AN ORDINANCE GRANTING A VARIATION FROM SECTION 3-7:1)(2) AND
SECTION 3-7:11)(5) OF THE ELK GROVE VILLAGE ZONING ORDINANCE AS IT
PERTAINS TO PERMITTED FRONT YARD SETBACKS AND REQUIRED YARD
OPEN TO THE SKY, UNOBSTRUCTED FOR THE CONSTRUCTION OF A GARAGE
ADDITION ON PROPERTY LOCATED AT 299 LAUREL STREET
WHEREAS, the Zoning Board of Appeals, at a public hearing duly called and held
according to law, considered the question of granting a variation from the provisions of Section
3-7:1)(2) and Section 3-7:1)(5) of the Elk Grove Village Zoning Ordinance as it pertains to
permitted locations for principal structures and the requirement that every part of a required yard
shall be open to the sky, unobstructed, except for the ordinary projection of sills, belt courses,
cornices and ornamental features to permit the construction of a garage addition that will extend
approximately three feet (3') into the required twenty five foot (25") front yard setback with a
twenty four inch (24") overhang that will extend approximately four feet (4') beyond the
allowable twelve inch (12") encroachment into the required twenty five foot (25') front yard
area and approximately one foot (1') beyond the allowable twelve inch (12") encroachment into
the required five foot (5') side yard area on property located at 299 Laurel Street and legally
described hereinafter; and
WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village find
and believe that sufficient hardship exists so as to j ustify the granting of said variation.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That there be granted a variation of Section 3-7:D(2) and Section 3-7:1)(5) of
the Elk Grove Village Zoning Ordinance to permit the construction of a garage addition to
encroach three feet (3') into the required twenty five foot (25') front yard setback to include a
twenty four inch (24") overhang that will extend approximately four feet (4') beyond the
allowable twelve inch (1211) encroaclunent into the required twenty Five foot (25') front yard area
and approximately one foot (1') beyond the allowable twelve inch (12") encroachment into the
required five foot (5') side yard area on property located at 299 Laurel Street, Elk Grove Village
and legally described as follows:
Lot 1190 in Elk Grove Village Section 2, being a Subdivision in the West % of Section
28, Township 41 North, Range 11 East of the Third Principal Meridian, in Cook County,
Illinois
Section 2: That this Ordinance shall be in full force and effect from and after its passage
and approval according to law.
