AN ORDINANCE AMENDING SECTION 7-5-3 ENTITLED "PRELIMINARY
TREATMENT" OF CHAPTER 5 ENTITLED "INDUSTRIAL WASTES" OF TITLE 7
ENTITLED "MAINTENANCE OF PUBLIC WAYS AND PROPERTIES; WATER AND
SEWER" OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE
VILLAGE
WHEREAS, the Village of Elk Grove Village and the Metropolitan Water Reclamation
District of Greater Chicago entered into a Service Agreement; and
WHEREAS, an Amendment to said Service Agreement was passed and approved by the
Elk Grove Village Board of Trustees on January 24, 2012 by Resolution No. 7-12; and
WHEREAS, as part of said Amendment to Service Agreement, the aforementioned
parties agreed that the Village of Elk Grove Village would adopt the Metropolitan Water
Reclamation District of Greater Chicago Sewage and Waste Control Ordinance or revisions to its
existing Ordinance as part of the Municipal Code of the Village of Elk Grove Village;
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That Section 7-5-3 of Title 7, Maintenance of Public Ways and Properties;
Water and Sewer, of the Village Code of the Village of Elk Grove Village be amended by adding
thereto the following paragraphs:
The Metropolitan Water Reclamation District of Greater Chicago (MWRD) Sewage and
Waste Control Ordinance (SWCO), effective November 18, 2010, as the same may be
amended from time to time, is hereby adopted and incorporated by reference by the
Village of Elk Grove Village, as authority for administration and enforcement of the
industrial waste pretreatment program within areas of the Village of Elk Grove Village
that are subject to the agreement for sewerage services between the MWRD and the
Village of Elk Grove Village and amendments thereto.
The requirements of the SWCO are applicable to all industrial waste discharges within
the service areas of the Village of Elk Grove Village in addition to all local Ordinances
relating to industrial waste discharges to the Village's sewerage system. Where
provisions of the SWCO are in conflict with the provisions of any local ordinances, the
more stringent provisions will apply.
Section 2: That this Ordinance shall be in full force and effect from and after its passage,
approval, and publication according to law.
