Village President Dennis J. Gallitano called the meeting to order
at 8 : 02 p.m.

2 . INVOCATION
The Reverend William Kalivoda, Deacon of St . Julian Parish
delivered the invocation.
3 . APPROVAL OF MINUTES
Motion to approve the minutes of the Regular Meeting held on
June 14, 1994 as submitted.

4 . REPORT OF THE VILLAGE PRESIDENT - DENNIS J. GALLITANO
1 . GROVE MALL SHOPPING CENTER - A proposal was offered to
the owners at the last Village Board meeting. An
acceptance of the proposal has not been received. The
Village Attorney has been instructed to meet and concur
with our advisors to look at an expedited condemnation
proceeding against Grove Mall .
5 . APPROVAL OF ACCOUNTS PAYABLE WARRANT
Motion to authorize payment of invoices as shown on the
June 28, 1994 Accounts Payable Warrant in the amount of
$859, 738 . 38 .

Mr. Ted Popielewski, Elk Grove Firefighter, addressed the Board
regarding Item J. of the Consent Agenda referencing the
consideration of adoption of a resolution amending the Personnel
Rules and Regulations of the Village of Elk Grove Village.
6 . CONSENT AGENDA
A. Alexian Brothers Medical Center Auxiliary Thrift Shop -
Grant a request to waive the $100 business license fee
for the retail sales conducted in the thrift shop.
B . Children' s Advocacy Center - Grant a request for
payment of FY 195 dues in the amount of $3 , 500 .

C. Northwest Community Hospital , Arlington Heights.
Illinois - Award a professional service contract in an
amount not to exceed $9, 235 for an "in station"
required paramedic training program.
D. Sero Scotty R.V. , Irwin, PA. - Waive the formal bidding
process; and
Award a sole source purchase contract for one (1) fire
safety house in an amount not to exceed $23 , 893 .
E . Kustom Signals , Shorewood, Minnesota - Waive the formal
bidding process; and
Award a contract to furnish six (6) Kustom HR-12 police
radar units and two (2) Kustom Pro-100 police radar
units at a total cost not to exceed $12 , 808 including a
trade-in price of $400 for eight (8) radar units .
F. Gerard Printing, Elk Grove Village, IL - Award a
professional service contract for the typesetting and
printing of three (3) residential newsletters and three
(3) business newsletters in an amount not to exceed
$12, 700 .
G. Elk Grove High School - Grant a request to waive the
1994-1995 $50 business license fee for the Homecoming
Parade scheduled for October 14 , 1994 from 1 :45 p.m. to
2 :45 p.m.
H. Budget Transfer - Approve the transfer of $9, 048 . 85
from the FY 1993-94 Commissions Budget into the FY
1993-94 Village Board Budget; and
Increase the FY 1993-94 Village Board budget by
$44 , 604 . 27 .
I . Grant of Easement - Adopt Resolution No. 33-94
entitled, "A RESOLUTION APPROVING A GRANT OF EASEMENT
FOR WATERMAIN BETWEEN THE VILLAGE OF ELK GROVE VILLAGE
AND ELK GROVE PARK DISTRICT - OLMSTEAD PARK. "
J. Residency - Adopt Resolution No. 34-94 entitled, "A
RESOLUTION AMENDING ARTICLE III, SECTION 3 . 2 II,

K. Zoning Variation - Adopt Ordinance No. 2375 entitled,

8 . CAPITAL IMPROVEMENTS COMMITTEE - CHAIRMAN TOSTO
FIRE ADMINISTRATIVE BUILDING - A meeting was scheduled for
Wednesday, July 6, 1994 at 6 : 30 p.m. to discuss the
remodeling of the Fire Administration Building. The Village
Manager and the Fire Chief were requested to attend this
meeting.
9. JUDICIARY, PLANNING & ZONING COMMITTEE -
CHAIRWOMAN CZARNIK
MOBIL CATERING - The committee is satisfied with the current
regulations and request this item be removed from the
agenda.
10. PERSONNEL COMMITTEE - CHAIRMAN PETRI

a. CABLE TV COMMITTEE - TRUSTEES PETRI & RETTBERG
CABLE FRANCHISE RENEWAL - A final report on the public
hearing was submitted to the Village Board for
consideration.
There are a couple of items that stand out other than
the technical items from the Village, Channel 6 and the
School Districts in regard to consumer service issues
that were brought to the Board by the residents :
1 . There should be an increase in the capability of
handling telephone complaints regarding outages and
difficulties with the service. A uniform procedure
should be developed as part of the franchise agreement
where a consumer would be credited for the amount of
down time that occurs because of a cable outage .
2 . There should be a better response time to complaints
to cable outages, restoration of sod after burial of cable.

These are some of the areas that will be discussed during
franchise negotiations .
The Village has asked for parental control on all stations
so that parents can control what is being watched in the
home.
There is a study being done with regard to other technical
items dealing with fees and current rate structure and if
they comply with federal law. A report on this study will
be available sometime in August .
b. COMMUNITY SERVICE BOARD - TRUSTEE CZARNIK
MAKE A DIFFERENCE DAY - Plans are well underway.
Residents and organizations interested in planning a
project and/or volunteering for a project should
contact the Community Service Department at 364-2676 .
SENIOR SURVEY - To date approximately 60 senior citizen
housing questionnaires have been returned to the
Village. A copy will be in the up-coming Village
Newsletter.
ADMINISTRATIVE INTERN - A new intern has been added to
the Community Service staff, who will be coordinating
the Youth Employment Service .
14 . ORDINANCES, RESOLUTIONS & COMMUNICATIONS - VILLAGE CLERK
ROTARY CLUB OF ELK GROVE VILLAGE - The Village has received
a request for a waiver of fees incidental to the carnival
and sale of food, beer and wine in an amount of $2, 600 . 00;
and
for permission to place four (4) temporary signs to be
located at the following locations :
1 . Corner of Arlington Heights Road and Elk Grove Boulevard
2 . Corner of Biesterfield and Arlington Heights Roads
3 . Corner of Nerge and Rohlwing Roads
4 . Corner of Higgins and Arlington Heights Roads
Motion to waive the fees incidental to the Rotaryfest to be
held from August 10 through 14, 1994 for the sale of food
($100 . 00) , beer and wine ($2, 000 . 00) and the carnival
($500 . 00) in a total amount of $2 , 600 .

15 . UNFINISHED BUSINESS - VILLAGE ATTORNEY
NELSON MARINE - Negotiations are underway regarding the
condition that during the four year period an amount of
$10 , 000 . 00 is annually being submitted in escrow in an
account by Nelson Marine. A forfeiture situation is now
being dealt with as for instance if the premises are sold
within a three year period and the buyer does not want to

use the variation, the issue of what happens to the
$30, 000 . 00 in escrow is being considered. The negotiations
include the fact that the Village does not want to give up
the $30 , 000 . 00 even though the variation at that point
wouldn' t be utilized or be it a free variation for that
period of time.
In working with the Nelson Marine Attorney a 50/50 split or
a cost incurred by the Village regarding this variation
would be reimbursed to the Village out of that escrow and
then the variation would be terminate.
President Gallitano stated that the Board would be allowing
this property owner not to come into compliance with Village
Code and the multi year funding was simply an economic
concession because they could not fund the full amount the
first year.
A consensus was taken of the Board as to a split of the
escrow between the Village and Nelson Marine or a full
forfeiture of the funds in escrow. The majority felt a full
forfeiture of the funds should be part of the funding
agreement for the variation.
The Village Attorney will convey this condition to Nelson
Marine and a report will be given to the Board as to their
acceptance of the clause by the next Board meeting. If this
condition is not accepted, it will be brought before this
Board for enforcement purposes .
16 . REPORT FROM THE VILLAGE MANAGER
1 . MANOR HEALTHCARE - There will be a public
hearing at 7 :45 p.m. on July 12 , 1994 to
consider the annexation of the Manor
Healthcare property on Nerge Road for the
proposed 56 bed Alzheimer Unit .
2 . POLICE DEPARTMENT- TEEN SUMMER PROGRAMS - Over 100
teenagers attended the Rock & Bowl on Tuesday, June 21,
1994 at the Elk Grove Bowl . The Police Department
continues to sponsor this event through the summer
every Tuesday through August 9, 1994 .
The Police Department is also very involved in the
Summer Jam Program this year. The first was held at the
Super KMart on Friday, June 24 , 1994 . There were
approximately 125 teenagers that attended even with the
cold, windy and wet beginning of that weekend.
There are 6 additional activities planned similar to
the Summer Jam, including Rainbow Falls . These
activities will continue until August 19, 1994 and will
be advertised in the Village Newsletter.
3 . RAINFALL - The Village recorded a rainfall of
approximately 7 inches over the course of June 23rd and
24th. The newspapers were reflecting about 4 . 2 ,
however, the Village rain gauges on both the east and
west sides of the Village recorded 7 inches of rain.
Schaumburg recorded the same total and Arlington
Heights recorded almost 6 inches of rain.
The Village had 8 intersections closed due to high
water and there were also 4 County closures at
intersections with Village streets . We do not know of
any homes or private property with any flooding due to
the high water. We are aware of some homes that

received water in the basement not coming from streets
but just because the sump pumps could not keep up with
the influx of water that came from that particular
storm.
The improvements and overflows that the Village
installed over the last two years were found to be
extremely effective in reducing the impact of the storm
on both Village streets and private property.
The last phase of the drainage improvements are under
construction right now which include the storm sewers
to be installed along Rohlwing Road in the Parkview
Heights Subdivision as well as the work that is going
on in the Shadywood area of the Village . By the end of
this construction season, the Village will have
completed all three phases of that drainage improvement
program.
17 . NEW BUSINESS
EXECUTIVE SESSION
Motion to hold an Executive Session following tonight' s
Board meeting for the purpose of discussing personnel .

Elaine Olson voiced her concerns to the Village Board regarding
the drainage and swale which is under construction in her back
yard.
Mrs . Olson was assured that the problem that she envisions will
be taken care of upon completion of the construction.
Randy Nelson, Elk Grove Village Police Officer questioned the
Board regarding the Resolution which was passed earlier this
evening regarding the residency requirements for sworn personnel
and the criteria necessary for a variation.
Officer Nelson was informed that each variation is considered on
its own merit, special facts and extremely extenuating
circumstances and that there is no list relevant to a variation.
President Gallitano stated that what the Board is not going to do
tonight is debate Personnel Policies that are privileged and are
subject to the executive session.
Mr. Ted Popielewski, Firefighter, referred to a denial that he
received regarding a request to meet with the Personnel Committee
and voiced his opinion that the Rules and Regulations should be
addressed by those who are effected.
President Gallitano responded that the Village is currently in
negotiations with the Fire Union and it is very difficult to
separate what issues are subject to negotiations and what issues
are not subject to negotiations . He further stated the he did
not want to enter into any dialogue that might effect those union
negotiations .
The President further stated that he would personally examine
this request after those fire union negotiations have been
completed. The President' s understanding was that commitment
would be honored by himself and Mr. Popielewski .

Further discussion between the President and Mr. Popielewski
relative to the residency item ensued.
Mr. Michael Wiclin of Master Motors addressed the Board regarding
the Special Use Permit that he had received earlier this evening
and requested a 90 day extension to have the fence installed
which is part of the requirements for the Special Use Permit .
The President informed Mr. Wiclan that he should work with the
Engineering Department and have the fence installed before 90
days .
