HomeMy WebLinkAboutORDINANCE - 3365 - 12/17/2013 - BUILDING ACTIVITY CODE AMENDEDORDINANCE NO. 3365 AN ORDINANCE AMENDING TITLE 8, CHAPTERS 3B, 3C, 3D, 3E, 3F, AND ADDING THERETO CHAPTERS 3G, 3H, AND 31 OF THE BUILDING ACTIVITY -CODE OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, as follows: Section 1: That 8-3B-1 be amended to read as follows: A. Code Adopted: There is hereby adopted by reference as if fully set out herein, that certain code known as the International Residential Code for one and two-family dwellings, 2012 edition, prepared and published by the International Code Council, together with the additions, insertions, deletions and changes hereinafter set forth, one (1) copy which is available for inspection and on file in the office of the Village Clerk. This code shall govern the construction of detached one and two-family dwelling units, their appurtenances, and their accessory structures except that the provisions of the International Building Code, 2012 edition, as amended, shall apply to items not specifically covered by the International Residential Code for one and two-family dwellings, 2012 edition. B. Amendments: The following additions, insertions, deletions and changes are hereby made to the International Residential Code for one and two-family dwellings, 2012 edition: 1. Section R101.1. Under `Name of Jurisdiction" insert "Village of Elk Grove Village" 2. Section RI 05.2 Work exempt from permit. Delete sections "Building" items 1, 2, 3, 4, 5, 9, and 10. 3. Section R107 Temporary Structures and Uses. Amend Section R107.1 General to read as follows: R107.1 General. Temporary structures and uses are permitted during and for construction purposes only. Delete Sections R107.2 Conformance; R107.3 Temporary Power; and R107.4 Termination of Approval. 4. Section R202 Definitions. The definition of Structure is hereby amended to read as follows: Structure. Any construction, or any production or piece of work artificially built up or composed of parts joined together in some definite manner; or, any combination of materials to form a construction for occupancy, use or ornamentation whether installed on, above or below the surface of a parcel of land. 5. Section R202 Definitions. Add new definition of Temporary Structure as follows: Temporary Structure. All membrane structures (as defined in Section 3102.2 of the International Building Code); or any structure originally designed for mobile or transportation purposes (i.e., truck trailers, shipping or freight containers, etc.); or any structure without a permanent foundation (excepting there from residential storage sheds not exceeding one -hundred fifty (150) square feet in floor area). 6. Section R309 Garages and Carports is amended as follows: Section R309.5 Fire sprinklers is amended by adding "When required by section R313.2 of this code" to the beginning of the first sentence. Add Section R309.6 General. Off-street parking spaces required by the zoning regulations shall be provided in a completely enclosed building for the following construction: All new single-family dwellings. ii. All reconstructed single-family dwellings where over fifty percent (50%) of the structure above the foundation is razed. 7. Section R315 Carbon Monoxide Alarms shall be deleted in its entirety and replaced with the following: Section R315 Carbon Monoxide Detectors. i. Every dwelling unit shall be equipped with at least one approved carbon monoxide alarm in an operating condition within 15 feet (15') of every room used for sleeping 2 purposes. The carbon monoxide alarm may be combined with smoke detecting devices provided that the combined unit complies with the respective provisions of the administrative code, reference standards, and departmental rules relating to both smoke detecting devices and carbon monoxide alarms and provided that the combined unit emits an alarm in a manner that clearly differentiates the hazard. ii. Every structure that contains more than one dwelling unit shall contain at least one approved carbon monoxide alarm in operating condition within 15 feet (15') of every room used for sleeping purposes. iii. It is the responsibility of the owner of a structure to supply and install all required alarms. It is the responsibility of a tenant to test and to provide general maintenance for the alarms within the tenant's dwelling unit or rooming unit, and to notify the owner or the authorized agent of the owner in writing of any deficiencies that the tenant cannot correct. The owner is responsible for providing one tenant per dwelling unit with written information regarding alarm testing and maintenance. The tenant is responsible for replacement of any required batteries in the carbon monoxide alarms in the tenant's dwelling unit, except that the owner shall ensure that the batteries are in operating condition at the time the tenant takes possession of the dwelling unit. The tenant shall provide the owner or the authorized agent of the owner with access to the dwelling unit to correct any deficiencies in the carbon monoxide alarm that have been reported in writing to the owner or the authorized agent of the owner. iv. The carbon monoxide alarms required under this act may be either battery powered, plug- in with battery backup, or wired into the 3 structure's AC power line with secondary battery backup. 8. Section R322 Flood -Resistant Construction is deleted in its entirety. 9. Section R402.1 Wood Foundations is deleted in its entirety. 10. Section R405.1 Concrete or Masonry Foundations is amended to read as follows: Drains shall be provided around all concrete or masonry foundations enclosing habitable or usable spaces located below grade. Drainage tiles, gravel or crushed stone drains, perforated pipe or other approved systems or materials shall be installed at or below the area to be protected and shall discharge by gravity or mechanical means into an approved drainage system. Foundation drainage shall not discharge in such a manner so as to create a nuisance on adjacent properties. When, in the opinion of the Director of Community Development the discharge of foundation drainage is creating a nuisance on adjacent properties, the Director shall require the discharge pipe to be relocated so that it terminates no closer than ten feet (10') from any adjoining property line. Gravel or crushed stone drains shall extend at least one foot (1') beyond the outside edge of the footing and six inches (6") above the top of the footing and be covered with an approved filter membrane material. The top of open joints of drain tiles shall be protected with strips of building paper, perforated drains and the drainage tiles or perforated pipe shall be placed on a minimum of two inches (2") of washed gravel or crushed rock at least one sieve size larger than the joint opening or perforation and covered with not less than six inches (6") of the same material. 11. Delete the Exception in Section R405.1 12. Delete Section R504 Pressure Preservatively Treated -Wood Floors (On -Ground) 13. Electrical. Amend Chapter 35 General Requirements to read as follows: Z The electrical requirements shall conform to the provision of the most current edition of NFPA 70, National Electrical Code and Title 8, Chapter 3, Article C of the Municipal Code. 14. Appendix G. Add new Section AG109 Drainage Systems as follows: Drainage Systems: Water discharged from swimming pools shall be directed to the public street through the use of a discharge hose unless such discharge can occur directly into a storm sewer structure located in rear yards by the use of a continuous discharge hose from the swimming pool to the stoma sewer structure. Any encroachment of adjacent property by the discharge hose must first have the approval of the appropriate homeowner(s). At no time, shall water discharged from a swimming pool be permitted to encroach upon any adjacent property and in no case shall the overland discharge of swimming pool water be permitted unless such overland flow can be confined to the property upon which the swimming pool is located. Water discharged from swimming pools shall not create hazards to either pedestrians using the public sidewalk or vehicles using the public street. Water shall not be discharged during periods of rain or stones and at no time shall the discharge rate exceed a flow of 200 gallons per minute. Section 2: That 8-313-2 be amended to read as follows: A. Code Adopted: There is hereby adopted by reference, as if fully set out herein, governing the construction of all other structures (exclusive of one and two-family dwelling units) within the Village, that certain code known as the International Building Code, 2012 edition, prepared and published by the International Code Council, together with the additions, insertions, deletions and changes hereafter set forth in the remaining article of this chapter, one (1) copy which is available for inspection and on file in the office of the Village Clerk. B. Amendments: The following additions, insertions, deletions and changes are hereby made to the International Building Code, 2012 edition: y Section 101.1 Under "Name of Jurisdiction" insert "Village of Elk Grove Village". 2. Section 101.4.7 is added to read as follows: Electrical. The provisions of the most current edition of NFPA 70: National Electrical Code and Title 8, Chapter 3, Article C of the Municipal Code shall apply to the installation of electrical systems, including alterations, repairs, replacement, equipment, appliances, fixtures, fittings and appurtenances thereto. 3. Delete Section 103 Department of Building Safety. 4. Delete Section 113.3 Qualifications 5. Section 202 Definitions. The definition of Structure is hereby amended to read as follows: Structure. Any construction, or any production or piece of work artificially built up or composed of parts joined together in some definite manner; or, any combination of materials to form a construction for occupancy, use or ornamentation whether installed on, above or below the surface of a parcel of land. 6. Section 8202 Definitions. Add new definition of Temporary Structure as follows: Temporary Structure. All membrane structures (as defined in Section 3102.2 of this Code); or any structure originally designed for mobile or transportation purposes (i.e. truck trailers, shipping or freight containers, etc.); or any structure without a permanent foundation. 7. Add new Sections 403.3.4 and 403.3.5 as follows: 403.3.4 Shut-off Valves and Waterflow Devices. Shut-off valves and a waterflow device shall be provided for each floor. 403.3.5 Valve Supervision. Valves shall be supervised by a continuously manned control station or central station. 8. Section 415.1 Scope is hereby amended to read as follows: The provisions of this section shall apply to the storage and use of hazardous material in excess of the maximum allowable quantities per control area listed in Section 307.1. 6 ALL BUILDING AND STRUCTURES WITH AN OCCUPANCY IN USE GROUP H SHALL BE LOCATED IN A SEPARATE FREE-STANDING BUILDING AND NOT IN A MULTI -TENANT BUILDING. Buildings and structures with an occupancy in Group H shall also comply with the applicable provision of Section 414 and the International Fire Code. 9. Table 503 Height and Area Limitations of building is hereby amended as follows: 1. The height and area limitations for F-2 and S-2 shall be the same as F-1 and S-1. 2. Lines R -I and R-2 under columns 3B, 5A and 5B shall be eliminated. 313, 5A and 5B construction shall not be permitted for R-1 and R-2 use groups. 10. Section 705.4 Materials is hereby amended to read as follows: Section 705.4 Materials. In the I-1 and I-2 districts, exterior walls of all principle and accessory structures shall consist of brick, masonry, stone, split face block, precast or cast in place concrete or other equivalent non-combustible rigid construction. Metal clad buildings or parts thereof and membrane structures shall not be permitted. In all other districts, exterior walls shall be of materials permitted by the building type of construction. 11. Section 706.5 Horizontal Continuity is hereby amended by deleting Exceptions 1 and 2. 12. Section 706.6 Vertical Continuity is hereby amended by deleting Exceptions 2, 3 and 4. 13. Add new Section 706.8.1 as follows: Hold -Open Devices: heat -actuated hold -open devices shall be installed on both sides of the wall, and shall be interconnected so that the operation of any single device will permit the door to close. Heat detectors of fusible links shall be installed at the door opening and at the ceiling in compliance with NFiPA 80 listed in Chapter 35 for the particular type of door to be installed. Alt side - hinged doors in firewalls and fire separation assemblies shall be closed by activation of a smoke detector or fire VA alarm signal that is in compliance with NFiPA 80 listed in Chapter 35. 14. Section [F] 903.2 Where required is hereby amended to read as follows: [F] 903.2 Where required. Approved automatic sprinkler systems shall be provided in the locations described in this section. 1. In new buildings and structures approved automatic sprinkler systems shall be provided in Use Group Classifications A, B, E, F, H, I, M, RI, R2 and S irrespective of the size of the fire area or occupant load. 2. In existing buildings and structures approved automatic sprinkler systems shall be provided in accordance with the provisions of Sections [F] 903.2.1 through [F] 903.2.12. 3. Additions to any building or structure equal to or exceeding fifty percent (50%) of the gross floor area of the original building construction, as identified on the permit records and construction drawings approved by the Village when the structure was first constructed, shall require the installation of an approved automatic sprinkler system throughout the entire existing and proposed building or structure in accordance with paragraph 1. above. 4. Any change in Use and Occupancy which reclassifies a building or structure or portion thereof to a High - Hazard Group H occupancy shall require the installation of an approved automatic sprinkler system throughout the entire existing and proposed building or structure in accordance with paragraph 1. above. 5. Approved automatic sprinkler systems in existing building or structures shall be maintained in operational condition and shall be extended into any new construction notwithstanding any change in use which could eliminate the need for sprinkler protection. 15. Section [F] 903.3.1.2 NFPA 13R Sprinkler Systems is hereby deleted. 16. Section [F] 903.4 Sprinkler System Supervision and Alarms is hereby amended by deleting Exception 2. 8 17. Section [F] 905.1 General is hereby amended by adding thereto the following: Standpipes required by this section shall be installed within one floor of the highest point of construction having secure decking as flooring. 18. Section [F] 907.2.1 Group A is hereby amended to read as follows: [F] 907.2.1 Group A. A manual fire alarm system shall be installed in Group A-1, A-2 and A-3 occupancies having an occupant load of 50 or more. A manual fire alarm system shall be installed in Group A-4 and A-5 occupancies having an occupant load of 300 or more. Portions of Group E occupancies occupied for assembly purposes shall be provided with a fire alarm system as required for the Group E occupancy. In all Group A occupancies, all buildings shall be equipped with an approved heat and smoke detection system. (The Exception is deleted). 19. Section [F] 907.2.2 Group B is hereby amended to read as follows: [F] 907.2.2 Group B. A manual fire alarm system shall be installed in Group B occupancies having an occupant load of 500 or more persons or more than 100 persons above or below the lowest level of exit discharge. A manual and automatic fire alarm system shall be installed in Group B occupancies containing more than 7,500 square feet in gross floor area. (The Exception is deleted). 20. Section [F] 907.2.3 Group E is hereby amended by adding: In Group E Occupancies all buildings shall be equipped with an approved heat and smoke detection system. (Exceptions 1, 2 and 3 are deleted). 21. Section [F] 907.2.4 Group F is hereby amended to read as follows: [F] 907.2.4 Groups F1, F2, S1 and S2. A manual fire alarm system shall be installed in all buildings of Fl, F2, S1 and S2 occupancy classifications. All tenant spaces shall be equipped with manual pull stations. (The Exception is deleted). 22. Section [F] 907.2.7 Group M is hereby amended as follows: Delete Exception 2. 23. Section [F] 907.2.8.1 Manual Fire Alarm System is hereby amended as follows: Delete Exception 2. 24. Section [F] 907.2.9.1 Manual fire alarm system, sub- paragraph 1. is hereby amended to read as follows: 1. Any dwelling unit or sleeping unit is located two or more stories above the lowest level of exit discharge: (Delete Exception 2). 25. Add new Section [F] 907.2.24 as follows: [F] 907.2.24 Senior Citizen Housing. A manual fire alarm system and an approved heat and smoke detection system shall be installed in all Senior Citizen Housing occupancies as defined in the Elk Grove Village Zoning Ordinance. 26. Add new Section [F] 907.9 as follows: [F] 907.9 Non -required systems. All non -required systems which are supervised shall use equipment listed for that particular fire alarm system. Non -required systems shall be installed in accordance with Section 907 of this code and maintained in good working order. 27. Section [F] 912.1 Installation is hereby amended by adding the following: Fire Department connections shall be arranged in such a manner that the use of any one water sprinkler connection 10 will serve all sprinklers, and the use of any one standpipe will serve all standpipes within the building. For the purposes of this section, the term "building" will be interpreted to mean the footprint of the entire structure encompassing the entire area within the outside limits of the exterior walls, roof, or architectural trim of the structure. Firewalls or other separation walls shall not be considered an exterior wall for the purposes of interpreting this section. 28. Section [F] 912.2 Location is hereby amended to read as follows: [F] 912.2 Location. Fire Department connections shall be located where they will be visible from the public street or other location approved by the Fire Department. They shall be located so that immediate access can be made by the Fire Department. Fire Department connections shall not be obstructed by fences, bushes, trees, walls or similar objects. A ten -inch (10") waterflow alarm bell and illuminated identification device shall be located above the connection. A six-inch (6") waterflow alarm bell shall be located inside the building by the sprinkler riser. 29. Section 1008.1.9.3 Locks and latches is hereby amended by deleting sub -paragraph 2. 30. Section 1027.5 Access to a public way is hereby amended to read as follows: 1027.5 Access to a public way. From each grade floor exit from a building there shall be provided a hard surface area, a minimum of forty-eight inches (48") in width centered on that door, extending from the door to a property line adjoining a public street. 31. Delete Section 1809.5 Frost Protection. 32. Section 3001.2 Referenced standards is hereby amended to read as follows: 3001.2 Referenced standards. Referenced Standards to be as stringent and comply with current Illinois Elevator Safety Act (225 ILCS 312) and its rules. For private residential conveyance application, the Act does not apply. However, the IBC code shall apply for new installation, 11 permits and final acceptance. For applications not covered by the Illinois Elevator Safety Act, those conveyance applications shall comply with the provisions of the IBC. 33. Add new Section 3001.5 Amendments as follows: 3001.5 Amendments. The following additions, insertions deletions and changes are hereby made to ASME 2004 Al7.1. a. Section 2.7.3.1 Access to Machine Rooms and Machinery Spaces shall be amended as follows: General Requirements: A permanent safe, convenient means of access into the elevator machine room and overhead machinery spaces shall be provided for elevator maintenance personnel only. The elevator machine room shall not be used for a through passage to and from other spaces, roof, electric maintenance, etc. b. Section 2.8.2.3.1 Shut-off valves in Sprinkler Branch Lines shall be amended as follows: Shut-off Valves with a tamper -proof electrical switch back to a fire alarm panel shall be provided for each branch line for machine room and shaft in an accessible location outside these spaces. c. Section 2.10.1 Guarding of Equipment shall be amended as follows: In machine rooms and secondary machinery spaces, the following shall be guarded to protect against accidental contact: 1. Driving machine sheaves and ropes whose vertical projection upon horizontal plane extends beyond the base of the machine; 2. Sheaves; 3. Exposed gears, sprockets, tape or rope sheaves, or drums of selectors, floor controllers, or signal and driving machines guards, and their driving ropes, chains, or tapes; and 4. Keys, keyways, and screws in projecting shafts. Hand winding wheels and flywheels that are not guarded shall have yellow markings. 12 d. Amend the first sentence of Section 2.14.7.1.3 to read as follows: Passenger and freight elevators shall be provided with a standby emergency lighting power source on each elevator conforming to the following. e. Add new Section 2.7.3.4(B) as follows: 2.7.3.4(B) All machine room doors shall be 1% hour B label self-closing and locking. f. Section 3.7.1 shall be amended as follows: The requirements of 3.7.1 shall be the same as the requirements of Section 2.7.1.1.1. g. Section 3.19.4.1 is hereby amended by adding thereto the following sentence: A permanent handle shall be attached to the valve for shut-off purposes. h. Add new Section 5.3.1.1.4.5 as follows: 53.1.1.4.5 Private residence elevators. The private residence elevator room shall be as follows: Minimum of 1 -hour fire resistance. Minimum 60" wide by 24" deep. Maximum 60" wide by 60" deep. Head Room Minimum 84" high. Door to be minimum 36" wide by 80" self-closing and locking. Main Line Disc Switch to be fused, heavy duty, lock side of door. Car Light Disconnect Switch to be fused, heavy duty, lock side of door inside room. Room light switch, lock side of door. Minimum illumination 5FTC inside room. Room to have a IIOV GFI Duplex outlet below light switch. Minimum 51b ABC Fire Extinguisher in Machine Room, lock side of door, i. Add new Section 5.3.1.8.3 as follows: 13 3.1.8.3 Light in car. Emergency battery backup hting shall be provided in accordance with Section 14.7.1.3. Id new Section 5.3.2.3.1 as follows: 3.2.3.1 Machine room -hydraulic. A machine room shall be provided in accordance with Section 53.1.1.4.5. k. Add new Section 5.3.1.19 as follows: 5.3.1.19 Emergency signal. The emergency battery backup signaling device shall comply with Section 2.27.1.2. 1. Add the following paragraphs to Section 5.2.1.27 Emergency Operation and Signaling service. Telephone connection to a 24-hour service shall be required. An emergency light and alarm shall also be installed in the elevator. Phase I and II fire service. Phase I and II fire service with smoke sensor recall shall be provided on the elevator. When the machine room or shaft is sprinklered, a SHUNT TRIP device controlled by a heat sensor shall be installed. in. Add new Section 8.10.3.2.2M as follows: 8.10.3.2.2.M . Hydraulic working pressure shall be checked by running the elevator with a full load in the car and the pressure verified as per the Data Plate. 34. Section 3002.4 Elevator car to accommodate ambulance stretcher is hereby amended to read as follows: 3002.4 Elevator car to accommodate ambulance stretcher. In all buildings at least one elevator shall be provided for fire department emergency access to all floors in building. Such elevator car shall be of such size and arrangement to accommodate a minimum 24 -inch by 84 -inch ambulance stretcher in the horizontal open position and shall be 14 identified by the International Symbol for emergency medical services (Star of Life). The symbol shall not be less than 3 x 3 inches high and wide (87 mm x 76 mm) and shall be placed inside on both sides of the main lobby hoist way doorframe. 35. Section 3003.2 Firefighter's emergency operation is hereby amended to read as follows: 3003.2 Firefighter's Emergency Operation. Elevators shall be provided with Phase 1 emergency recall operation and Phase 2 emergency in car operation in accordance with ASME A17.1 and NFPA 72. 36. Add new Section 3005.4.1 as follows: 3005.4.1 Miscellaneous hoisting and elevating equipment: All miscellaneous hoisting and elevating equipment shall be subjected to tests and inspections as required by the AHJ to ensure safe operation. As per changes, a full load governor and full load safety test to be done after installation of hoist, a major alteration, and a jump of the hoist tower travel. 37. Section 3005.3 Conveyors is hereby amended to read as follows: 3005.3 Conveyors: Conveyors and related equipment shall be inspected and tested in accordance with ASME B20.1 listed in Chapter 35 and Section 3005.4 regarding personal hoists. 38. Section 3006.1 Access is hereby amended to read as follows: 3006.1 Access. An approved means of access shall be provided to elevator machine rooms and overhead machinery equipment spaces. This means is not to be used as a passageway through the machine room to other areas of the building or roof. 39. Section 3006.4 is hereby amended by deleting exception 2. 40. Add new Section 3006.7 as follows: 3006.7. Lighting protection. All machine room/control room lighting shall be protected against external breakage. 15 41. Add new Section 3009 entitled Existing Elevators. 42. Add new Section as follows: 3009.1 General. All Existing Elevators to comply with ASME 2002 173 Safety Code for existing elevators and escalators. 43. Add new Section 3010 entitled Maintenance and Accidents. 44. Add new Section 3010.1 as follows: 3010.1 Owner Responsibility. The owner or the owner's legal agent for the building in which the equipment is located shall be responsible for the care, maintenance and safe operation of all equipment covered by this article after the installation thereof and acceptance by such owner or agent. The owner or legal agent shall make or cause to be made all periodic tests and inspections, and shall maintain all equipment in a safe operating condition, as required by this article. 45. Add new Section 3010.2 as follows: 3010.2 Contractor Responsibility. The person installing any device covered by this article shall make all acceptance tests and shall be responsible for the care and safe operation of such equipment during its construction and until temporarily or finally accepted by the AHJ (Authority Having Jurisdiction) Elevator Inspector. 46. Add new Section 3010.3 as follows: 3010.3 Maintenance Items. All operating and electrical parts and accessory equipment or devices subject to this article shall be maintained in a safe operating condition. The maintenance of elevators, dumbwaiters and escalators shall conform to ASME A17.1 listed in Appendix A. 47. Add new Section 3010.4 as follows: 3010.4 Unsafe Conditions. If, upon inspection, any equipment covered in this article is found to be in an unsafe condition, or not in accordance with the provisions of this code, the AHJ shall thereupon serve a written notice of such finding upon the building owner or lessee, stating the time when recommended repairs or changes shall be 16 completed. After the service of such notice, it shall be the duty of the owner to proceed within the time allowed to make such repairs or changes as are necessary to place the equipment in a safe condition. It shall be unlawful to operate such equipment after the date stated in the notice unless such recommended repairs or changes have been made and the equipment has been approved, or unless an extension of time has been secured from the AHJ in writing. Time duration to be 24 hours, 7 days, 15 days or maximum 30 days. 48. Add new Section 3010.4.1 as follows: 3010.4.1 Power to Seal Equipment. In cases of emergency the AHJ, in addition to any other penalties herein provided, shall have the power to seal out of service any device or equipment covered by this article when, in the opinion of the AHJ, the condition of the device is such that the device is rendered unsafe for operation; or for willful failure to comply with recommendations and orders. 49. Add new Section 3010.4.2 as follows: 3010.4.2 Notice of Sealing Out of Service. Before sealing any device out of service, the AHJ, except in case of emergency, shall serve written notice upon the building owner or lessee stating intention to seal the equipment out of service and the reasons therefore. 50. Add new Section 3010.4.3 as follows: 3010.4.3 Unlawful to Remove Seal. Any device sealed out of service by the AHJ shall be plainly marked with a sign or tag indicating the reason for such sealing. Any tampering with, defacing or removal of the sign, tag or seal without approval shall constitute a violation of this article. 51. Add new Section 3010.5 as follows: 3010.5 Accidents Reported and Recorded. The owner of the building shall immediately notify the AHJ of every accident involving personal injury or damage to apparatus on, about or in connection with any equipment covered by this article, and shall afford the AHJ every facility for investigating such accident. When an accident involves the failure, breakage, damage or destruction of any part of the apparatus or mechanism, it shall be unlawful to use such device until after an examination by the AHJ is made and 17 approval of the equipment for continued use is granted. It shall be the duty of the AHJ to make a prompt examination into the cause of the accident and to enter a full and complete report thereof in the records of the building department. 52. Add new Section 3010.6 as follows: 3010.6 Removal of Damaged Parts. It shall be unlawful to remove from the premises any part of the damaged construction or operating mechanism of elevators, or other equipment subject to the provisions of this article, until permission to do so has been granted by the AHJ. 53. Add new section 3011 entitled Certificate of Compliance. 54. Add new Section 3011.1 as follows: 3011.1 The operation of all equipment governed by the provisions of this chapter and hereafter installed, relocated or altered shall be unlawful by persons other than the installer until such equipment has been inspected and tested as herein required and a final Certificate of Compliance has been issued by the AHJ. 55. Add new Section 3011.2 as follows: 3011.2 Posting Certificates of Compliance. The owner or lessee shall post the current -issued Certificate of Compliance in a conspicuous place inside the elevator. 56. Add new Section 3012 entitled Construction Documents and Permits. 57. Add new Section 3012.1 as follows: 3012.1 Application. The application for a permit shall be accompanied by construction documents in sufficient detail and indicating the location of the machinery room and equipment to be installed, relocated or altered; and all supporting structural members, including foundations. The construction documents shall indicate all materials to be used and all loads to be supported or conveyed. Documents to be reviewed and approved before permit is issued. 58. Add new Section 3012.2 as follows: M 3012.2 Permits. Equipment or devices subject to the provisions of this code shall not be constructed, installed, relocated or altered unless a permit has been received from the AHJ before the work is commenced. A copy of such permit shall be kept at the construction site at all times while the work is in progress. 59. Add new Section 3013 entitled Tests and Inspections. 60. Add new Section 3013.1 as follows: 3013.1 General. All equipment and devices covered by the provision of this code shall be subjected to acceptance and maintenance tests and periodic inspections as required herein. 61. Add new Section 3013.2 as follows: 3013.2 Acceptance Tests. Acceptance tests and inspections shall be required on all new, relocated and altered equipment subject to the provisions of this chapter. Tests and inspections shall be of such a nature as to determine whether the entire installation is designed, constructed and installed in compliance with this code, and shall include all parts of the equipment and machinery. In addition, Full Load Tests to be done on all equipment. All such tests shall be made in compliance with the requirements of Section 8, 10 and in the presence of the AHJ, or by an approved agency for the AHJ and by the person installing such equipment. 62. Add new Section 3013.3 as follows: 3013.3 Periodic Tests and Periodic Inspections. Periodic tests shall be required on all new and existing power of elevators, and periodic inspections shall be made of all new and existing equipment subject to the provisions of this chapter. 63. Add new Section 3013.3.1 as follows: 3013.3.1 Periodic Tests. Periodic tests shall be made by the AHJ, or by an approved agency, and shall be made at the expense and responsibility of the owner. Where such tests are not made by the AHJ, the approved agency shall submit a detailed report of the tests to the AHJ on approved forms not more than 30 days after the completion of the tests. 19 64. Add new section 3013.3.2 as follows: 3013.3.2 Periodic Inspections. Periodic inspections shall be made by the AHJ or by an approved agency. Where such inspections are not made by the AHJ, the approved agency shall submit a detailed report of the inspection to the AHJ on approved forms not more than 30 days after completion of the inspection. 65. Add new Section 3013.3.3 as follows: 3013.3.3 Frequency of Tests and Inspections. Tests and inspections shall be conducted at intervals of not more than those set forth in ASME A17.1 listed in Chapter 35 for elevators, escalators, dumbwaiters and moving walks. 66. Section 3103 Temporary Structures. Amend Section 3103.1 General to read as follows: 3103.1 General. Temporary structures and uses are permitted during and for construction purposes only. Delete Sections 3103.1.1 Permit Required; 3103.2 Construction documents; 3103.3 Location; and 3103.4 Means of egress. 67. Section 3403.1 Existing buildings or structures is hereby amended to read as follows: 3403.1 Existing buildings or structures. Additions or alterations to any building or structure shall comply with the requirements of the code for new construction except for the installation of approved automatic sprinkler systems. Approved automatic sprinkler systems shall be installed in accordance with Section 903.2 of this code as amended. Additions or alterations shall not be made to an existing building or structure that will cause the existing building or structure to be in violation of any other provisions of this code. An existing building plus additions shall comply with the height and area provisions of Chapter 5. Portions of the structure not altered and not affected by the alteration are not required to comply with the code requirements for a new structure except as required for the installation of approved automatic sprinkler systems in accordance with Section 903.2. 20 Section 3: That 8-3C-1 be amended to read as follows: A. Code Adopted. There is hereby adopted by reference, as if fully set out herein, the most current published edition of that certain code known as NFPA 70, the National Electrical Code as sponsored and published by the National Fire Protection Association, together with the additions, insertions, deletions and changes hereinafter set forth, one (1) copy which is available for inspection and on file in the office of the Village Clerk. In the event of a conflict between the provisions of this Article and the provisions of the most current published edition of NFPA 70, the National Electrical Code, the provisions contained in this Article shall prevail and the conflicting provisions contained in NFPA 70, the National Electrical Code, shall be of no force and effect. B. Amendments. The following additions, insertions, deletions and changes are hereby made to NFPA 70, the National Electrical Code: Section 230.70 (A)(1) Readily Accessible Location shall be amended as follows: Section 230.70 (A)(1) Readily Accessible Location. Add the following text to the end of the sentence: "and within five feet (5') of the point of entrance of the service conductors." 2. Section 310.106(B) Conductor material shall be amended to read as follows: 310.106 (B) Conductor Material. Conductors in this Article shall be of copper material only. No other type of material may be used for conductors. 3. Section 320.10 Uses Permitted shall be amended to read as follows: Section 320.10 Uses Permitted. Type AC cable shall only be permitted when used to supply light fixtures or electrical equipment in lengths not exceeding six feet (6') in accessible spaces or twelve feet (12') in concealed spaces. 4. Section 334.10 Uses Permitted shall be amended to read as follows: 21 334.10 Uses Permitted. Type NM, Type NMC and Type NMS cables are not permitted to be used within the Village. 5. Section 348.10 Uses Permitted shall be amended to read as follows: Section 348.10 Uses Permitted. Type FMC flexible metal conduit shall only be permitted when used to supply light fixtures or electrical equipment in lengths not exceeding six feet (6') in accessible spaces or twelve feet (12') in concealed spaces. 6. Section 350.10 Uses Permitted shall be amended to read as follows: Section 350.10 Uses Permitted. Type LFMC liquidtight flexible metal conduit shall only be permitted when used to supply light fixtures or electrical equipment in lengths not exceeding six feet (6') in accessible spaces or twelve feet (12') in concealed spaces. 7. Section 352.10 Uses permitted is hereby amended by deleting paragraph (F) Exposed. 8. Section 356.10 Uses Permitted shall be amended to read as follows: Section 356.10 Uses Permitted. Type LFNC liquidtight flexible non-metallic conduit shall only be permitted when used to supply light fixtures or electrical equipment in lengths not exceeding six feet (6') in accessible spaces or twelve feet (12') in concealed spaces. 9. Section 3 60. 10 Uses Permitted shall be amended to read as follows: Section 360.10 Uses Permitted. Type FMT flexible metallic tubing shall only be permitted when used to supply light fixtures or electrical equipment in lengths not exceeding six feet (6') in accessible spaces or twelve feet (12')in concealed spaces. 10. Section 400.7 Uses Permitted, paragraph (A) Uses, sub- paragraph (1) Pendants is hereby amended to read as follows: 22 Pendants. Pendant hung flexible cable and cord is prohibited. Exception: Pendant hung flexible cable may be permitted only with the written permission of the Director of Community Development and only under circumstances where the use of flexible cord as a wiring method is necessary to the method of operation due to the frequent alteration, change or relocation of electrical equipment. Such permission shall be granted only upon evaluation of written documentation submitted to the Director of Community Development that clearly demonstrates exceptional practical hardship as distinguished from a mere inconvenience to the owner or tenant. All pendant hung flexible cable approved under this section shall contain a ground conductor and shall be terminated in approved fittings. Section 4: That 8-3D-1 be amended to read as follows: A. Codes Adopted: There is hereby adopted by reference, as if fully set out herein, those certain codes known as the International Plumbing Code, 2012 edition, prepared and published by the International Code Council and the most recently published edition of the State of Illinois Plumbing Code, prepared and published by the Illinois Department of Public Health, together with the additions, insertions, deletions and changes hereinafter set forth, one (1) copy which is available for inspection and is on file in the office of the Village Clerk. B. International Plumbing Code Amendments: The following additions, insertions, deletions and changes are hereby made to the International Plumbing Code, 2012 edition: 1. Section 101.1: Insert "Elk Grove Village". 2. Section 106.6.2: Insert "As may be established from time to time by the Mayor and Board of Trustees". 3. Section 106.6.3: Fee Refunds is hereby deleted in its entirety. 4. Section 108.4: Violation Penalties is hereby amended to read as follows: 108.4 Violation Penalties. Any person who shall violate any provision of this code or shall fail to comply with any 23 of the requirements thereof or who shall erect, install, alter or repair plumbing work in violation of the approved construction documents or directive of the code official or of a permit or certificate issued under the provisions of this code shall be subject to the penalties as provided for by Title 8, Chapter 3, Article I of the Municipal Code. 5. Section 108.5: Insert "one hundred" and "five hundred" respectively. 6. Section 109 Means of Appeal is hereby deleted in its entirety. 7. Section 305.4.1 Sewer Depth is hereby deleted in its entirety. 8. Table 605.3: Water Service Pipe is hereby amended to permit only the following pipe materials for water service pipe: i. Section 605.6 Flexible Water Connectors shall be amended by adding thereto the following final sentence: Flexible water connectors shall not be permitted for the installation of water heaters. C. State Plumbing Code Amendments: The following additions, insertions, deletions and changes are hereby made to the State of Illinois Plumbing Code: 24 Add new Section 890.1220 a) 12) as follows: 890.122 a) 12) Water Heater Connection. That new Section 1101.11 Use of Water for Comfort Air Conditioning be added as follows: 1101.11 Use of Water for Comfort Air Conditioning. In all apparatus or equipment installed for the purpose of changing the dry bulb temperature or humidity content of the air, whether used in conjunction with summer comfort air conditioning or other refrigeration, the following regulations shall apply: The use of water is prohibited when used directly from the water system as a cooling medium in air washers or any type of equipment whereby the air to be conditioned comes into direct contact with sprays or wet surfaces, or where the water is used as the direct or indirect cooling system medium in coils. 2. The use of water is permitted in all compressor type refrigeration units having standard rated capacities of one and one-half (1 %) tons or less. 3. All compressor type refrigeration units having standard rated capacities of over one and one- half (1 yz) tons shall be equipped with evaporate coolers and condensers, water cooling towers, spray ponds, and or other water cooling PLP equipment so that all water from the water system is used for make-up purposes only. NOTE: In paragraphs 2 and 3 above the capacities shall be established in accordance with conditions given in standard ASRE Testing and Rating Codes. 4. If other than compressor types of refrigeration units are used, the consumption of water from the water system shall be limited in amount to not more per ton of refrigeration produced than would be used by a compressor type refrigeration unit as described under paragraph 3 above when such type is operating under normal conditions. Section 6: That 8-3F-1 be amended to read as follows: A. Amend Section 702.2 to read as follows: 702.2 Aisles: Arrangements of chairs or tables and chairs shall provide for ready access by aisle access ways and aisles to each egress door. The minimum clear width of each aisle in occupancies in Use Groups A, E and I-2 shall be maintained in accordance with the requirements of the building code listed in Chapter 8. In all other occupancies, aisles shall have a minimum required clear width of 44 inches (1118 mm) where serving an occupant load greater than 50, and 36 inches (914 mm) where serving an occupant load of 50 or less. The clear width of aisles shall not be obstructed by chairs, tables or. other objects. 8. Add new Section 702.5 as follows: 702.5 Exit Signs: All means of egress shall be indicated with approved "Exit" signs where required by the building code listed in Chapter 8. All "Exit" signs shall be maintained visible and all illuminated "Exit" signs shall be illuminated at all times that the building is occupied. 9. Add new Section 702.6 as follows: 702.6 Dead-end Travel Distance: All corridors that serve more than one exit shall provide direct connection to such exits. The length of a dead-end corridor shall not exceed 35 feet (10668 mm) where the building is not equipped throughout with an automatic sprinkler system. The dead- end travel distance limitation shall be increased to 70 feet (21336 mm) where the building is equipped throughout with an automatic sprinkler system. 29 10. Section 704.2 Smoke Alarms is hereby amended by adding thereto the following final sentence: Anyone tampering or interfering with the effectiveness of a smoke alarm shall be in violation of this code. 11. Add new Section 704.5 as follows: 704.5 Fire Extinguishers: All portable fire extinguishers shall be visible, provided with ready access thereto, and maintained in an efficient and safe operating condition. Extinguishers shall be of an approved type. 12. Add new Section 704.6 as follows: 704.6 Manual Fire Alarm Boxes: All manual fire alarm boxes shall be operational and unobstructed. 13. Add new Section 704.7 as follows: 704.7 Smoke and Heat Detectors: All smoke and heat detectors shall be operational and free from any obstructions that prevent proper operation, including smoke entry. Section 9: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form.
