HomeMy WebLinkAboutRESOLUTION - 51-13 - 10/22/2013 - CLASS 6B- 575 LIVELYRESOLUTION NO. 51-13 A RESOLUTION DETERMINING THE APPROPRIATENESS FOR CLASS 6B STATUS PURSUANT TO THE COOK COUNTY REAL PROPERTY CLASSIFICATION ORDINANCE AS AMENDED FEBRUARY 15, 2006 FOR CERTAIN REAL ESTATE LOCATED AT 575 LIVELY BOULEVARD, ELK GROVE VILLAGE, ILLINOIS WHEREAS, the Village of Elk Grove Village desires to promote the development of industry in the Village of Elk Grove; and WHEREAS, the Cook County Assessor is operating under an ordinance enacted by the Cook County Board of Commissioners, and amended from time to time, the most recent amendment becoming effective as of February 15, 2006, which has instituted a program to encourage industrial and commercial development in Cook County known as the Cook County Real Property Classification Ordinance; and WHEREAS, in the case of abandoned property, if the municipality or the Mayor and Board of Trustees, finds that special circumstances justify finding that the property is "abandoned" for purpose of Class 613, even though it has been vacant and unused for less than 24 months, that finding, along with the specification of the circumstances, shall be included in the resolution or ordinance supporting and consenting to the Class 6B application. Such resolution or ordinance shall be filed with the eligibility application. If the ordinance or resolution is that of a municipality, the approval of the Board of Commissioners of Cook County is required to validate such shortened period of qualifying abandonment, and a resolution to that effect shall be included with the Class 6B eligibility application filed with the Assessor; and WHEREAS, the Petitioner has applied for or is applying for Class 613 property status special circumstances pursuant to said aforementioned ordinance, for certain real estate located at 575 Lively Boulevard, in the Village of Elk Grove Village, Cook County, Illinois, with the Property Index Number 08-27-202-051-0000, has proven to this Board that such incentive provided for in said ordinance is necessary for development to occur on this specific real estate. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1: That the request of the Petitioner to have certain real estate located at 575 Lively Boulevard, Elk Grove Village, Cook County, Illinois, legally described as follows, and with the Property Index Number 08-27-202-051-0000 declared eligible for Class 613 special circumstances status pursuant to the Cook County Real Property Classification Ordinance as amended February 15, 2006, is hereby granted in that this Board and the Village of Elk Grove Village, Illinois, has determined that the incentive provided by the said Class 613 Tax Incentive Ordinance is necessary for the said development to occur on the subject property: Lot 196, in Higgins Industrial Park Unit 137, being a subdivision of the Northeast quarter of Section 27, township 41 North, Range I 1 East of the Third Principal Meridian, excepting therefrom that part described as follows: Commencing at the Northwest comer of Lot 196 aforesaid; thence South 00 degrees 38 minutes 28 seconds East along the West line of Lot 196 aforesaid, 118.35 feet for a point of beginning; thence continuing South 00 degrees 38 minutes 28 seconds East along said West line of Lot 196, a distance of 31.39 feet; thence Southeasterly along the said West line of Lot 196, a distance of 31.67 feet on a tangential curve to the left having a radius of 20.00 feet, the chord of said curve bears South 46 degrees 00 minutes 12 seconds East, 28.46 feet; thence North 88 degrees 38 minutes 03 seconds East along tangent, 31.39 feet; thence Northwesterly a distance of 80.76 feet along a non-tangential curve to the right having a radius of 51.00 feet, the chord of said curve bears North 46 degrees 00 minutes 12 seconds West, 72.58 feet to the point of beginning, in Cook County, Illinois. Section 2: That the Special Circumstances as outlined by the petitioner are attached hereto as Exhibit "A" and made a part thereof. Section 3: That the Village of Elk Grove Village, Illinois hereby supports and consents to the Class 613 Application and approves the classification of the subject property as Class 613 property pursuant to the Cook County Real Property Classification Ordinance and the Class 613 tax incentives shall apply to the property identified as Permanent Real Estate Index Number 08-27-202-051-0000. Section 4: That the Mayor and Village Clerk are hereby authorized to sign any necessary documents to implement this Resolution. Keegan, Village Clerk Res6 bTax5 7 %velyspecial Exhibit "A" SARNOFF & BACCASH Special Circumstances Requested by Masterpiece Acquisitions, LLC 575 Lively IBlvd.,.Elk Grove Village, Illinois WIN: 08-27-202-051-0000) Masterpiece Acquisitions, LLC ("Applicant") is requesting a Resolution in support and consent of Class 6b Incentive on the property located at 575 Lively Blvd, in Elk Grove Village, Illinois (PIN; 08-27-202-051- 0000) based on occupation of abandoned property that has been vacant for less than twenty-four (24) continuous months with a purchase for value, special circumstances and substantial rehabilitation. The Applicant plans on leasing the subject property to a related entity, J.C. Technology, Inc. d/b/a Ace Computers ("Ace Computers"), for its own operations consisting of the assembly, warehousing and distribution of computers for the government and education markets. The subject property consists of an approximately 36,623 square foot site with a roughly 15,000 square foot building that has been 100% vacant and unused since January 11, 2012. The subject property is in need of significant improvements, and therefore, the Applicant has allotted approximately $25,000 for immediate improvements to the same. Based on initial inspections, these immediate improvements will be to the electrical, floors, walls, to replace the HVAC units and update the interior as well as for other general maintenance. Further inspections of the subject property may require additional improvements, including but not limited to converting the current loading dock into an indoor dock. Ace Computers is located in Arlington Heights and plans to move its entire operation to the subject property and bring all 18 of its current employees to the same. In addition, Ace Computers plans on adding approximately 1 to 3 new employees as soon as possible upon moving into the subject property and will look to hire all qualified Village of Elk Grove Village residents for future hires. However, the above is all contingent on the Applicant receiving a Class 6b Incentive. Based on our research and the additional costs that must be incurred to rehabilitate the building in order for this to be a successful endeavor, the Applicant must possess a Class 6b Incentive to complete the substantial rehabilitation thereof and to successfully operate the subject property. It is for these reasons that it is necessary to grant the Applicant a Resolution in support and consent of a Class 6b Incentive for the above -referenced property based on occupation of abandoned property for less than twenty-four (24) months of continuous vacancy with a purchase for value, special circumstances and substantial rehabilitation.
