AN ORDINANCE AMENDING ARTICLE J. AUTOMATIC FOOD VENDING MACHINES OF
CHAPTER 5 OF TITLE 3 OF THE VILLAGE CODE BY ADDING THERETO REGULATORY
PROVISIONS FOR NON-FOOD PRODUCT VENDING MACHINES
WHEREAS, Article J. Automatic Food Vending Machines of Chapter 5 of Title 3 of the Village
Code currently regulates vending machines that contain various food products but does not regulate
vending machines for non-food product items; and
WHEREAS, the Licensing Officer of the Village has recommended an amendment to said
Article J. so as to include non-food product vending machines under the regulatory provisions of said
Section.
NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Trustees of the Village
of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That the heading for Article J. of Chapter 5 of Title 3 of the Village Code be
amended to read as follows:
ARTICLE J. AUTOMATIC VENDING MACHINES
Section 2: That Section 3-5J-1 DEFINITIONS be amended by adding thereto the following:
NON-FOOD PRODUCT VENDING MACHINE: A container or device used
for the sale or rental of non-food products such as, but not limited to,
aspirin, clothes, DVD rentals, toiletry products, novelties, sundries and
the like by the deposit of U.S. currency or token.
Section 3: That Section 3-5J-2 LICENSE REQUIRED shall be amended to read as follows:
3-5J-2 LICENSE REQUIRED: It shall be unlawful for any person to maintain or operate
a bulk food/beverage vending machine, a packaged food/beverage vending machine or a
non-food product vending machine, either by himself or through an agent, employee or
partner without first having obtained a license as is herein provided.
Section 4: That Section 3-5J-3 be amended to read as follows:
3-5J-3: APPLICATION FOR LICENSE: An application for a license under this Article
shall be made in conformity with the general requirements of this Code relating to all
applications for licenses. Such application shall also specify the number and type of
vending machines intended to be operated, a description of each type and the number of
employees to be involved in servicing the machines.
Section 5: That this Ordinance shall be in full force and effect from and after its passage and
approval according to law.
