Childress R. De Frenza M.Colgan R. Bookler L. Dohrer C. Kelley W. Jameel Absent: J. Meister, Sr. M. Larson Staff. J. Polony, Plan Review Supervisor, Community Development Zoning Variation—Docket#16-2 622 Dupont Circle Chairman Childress called the meeting to order at 7:00 pm and read a statement describing the hearing notification procedure as well as the legal notice. The petitioner, Deborah Sapyta, was sworn in and asked to present her case. Ms. Sapyta stated the reason for her variation request is because her current fence has become deteriorated and was cited by the Village property maintenance division to be repaired and/or replaced. Her house is located in front of her neighbor's house so in order to meet the Village Ordinance for compliant fence locations, she'd lose a large portion of her backyard. Mr. Childress opened the meeting to questions from the board. Ms. De Frenza asked the petitioner if the same style and height fence will be installed. Ms. Sapyta indicated the fence will be installed in the same location and the fence height will be five (5') feet. Ms. De Frenza asked if the petitioner was aware of any neighbor concerns with the variation request. Ms. Sapyta indicated the neighbor most affected by the fence was in favor of the request to replace the deteriorated fence. A motion to grant a variation for the construction of a five (5') foot high, wood fence which would extend approximately twenty six (26') feet beyond a line extended from the nearest front corner of the principal building located on an adjacent single-family residential lot was made by Mr. Dohrer and seconded by Ms. Kelley. Upon voting (AYES—Childress,De Frenza, Colgan, Jameel and Bookler.) The motion to grant the variance passed unanimously. Mr. Childress advised the petitioner, Ms. Sapyta, to contact the Village Clerk and attend the subsequent Village Board Meeting.
