A RESOLUTION ACCEPTING A CERTIFICATE OF APPROVAL AND
INITIAL ACCEPTANCE AND DEED OF CONVEYANCEBILL OF SALE FOR
PUBLIC IMPROVEMENTS (WATERMAIN-2475 TOUHY AVENUE
REDEVELOPMENT)
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois:
Section 1: That the Mayor and Board of Trustees do hereby accept a Certificate
of Approval and Initial Acceptance and Deed of Conveyance/Bill of Sale for public
improvement as described in the "As Built" Engineering Plans prepared by
Spaceco/Premier/Nolan/Wedow Survey Group, Itasca, Illinois.
Section 2: That the Village of Elk Grove Village shall amend the original Letter
of Credit Number DC 112252US 14213, which secured the installation of the public
watermain in the amount of $90,000 and was accepted by Resolution No. 33-13 on July
16, 2013 to a new amount of $10,000, guaranteeing the maintenance of the accepted
watermain until May 31, 2016.
Section 3: That this Resolution shall be in full force and effect from and after its
passage and approval according to law.

We hereby issue an amendment to our Irrevocable Standby Letter of Credit No. DC112252US14213 dated
June 25, 2013 as follows:
• Delete Expiration Date of., September 25, 2014
• Add Expiration Date of: May 31, 2016
• Decrease Letter of Credit Amount by: USD 80,000100
• New Letter of Credit Amount: USD 10,000.00
• It is a condition of this Irrevocable Letter of Credit that it shall be automatically extended for one year from
the present expiration date hereof unless thirty (30) days prior to such expiration date the Village Manager
shall notify the undersigned in writing, certified mail, return receipt requested that he or she, based upon
the advice and supporting documentation from the Village Engineer that he or she does elect not to
arbitrarily request renewal of this Irrevocable Letter of Credit for such additional one (1) year period
without due cause.
All other terms and conditions remain unchanged.
This amendment is to form an integral part of this Letter of Credit.
Kindly return a countersigned copy of this amendment letter at your earliest convenience, indicating your
acceptance or rejection of this amendment. A postage -prepaid envelope is enclosed.
This amendment must be accepted or rejected IN ITS ENTIRETY; you may not accept it only partially.

APPROVAL AND ACCEPTANCE OF GOVERNING AUTHORITY
The VILLAGE OF ELK GROVE VILLAGE does hereby approve and accept for
maintenance and operation the above described improvement. It is understood_that the
,
guarantee period of 24:months shall commence as of the date of Village Board
acceptance.
It is also. understood that this approval and acceptance_ covers only the specific
work Indicated above and'is subject to a final punch list being made concerning
adjustment, alignment and necessary repairs of all structures, boxes, hydrants, etc.
Acceptance of maintenance by the Village does not relieve the developer from the
responsibility of keeping all dirt and debris due. to construction operations out of both
storm and sanitary sewer systems. Final acceptance of the subdivision or other general
development is conditional upon completing all indicated items on the final punch list. It
is the responsibility of the owner or developer to request the final punchlist to be made.
No.refund of maintenance escrow monies will be made until all items in the final punch
list have been corrected.
