ZETTEK MUNICIPAL BUILDING AT 901 WELLINGTON AVENUE ON TUESDAY, FEBRUARY 8, 1994 Village President Dennis J. Gallitano called the meeting to order at 8 : 07 p.m. 1. ROLL CALL: Present : President : Dennis J. Gallitano; Trustees: Ronald L. Chernick, Nancy J. Czarnik, Craig B. Johnson, James P. Petri, Paul A.Rettberg, and Michael A. Tosto Absent: None Also Present : Village Manager, Gary E . Parrin; Village Attorney, George B .Knickerbocker and Village Clerk, Patricia S. Smith A quorum was present . 2 . INVOCATION: The Reverend Chuck Ellis, Pastor of First Baptist Church, delivered the invocation. 3 . APPROVAL OF MINUTES: Motion to approve the minutes of the Regular Meeting held on January 25 , 1994 as submitted. MOVED: Trustee Petri Seconded: Trustee Tosto Voice vote MOTION CARRIED. 4 . APPROVAL OF WARRANT Motion to authorize payment of invoices as shown on the February 8, 1994 Accounts Payable Warrant in the amount of $631, 407 . 89 . Moved: Trustee Petri Seconded: Trustee Tosto AYES : Trustees Chernick, Czarnik, Johnson, Petri, Rettberg, Tosto MOTION CARRIED 5. REPORT OF THE VILLAGE PRESIDENT - DENNIS J. GALLITANO 1 . SUPER KMART - Attended the opening for officials on January 27, 1994 . The official opening of the store for full business was on February 3 , 1994 . The store appears to be doing a good business because the parking lot has been full since opening day. The Elk Grove Village Super KMart employs 115 Village residents . The Board will be considering the initiation of a traffic study to look at the Biesterfield and Meacham Road intersection; the Wise and Michigan intersection; the new light timing; and the Texas traffic flow. 2 . ALEXIAN BROTHERS MEDICAL CENTER - Attended a meeting to discuss different ways to address senior citizen housing in the Village. 3 . ILLINOIS STATE SCHOLARSHIP - Attended an award ceremony hosted by the Elk Grove High School on February 2 , 1 2-08-94 1994 . There were about 35 seniors from the High School who received Illinois State Scholarship awards . 6 . CONSENT AGENDA A. Techno, Inc . , Chicago. Illinois - Approve the final payment for the cleaning and painting of the Lively Boulevard water reservoir #8 , and installation of a cathodic protection system in the reservoir in an amount of $244, 600 ; and Approve the Balancing Change Order for the water reservoir #8 improvements for a net decrease of $13 , 600, from the contract price . B. Fire Department Training - Authorize David C. Sindelar, Firefighter, to attend Paramedic Certification training in Arlington Heights, IL from February 28, 1994 through June 10, 1994 , at a cost not to exceed $1, 463 . 30 . C. Fire Delpartment Training - Concur with the authorization of the Village Manager allowing William A. Knipp, Firefighter recruit, to attend Firefighter and Haz/Mat First Responder Certification Class in Elgin, Illinois, from February 7, 1994 to March 25, 1994, in an amount not to exceed $1, 530 . 40 . D. Executive Session Minutes - Adopt Resolution No. 9-94A entitled, "A RESOLUTION AUTHORIZING RELEASE/RETENTION OF EXECUTIVE SESSION MINUTES OF THE VILLAGE OF ELK GROVE VILLAGE. " E . North West Housing Partnership - Adopt Resolution No. 10-94 entitled, "A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE CLERK TO EXECUTE AN AGREEMENT BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND THE NORTH WEST HOUSING PARTNERSHIP" ; AND Waive the Village building permit and inspection fees associated with the program; and To designate the Community Service Coordinator as the "liaison" as identified in the agreement . F. Illinois Housing Development Authority - Adopt Resolution No. 11-94 entitled, "A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE CLERK TO EXECUTE AN AGREEMENT BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND THE ILLINOIS HOUSING DEVELOPMENT AUTHORITY. " G. Landmeier Fire Station- Adopt Resolution No. 12-94 entitled, "A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE CLERK TO EXECUTE A PROFESSIONAL SERVICE CONTRACT BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND APPRAISAL SYSTEMS (FIRE STATION) . " H. American Private Car - Adopt Ordinance No. 2348 entitled, "AN ORDINANCE ISSUING A CERTIFICATE OF AUTHORITY TO AMERICAN PRIVATE CAR TO PERMIT THE ISSUANCE OF A PUBLIC PASSENGER VEHICLE DISPATCHER LICENSE FOR DISPATCHING OF LIVERY VEHICLES IN THE VILLAGE OF ELK GROVE VILLAGE. " I . Municipal Waste System - Adopt Ordinance No. 2349 entitled, "AN ORDINANCE AMENDING TITLE 4 , CHAPTER 6, MUNICIPAL WASTE SYSTEM, OF THE OFFICIAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE, BY ESTABLISHING THEREIN PENALTY PROVISIONS FOR THE VILLAGE' S MUNICIPAL WASTE SYSTEM. " 2 2-08-94 J. Amendment - Adopt Ordinance No. 2350 entitled, "AN ORDINANCE AUTHORIZING AN AMENDMENT TO ORDINANCE NO. 2342, GENERAL OBLIGATION BONDS, SERIES 1994 , SECTION 11, TAX LEVY. " Motion to approve Consent Agenda items "A, B, C, D, E, F, G, H, I , and J" . CAPITAL IMPROVEMENTS COMMITTEE - CHAIRMAN TOSTO 1551 BUSSE ROAD - The Committee has reviewed a request for a temporary waiver to construct a public sidewalk and recommend that waiver be granted by accepting a Statement of Commitment to Construct a Public Sidewalk from Royal Partners, Inc . Motion to adopt Resolution No. 13-94, "A RESOLUTION APPROVING A STATEMENT OF COMMITMENT TO CONSTRUCT PUBLIC SIDEWALK BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND ROYAL PARTNERS, INC. JUDICIARY, PLANNING & ZONING COMMITTEE - CHAIRWOMAN CZARNIK SALE OF HANDGUNS ORDINANCE - The committee has reviewed a proposed ordinance regulating the sale of certain handguns and further discussed the ordinance at the Committee of the Whole meeting earlier this evening. The Committee recommends that the proposed ordinance be presented for consideration and that comments be accepted from the Board and/or the audience . Motion to adopt Ordinance No. 2351 "AN ORDINANCE REGULATING THE SALE AND USE OF CERTAIN HANDGUNS, B-B GUNS, AND PELLET GUNS WITHIN THE CORPORATE LIMITS OF THE VILLAGE OF ELK GROVE VILLAGE. " Comments in opposition to the proposed ordinance were presented by the following members of the audience : Jeff Castic, 948 Brantwood Avenue; Phil Haverland, 38 Avon; Alan Race, 565 Northampton Circle; Frank Buday and Dale Volkamer, 62 Clearmont . Comments encouraging passage of the proposed ordinance were presented by the following members of the audience : Roger Bianco, 1636 Gibson. MOVED: Trustee Czarnik SECOND: Trustee Rettberg AYES : Trustees Czarnik, Petri, Rettberg, Chernick NAYS : Trustees Johnson, Tosto (Upon response to the roll call each Trustee explained the reason for their vote) MOTION CARRIED The Judiciary, Planning and Zoning Committee scheduled a meeting for Tuesday, March 8, 1994 at 6 : 30 p.m. in the 3 2-08-94 Trustees Conference Room to discuss the Parental Responsibility Ordinance . RECESS: 8 :40 P.M. RESUME MEETING: 8 :48 p.m. 9 . PERSONNEL COMMITTEE - CHAIRMAN PETRI EXECUTIVE SESSION - A meeting of the committee to meet in Executive Session was scheduled for Wednesday, February 16 , 1994 . The Village Manager and the Personnel Officer were requested to attend this meeting. 10 . RECYCLING COMMITTEE - CHAIRMAN CHERNICK and VICE CHAIRMAN JOHNSON The Committee has received information pertaining to the proposed residential recycling ordinance that need to be reviewed, however the fees and charges have not been received as yet from Waste Management . A meeting of the committee will be scheduled upon receipt of the proposed fees . Motion to hold a first reading of an ordinance "AMENDING TITLE 3 , CHAPTER 14 , SCAVENGERS, OF THE MUNICIPAL CODE BY ESTABLISHING THEREIN REGULATIONS FOR THE VILLAGE' S INDUSTRIAL OR COMMERCIAL RECYCLING PROGRAM. " MOVED: Trustee Johnson SECOND: Trustee Chernick Voice vote MOTION CARRIED Copies of this ordinance will be distributed to members of the Business Liaison Council and the Greater O'Hare Association for their input . The ordinance will then be presented for adoption at the next Village Board meeting. 11. PLAN COMMISSION - VILLAGE MANAGER No report . 12 . ZONING BOARD OF APPEALS - VILLAGE MANAGER No report . 13 . REPORTS OF OTHER BOARDS, COMMISSIONS & COMMITTEES a. CABLE TV COMMITTEE - TRUSTEE PETRI REGIONAL CABLE TV GROUP - A meeting is scheduled for Thursday, February 10, 1994 at 8 : 00 p.m. in Buffalo Grove . PUBLIC HEARING - A reminder that there will be a hearing on Tuesday, February 15, 1994 at 7 : 00 p.m. regarding the Cable Franchise renewal process. Everyone is invited and encouraged to attend. b. COMMUNITY SERVICE BOARD - TRUSTEE CZARNIK A meeting of the Board is scheduled for Thursday, February 17, 1994 at 8 : 00 p.m. in meeting room C. 14 . ORDINANCES, RESOLUTIONS & COMMUNICATIONS President Gallitano issued a Proclamation declaring the week of February 27 through March 5, 1994 as "TORNADO PREPAREDNESS WEEK" . 4 2-08-94 The Fire Chief gave a brief description of the warning system that is installed in the Village for severe weather conditions . 15 . UNFINISHED BUSINESS None 16 . REPORT FROM THE VILLAGE MANAGER 1 . TREE CITY USA 1993 AWARD - The Director of Public Works was called upon to explain to the Board the criteria for accomplishing that designation and earning that award. 1 . There must be a designation of a Department for tree care . 2 . There must be a community tree ordinance . 3 . The community must demonstrate to the State Forester that there is a comprehensive tree care program (Urban Forest Program) . 4 . The community must observe the tradition of Arbor Day. In Elk Grove Village this is a joint effort of the Village and the Elk Grove Park District . This is the 9th consecutive year that the Village of Elk Grove Village has received this award, which will be officially presented by the State Forester at the Morton Arboretum. President Gallitano acknowledged the tremendous tasks that were accomplished by the Public Works Department within the past few weeks due to the winter storms . In addition to snow and ice removal, there were 10 water main breaks . AUDIENCE - 9 : 04 p.m. Mr. Phil Haverland, 38 Avon Road, addressed the Board asking them to reconsider the widening of Elk Grove Boulevard due to the opening of the Elgin O'Hare Expressway. Mr. Mike Starostka, 487 Franklin, thanked the Board for being receptive to the public expressing their concerns regarding the gun regulation ordinance . MEETING RESUMED - 9 :07 p.m. REPORT FROM THE VILLAGE MANAGER - CONTINUED SNOW PLOWING OPERATIONS - Salt supplies in the northwest suburbs and the entire State of Illinois have been in demand with very little supply. The Village has a contract that was let last fall with many other municipalities who have a joint purchase contract with the State of Illinois in order to get the most favorable rates because of the volume of salt that will be purchased during the winter season. The Manager addressed the problems that the Village and surrounding municipalities have encountered over the past few weeks regarding the dwindling of the salt supply and the eventual disappearance of the salt . The Manager further explained the difficulty the State has had in meeting the shipping dates and amounts of salt due to the barges being caught in the frozen Mississippi River. 5 2-08-94 In the next few weeks, when the salt supplies start coming in, there will be a distribution based on how much the State feels they can provide the municipalities from their supply. For the current snow storm the Village has adequate salt supplies for at least the next week predicated on when the snow finally stops. The Village has been able to purchase in lieu of salt a combination of 75% sand and 25% salt in order to provide better traction on those streets that have frozen. 17 . NEW BUSINESS EXECUTIVE SESSION Motion to hold an Executive Session following tonight' s Board Meeting for the purpose of discussing litigation; personnel and land acquisition.
