AN ORDINANCE AMENDING SECTION 6-13-1-A OF CHAPTER 13 OF TITLE 6 OF
THE ELK GROVE VILLAGE CODE BY EXEMPTING UNPAID TICKET PAYMENTS
AND EMISSION TESTING FAILURE SUSPENSIONS FROM VEHICLE SEIZURE
ANDIMPOUNDMENT
WHEREAS, Section 6-13-1-A of the Village Code authorizes vehicle seizures and
impoundment for vehicles driven by drivers whose license is suspended for any reason; and
WHEREAS, the Illinois legislature recently amended said section by exempting
therefrom suspensions if the suspension is for unpaid citations (parking or moving) or due to
failure to comply with emission testing;
NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section l: That Section 6-13-1-A of the Elk Grove Village Code be amended to read as
follows:
A. Driving with suspended or revoked license, 625 ILCS 5/6-303, an administrative
penalty not to exceed five hundred dollars ($500.00) except that vehicles shall not be subject to
this section if the suspension is for unpaid citations (parking or moving) or due to failure to
comply with emission testing.
Section 2: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication according to law.
