HomeMy WebLinkAboutORDINANCE - 3322 - 10/23/2012 - LAND USE PLAN OF DEVELOPMENTORDINANCE NO. 3322 AN ORDINANCE APPROVING A LAND USE PLAN OF DEVELOPMENT FOR THE APPROXIMATE 70 ACRE PARCEL OF PROPERTY LOCATED WEST OF LIVELY BOULEVARD BETWEEN HIGGINS ROAD ON THE NORTH AND OAKTON STREET ON THE SOUTH WHEREAS, the Village of Elk Grove Village is a Home Rule Municipality as established and as set forth in the Constitution of the State of Illinois and is empowered to enact legislation with respect to its government and affairs; and WHEREAS, 65 ILCS 5/11-13-1 authorizes the Village to enact legislation or adopt Ordinances concerning the classifications, regulation and location of land uses within its corporate limits or to contiguous territory not more than one and one-half miles beyond the corporate limits; and WHEREAS, there is a parcel of property consisting of approximately 70 acres which is not within the corporate limits but within one and one-half miles of the corporate limits and contiguous to the Village; and WHEREAS, the Village has requested the Land Planning Architectural firm of Gary R. Weber Associates, Inc. (`the consultant') to review potential land use and zoning for said parcel; and WHEREAS, the Consultant, after having considered the surrounding uses abutting the subject parcel, which uses include single-family and multi -family residential, commercial, office/transitional and governmental uses, has determined that the best utilization of the property would be a Planned Unit Development incorporating mixed uses compatible with the surrounding area. WHEREAS, that the mixed use plan of single-family and multi -family residential, commercial, office/transitional and governmental uses is compatible with surrounding uses, and is deemed more suitable as opposed to a large single use district such as an Industrial or Warehouse concept, which single -use concept has caused the property to remain vacant and undeveloped for many years; and WHEREAS, the subject property is located in unincorporated Cook County, and should an owner or developer petition the County for zoning other than the multi -use zoning concept herein approved, the Village shall have the authority to use said multi -use plan in filing an objection with the County with respect to any contrary zoned use. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, as follows: Section 1: That the Preamble paragraphs set forth above are hereby incorporated into this Ordinance. Section 2: That a multi -use Planned Unit Development consisting of single -fancily and multi -family residential, commercial, office/transitional and governmental uses is hereby approved for the approximate 70 acre tract of property located west of Lively Boulevard between Higgins Road on the north and Oakton Street on the south. Section 3: That this Ordinance shall be in full force and effect from and after its passage and approval this 2.3 day of October 2012.
