HomeMy WebLinkAboutORDINANCE - 3280 - 12/6/2011 - SPECIAL USE - AUTOMOBILE SHOWROOM/INTERNET SALESORDINANCE NO. 3280 AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO JOHN OEHLER OF NOSTALGIA LANE MOTORSPORTS, LTD. TO PERMIT THE OPERATION OF AN AUTOMOBILE SHOWROOM FOR INTERNET BASED SALES ON THE PROPERTY LOCATED AT 837-B OAKTON STREET IN ELK GROVE VILLAGE ILLINOIS WHEREAS, the Plan Commission of the Village of Elk Grove Village, at a Public Hearing duly called and held according to law, considered the question of granting a Special Use Permit to John Oehler to permit the operation of an automobile showroom for internet based sales as a Special Use on property located at 837-B Oak -ton Street; and WHEREAS, The Mayor and Board of Trustees of the Village of Elk Grove village, after considering the recommendation and finding of said Plan Commission find and believe it to be in the best interest of the Village that said Special Use Permit be granted as requested, subject to the conditions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the findings and recommendations of the Plan Commission dated October 31, 2011 be and the same are hereby incorporated into this ordinance. Section 2: That there is hereby granted a Special Use Permit to John Oehler of Nostalgia Lane Motorsports, Ltd. to permit the operation of an automobile showroom for internet based sales, which Special Use Perntit is subject to the following conditions: 1. Except for the arrival and departure of automobiles, all activities shall occur completely within the enclosed building. 2. The use shall be limited to display of vehicles to customers by appointment only and related office use. Vehicles on display must be in a "ready for sale" condition and no vehicle maintenance or repairs shall take place in the showroom or on the site in which it is located. 4. No more than one (1) such use shall be permitted in a multi -tenant structure. 5. No outdoor advertising inviting the general public to the showroom shall be permitted. 6. No more than seven vehicles can be stored at the location at one time. 7. Obtain a State Dealer License subsequent to the granting of an occupancy permit by the Village. Section 3: That this ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 6th day of December 2011.
