ORDINANCE NO. 3057
AN ORDINANCE VACATING CERTAIN RIGHT -OF -WAY PROPERTY
AND CONFIRMING THE SALE THEREOF TO AN ABUTTING PROPERTY OWNER
WHEREAS, the Village of Elk Grove Village is the owner of the following right-of-way property:
That part of Gateshead South lying South of and adjoining the South Line of Lot 4662 and lying North of and adjoining the North line of Lot 4661 and lying West of a line drawn from the
Southeast corner of Lot 4662 to the Northeast corner of Lot 4661 in Elk Grove Village Section 15 being a Subdivision in Section 32, Township 41 North, Range 11, East of the third Principal
Meridian, in Cook County, Illinois
Also:
That part of the East 30.0 feet of Beisner Road (formerly identified as Bisner Road) lying South of the Westerly extension of the South line of Lot 4662 and lying North of the Westerly
extension of the North line of Lot 4661 in Elk Grove Village Section 15, being a Subdivision in Section 32, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook
County, Illinois
WHEREAS, the Mayor and Board of Trustees, pursuant to a public hearing, duly called and held according to law, have determined that the nature and extent of the public use or public’s
interest by the above-described property is such as to warrant the vacation of such right-of-way, and it is in the public interest and best interest of the Village to vacate said property
and convey same to an abutting property owner; and
WHEREAS, on July 19, 2005, the Mayor and Board of Trustees authorized the sale of the right-of-way to Virginia Cangialosi, an abutting property owner, subject to the Board’s
determination pursuant to public hearing that the nature and extent of the public use or public interest to be subserved by the above described property is such as to
warrant the vacation of said right-of-way pursuant to 65 ILCS 5/11-91-1 and that it is in the public interest and best interest of the Village to so vacate said property and sell it
to Virginia Cangialosi pursuant to the Real Estate Purchase Agreement authorized by Resolution No. 42-05, duly passed and approved on July 19, 2005.
NOW THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That the following right-of-way property be and the same is hereby vacated for the purposes of conveying same to an abutting property owner:

Southeast corner of Lot 4662 to the Northeast corner of Lot 4661 in Elk Grove Village Section 15 being a Subdivision in Section 32, township 41 North, Range 11, East of the Third Principal
Meridian in Cook County, Illinois
Also:
That part of the East 30.0 feet of Beisner Road (formerly identified as Bisner Road) lying South of the Westerly extension of the South Line of Lot 4662 and lying North of the Westerly
extension of the North line of Lot 4661 in Elk Grove Village Section 15, being a Subdivision in Section 32, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook
County, Illinois.
Section 2: That the Real Estate Purchase Agreement between the Village of Elk Grove Village and Virginia Cangialosi, authorized by Resolution No. 42-05 duly passed and approved on
July 19, 2005 is hereby confirmed.
Section 3: That should any portion of this Ordinance be declared invalid, then and in that event, the title of said right-of-way property shall revert back to the Village of Elk Grove
Village.
Section 4: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form.
Section 5: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
