Childress R. De Frenza M.Colgan R. Bookler L. Dohrer C. Kelley W. Jameel Absent: J. Meister, Sr. M. Larson Staff: J. Polony, Plan Review Supervisor, Community Development Zoning Variation—Docket#16-3 398 Brighton Road Chairman Childress called the meeting to order at 7:15 pm and read a statement describing the hearing notification procedure as well as the legal notice. The petitioner, Thomas Johnson, was sworn in and asked to present his case. Mr. Johnson stated the reason for his variation request is because he is located on a corner lot and if he was required to meet the Village Ordinance for permitted fence locations he'd lose approximately one third of his backyard area. Mr. Johnson further explained that his neighbor's driveway is located on the opposite side of the proposed fence so no sight line issues would be created by the proposed fence. Additionally, Mr. Johnson stated he'd like the fence to protect his young children when playing in the yard. Mr. Childress opened the meeting to questions from the board. Ms. De Frenza asked the petitioner if he was aware of any neighbor concerns with the proposed variation. Mr. Johnson stated that he spoke with his neighbors when he purchased the house and they had no concerns with constructing a fence. Mr. Childress asked the petitioner if the shrubbery along the side of the house would be located within the fenced in area. Mr. Johnson stated the shrubs would be located entirely within the proposed fence area. A motion to grant a variation for the construction of a four(4') foot high, wood fence which would extend approximately nineteen(19') feet beyond a line extended from the nearest front corner of the principal building located on an adjacent single-family residential lot was made by Mr. Jameel and seconded by Mr. Colgan. Upon voting (AYES—Childress, Kelley, Dohrer, and Bookler. Mr. De Frenza abstained from voting) The motion to grant the variance passed unanimously. Mr. Childress advised the petitioner, Mr. Johnson, to contact the Village Clerk and attend the subsequent Village Board Meeting.
