AN ORDINANCE GRANTING A VARIATION OF SECTIONS 3-7:1)(1) AND 3-6:A(2)(a)
OF THE ZONING ORDINANCE AS THEY PERTAIN TO MODIFICATIONS OF A
NONCONFORMING STRUCTURE AND ENCROACHMENT OF THE TWENTY-FIVE
FOOT (251) FRONT YARD SETBACK TO PERMIT THE CONSTRUCTION OF AN
ENTRY PORTAL ON A LEGAL NON CONFORMING STRUCTURE WHICH WOULD
ENCROACH APPROXIMATELY FOURTEEN FEET ONE AND A HALF INCHES (14'-
11/2") INTO THE REQUIRED FRONT YARD ON PROPERTY LOCATED AT 175
NORTH ARLINGTON HEIGHTS ROAD (HOSKINS)
WHEREAS, the Zoning Board of Appeals, at a Public Hearing duly called and held
according to law, considered the question of granting a variation of the Zoning Ordinance to
permit the construction of an entry portal element to encroach approximately fourteen feet one
and a half inches into the required twenty five foot front yard setback of a nonconforming
structure on property located at 175 North Arlington Heights Road, Elk Grove Village; and
WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after
having reviewed the finding of said Zoning Board of Appeals, find and believe that sufficient
hardship exists so as to justify the granting of the variations requested.
NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage. Illinois as follows:
Section 1: That there be granted a variation of Sections 3-7:1)(1) and 3-6:A(2)(a) of the
Zoning Ordinance as it pertains to modifications of a nonconforming structure and encroachment
of the twenty-five foot (25') front yard setback to permit the construction of an entry portal on a
legal nonconforming structure which would encroach approximately fourteen feet one and a half
inches (14'- 1 1/2") into the required front yard on property located at 175 North Arlington
Heights Road.
Section 2: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication according to law.
