Zoning Variation—Docket#16-4 994 Wisconsin Lane
Chairman Childress called the meeting to order at 7:30 pm and read a statement describing the
hearing notification procedure as well as the legal notice.
The petitioner, Maura O' Connor, was sworn in and asked to present her case.
Ms. O' Connor stated the reason for her variation request is because her fence is deteriorated and
in need of replacement. The current fence has existed at the property since she moved in twenty-
two (22) years ago. Approximately ten to twelve years ago, she received a zoning variation for
her above ground pool and the fence is a required barrier that must be constructed around the
pool for safety and security. Mr. O' Connor noted that the proposed fence would be constructed
in the same location and would be the same height as the existing fence.
Mr. Childress opened the meeting to questions from the board.
Mr. Bookler stated he spoke with the neighbor at 1694 Virginia Drive and they had no concerns
with the removal and replacement of the fence.
Mr. Dohrer asked the petitioner if her hardship was the location of the pool.
Ms. O' Connor stated that since she received a variation for the pool location, the fence would
need a variation as well in order to construct a proper barrier around the pool structure. She also
noted that the fence was in place prior to the installation of her pool.
Mr. Dohrer stated he had concerns with sight line restrictions caused by the fence and shrubbery
when backing out of the neighbor's driveway.
A motion to grant a variation for the construction of a five (5') foot high, wood fence which
would extend approximately seventeen (17') feet beyond a line extended from the nearest front
corner of the principal building located on an adjacent single-family residential lot was made by
Ms. De Frenza and seconded by Mr. Jameel. Upon voting(AYES—Childress, Kelley, Colgan,
and Bookler. NAPES- Dohrer) The motion to grant the variance passed with a six (6) to
one (1) in favor vote. Mr. Childress advised the petitioner, Ms. O' Connor, to contact the
Village Clerk and attend the subsequent Village Board Meeting. The meeting adjourned at 7:38
p.m.
