AN ORDINANCE AMENDING SECTIONS 3 -5A -2-F AND 6-5-4-F OF THE ELK
GROVE VILLAGE CODE BY DESIGNATING THE LICENSE REVIEW
COMMISSION AS THE AUTHORITY TO CONDUCT CERTAIN LICENSE APPEAL
WHEREAS, Ordinance No. 3398 repealed provisions which previously established the
Health and Community Services Advisory Committee; and
WHEREAS, said Committee served as a hearing body for appeals concerning food
service establishments and retail food store establishments as well as for appeals concerning the
revocation of dog or cat owner licenses; and
WHEREAS, it is necessary to designate the License Review Commission as the
successor hearing body for appeals concerning the above referenced areas.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That Section 3 -5A -2-F of the Village Code be amended to read as follows:
F. Hearings: The hearings provided for in this section shall be conducted by the License
Review Commission at a time and place designated by said Commission. Based upon the record
of such hearing, the Commission shall make a finding to sustain, modify or rescind any official
notice or order considered in the hearing. All hearings for license revocation or permanent
closure of a food establishment or retail food store establishment shall likewise be before the
License Review Commission. Based upon the record of such hearing, the Commission shall
make a finding as to whether to permanently revoke such establishment. A written report of the
hearing decision shall be furnished to the license holder by the health authority within five (5)
days from the date said matter is decided by the License Review Commission.
Section 2: That Section 6-5-4-F of the Village Code be amended to read as follows:
F. Revocation Of License: Licenses shall be granted upon application with a payment of
a fee. Should any provision of these regulations relating to animals be in violation, the person's
license may be subject to revocation by the health department or the police department and/or a
penalty imposed, as hereinafter provided.
Persons whose licenses have been revoked shall be granted a hearing upon written
request to the License Review Commission at a time and place designated by said Commission.
A written report of the decision of the License Review Commission shall be furnished to the
Licensee within five (5) days from the date said matter is decided by the License Review
Commission.
Section 3: That this ordinance shall be in full force and effect from and after its passage
and according to law.
