AN ORDINANCE AMENDING SECTION 3-913-11 ON STREET SOLICITATION OF
THE VILLAGE CODE OF THE VILLAGE OF ELK GROVE VILLAGE
BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove
Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That Paragraph A. Permit Required of Section 3-913-11: On Street
Solicitation be amended to read as follows:
A. Permit Required: It shall be unlawful for any person to publicly solicit, either in
person or by agent, upon the streets or other public places in the Village without
having first secured a permit therefore, which permit must be on the solicitors person
at all times when solicitation occurs.
Section 2: Application For Permit: Application for a solicitor's permit shall be made to
the Village Clerk at least one month in advance of the proposed date for the solicitation and shall
set forth the full name and address of the applicant or applicants, the day or days requested for
such permit, the specific location for which the solicitation is requested and such other
information which the Village Clerk shall deem necessary. No date will be reserved for
solicitation until all required documentation has been submitted to the Village Clerk.
Section 3: That Paragraphs 4 and 5 of Paragraph C. Regulations For On Street
Solicitation of Section 3-913-11 be amended to read as follows:
4. No permit shall be issued to any person or agency more than
once in a calendar year.
5. Solicitation shall only be permitted on Thursdays, Fridays, Saturdays or Sundays
between the hours of:
6:00 a.m. and 7:00 p.m. from May 1 through September 30 and
7:00 a.m. and 5:00 p.m. from October 1 through April 301h.
Section 3: That Paragraph C. Regulations For On Street Solicitation of Section 3-913-11
be further amended by adding thereto a Paragraph 6 which shall read as follows:
6. In case of an emergency or dangerous or potentially dangerous situation, as
determined by the Chief of Police or his designated agent, or in the case of the conduct
of any solicitor being deemed to be detrimental to the safety, welfare or best interest of
the Village, the Village shall have the authority to suspend or revoke any solicitor's
permit for such period of time as deemed necessary under the circumstances.
Section 4: That any person, firm or corporation who violates any of the provisions of
this Ordinance shall be subject to a fine of not less than fifty dollars ($50.00) nor more than five
hundred dollars ($500.00)for each offense.
Section 5: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication according to law.
