HomeMy WebLinkAboutORDINANCE - 3428 - 8/18/2015 - 2750 TOUHY REZONE TO B-3ORDINANCE NO. 3428 AN ORDINANCE REZONING PROPERTY LOCATED AT 2750 TOUHY AVENUE FROM I-1 RESTRICTED INDUSTRIAL DISTRICT TO B-3 BUSINESS DISTRICT (AUTOMOTIVE) WHEREAS, the Plan Commission, acting as a Zoning Commission, at a Public Hearing duly called and held according to law, considered the petition to rezone property located at 2750 Touhy Avenue, Elk Grove Village from I -I Restricted Industrial District to B-3 Business District (Automotive); and WHEREAS, the Mayor and Board of Trustees of' the Village of Elk Grove Village after having considered the recommendation and finding of said Plan Commission, find and believe it to be in the best interest of the Village that said property be rezoned as requested. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage Illinois as follows: Section 1: That the property located at 2750 Touhy Avenue, Elk Grove Village Illinois be and the same is hereby rezoned from I-1 Restricted Industrial District to B-3 Business District (Automotive), which property is legally described as follows: PARCEL 1: LOT 15 IN STEELE'S HIGGINS AND TOUHY HIGHLANDS, BEING A SUBDIVISION IN THE EAST % OF THE SOUTHEAST %4 OF SECTION 26, TOWNSHIP 41 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDI, ACCORDING TO THE PLAT RECORDED .TUNE 12, 1926 AS DOCUMENT NO. 9306691, EXCEPT THAT PART OF SAID LOT 15 CONVEYED TO THE STATE OF ILLINOIS BY DEED RECORDED JANUARY 19, 1991 AS DOCUMENT NO. 91-013, 229 AND DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHEAST CORNER OF SAID LOT 15, BEING ALSO THE POINT OF INTERSECTION OF THE NORTHWESTERLY LINE OF TOUHY AVENUE WITH THE EASTERLY LINE OF SAID LOT 15; THENCE NORTHWESTERLY ALONG THE CURVE LINE CONCAVE TO THE NORTHEAST AND HAVING A RADIUS OF 1759.57 FEET, A DISTANCE OF 40.0 FEET TO A POINT IN THE WESTERLY LINE OF SAID LOT 15; THENCE NORTHEASTERLY ALONG SAID WESTERLY LINE OF SAID LOT 15, A DISTANCE OF 8.0 FEET TO A POINT; THENCE SOUTHEASTERLY ALONG A CURVED LINE CONCAVE TO THE NORTHEAST AND HAVING A RADIUS OF 1708.35 FEET, A DISTANCE OF 39.91 FEET TO A POINT IN THE EASTERLY LINE OF SAID LOT 15; THENCE SOUTHWESTERLY ALONG SAID EASTERLY LINE OF SAID LOT 15 A DISTANCE OF 8.0 FEET TO THE POINT OF BEGINNING, IN COOK COUNTY, ILLINOIS. PARCEL 3: THE EAST/20F THAT PART OF THE 20 FOOT VACATED ALLEY LYING WEST OF AND ADJOINING LOT 12; AND THAT PART OF THE NORTHERLY % OF THE VACATED 20 FOOT ALLEY LYING (i) SOUTHERLY OF LOT 12 AND OF THE SOUTHERLY LINE OF LOT 12 EXTENDED WESTERLY TO THE WEST LINE OF THE EAST 14 OF THE VACATED 20 FOOT ALLEY LYING WEST OF SAID LOT 12; AND (ii) WESTERLY LINE OF A LINE DRAWN FROM THE SOUTHWESTERLY CORNER OF LOT 12 TO THE NORTHWESTERLY CORNER OF LOT 15; ALL AS VACATED BY AND SHOWN ON THE PLAT OF VACATION BY OWNERS RECORDED OCTOBER 31, 1951 AS DOCUMENT NO. 15206103 AND ALL BEING IN STEELE'S HIGGINS AND TOUHY HIGHLANDS, BEING A SUBDIVISION IN THE EAST % OF THE SOUTHEAST'/ OF SECTION 26, TOWNSHIP 41 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED .TUNE 12, 1926 AS DOCUMENT NO. 9306691, IN COOK COUNTY, ILLINOIS. NOTE: IN THE DESCRIPTIONS OF THOSE PARTS CONVEYED TO THE STATE OF ILLINOIS AS DESCRIBED AS EXCEPTIONS FROM PARCELS 1 AND 2 THE BEARING OF THE EAST LINE OF THE SOUTHEAST''/4 OF SECTION 26, AFORESAID, IS ASSUMED AS SOUTH 0 DEGREES 25 MINUTES 30 SECONDS WEST. Section 2: That variations of Section 4-3-1 of the Zoning Ordinance are hereby granted to permit sixteen (16) parking stalls instead of the twenty-seven required by Code and a variation for two (2) stacking spaces to permit ten (10) stacking spaces instead of the twelve (12) required by Code. Section 3: That the rezoning and the granting of the variations is subject to the lots being resubdivided into one lot with a plat of vacation included therein thus vacating the existing right- of-way. Furthermore, the petitioner has one year from the date of formal approval of this Ordinance to receive necessary permits and begin construction; otherwise the rezoning and variations will be rescinded. Section 4: That the Village Clerk is hereby directed to amend the zoning map of the Village to reflect the rezoning as set forth herein. Section 5: That this Ordinance shall be in full force and effect form and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 18th day of August 2015.
