completely within the enclosed building. 2. The use shall be limited to display of vehicles to customers by appointment only and related office use. 3. Vehicles on display must be in a "ready for sale" condition and no vehicle maintenance or repairs shall take place in the showroom or on the site in which it is located. 4. No more than one (1) such use shall be permitted in a multi -tenant structure. 5. No outdoor advertising inviting the general public to the showroom shall be permitted. 6. In granting a Special use Permit for Automovile Showrooms for Internet Based Sales, the Village shall consider compatibility with surrounding uses, the benefit to the Village to be derived from the granting of the special use permit, a'finding that the traffic generated from the use will not have deleterious effect on existing uses in proximity to the proposed use nor on the adjacent streets, that the building size is adequate for the operation, including the number of vehicles anticipated in the showroom, and whether sufficient parking exists for the number of employees and the prospective customers to the use. 7. That the business be in compliance with applicable regulations of the Illinois Secretary of State's Office with respect to licensing, and obtain a State dealer license. Section 2: That this ordinance shall be in full force and effect from and after its passage and according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 6`h day of December 2011.
