ZETTEK MUNICIPAL BUILDING AT 901 WELLINGTON AVENUE ON TUESDAY, AUGUST 9, 1994 Village President Dennis J. Gallitano called the meeting to order at 8 : 07 p .m. 1 . ROLL CALL Present : President Dennis J. Gallitano Trustees : Ronald L. Chernick, Nancy J. Czarnik, Craig B. Johnson, James P. Petri, Paul A. Rettberg, and Michael A. Tosto Absent : None Also Present : Village Manager, Gary E. Parrin; Village Attorney, William Payne; and Village Clerk, Patricia S . Smith A Quorum was present 2 . PLEDGE OF ALLEGIANCE President Gallitano led the Trustees and members of the audience in the Pledge of Allegiance to the Flag. 3 . APPROVAL OF MINUTES Motion to approve the minutes of the Regular Meeting held on July 26 , 1994 as submitted. MOVED: Trustee Petri SECONDED: Trustee Tosto Voice vote MOTION CARRIED. 4 . REPORT OF THE VILLAGE PRESIDENT - DENNIS J. GALLITANO 1 . BOARDS AND COMMISSIONS - The Oath of Office was administered to the following newly appointed members of the Boards and Commissions of the Village of Elk Grove : Joseph A. Oliveto - Zoning Board of Appeals Kelly Murphy Clancy - Board of Health Ted E. Thompson - Board of Fire and Police Commissioners Richard C. Guzzardi - Plan Commission 2 . ROAD CONSTRUCTION - VILLAGE PROJECTS - Mary Jo Pye, Assistant Village Engineer, reported on the progress of the road construction on John F. Kennedy and Elk Grove Boulevards, noting that the project is approximately 55% complete . The completion date for the project is October 14 , 1994, however, with good weather the project could be completed earlier in September. DRAINAGE IMPROVEMENT PROJECT PHASE III - Ms . Pye continued her report stating that the pavement reconstruction work on Rohlwing Road and Biesterfield Road is complete; the base course and binder course was installed today on David Lane and the surface course will be installed tomorrow, which will conclude the pavement restoration. The items remaining on this project are landscaping and fencing at the residential homes . The contract requires that all work be completed by September 1, 1994 excluding landscaping, which must be completed by October 1, 1994 . 1 08-09-94 1 3 . ROAD CONSTRUCTION - STATE & COUNTY PROJECTS - The Village Manager reported that there are other projects going on in the Village; the State project on Higgins Road; the Cook County project on Devon Avenue and Arlington Heights Road; and DuPage County will now be doing a project to widen and improve Wood Dale Road, south of Devon. The Village will be contacting DuPage County this week and next week to get an update for the next Board meeting as to how far along they are on their schedule and whether or not they anticipate completing all of the project this year. There will also be an update from the County on the Landmeier Road project for the next Board meeting. President Gallitano made the statement that while the Village has control of the improvements made on the Village roads, the Village does not have control of the timing nor the sequence of the road improvements to Higgins and Arlington Heights Roads or Landmeier Road. The next major undertaking of road improvement, the reconstruction of the Arlington Heights/Biesterfield Road intersection, will be done next year. 5 . APPROVAL OF ACCOUNTS PAYABLE WARRANT Motion to authorize payment of invoices as shown on the August 9, 1994 Accounts Payable Warrant in the amount of $1, 064 , 705 . 74 . CONSENT AGENDA A. 1994 Motorola Half-Marathon - Grant a request from Motorola for a half-marathon on certain Village roadways on Sunday, October 2 , 1994 ; and Sian Variation - Grant a sign variation to allow temporary information signs to be placed in Village parkways in conjunction with the Motorola Half- Marathon. B . Appointment-Community Service Board - Appoint Mary Cortes to the Community Service Board, term ending 4- 30-97 . C. Screen Wear, 347 S. Lively Boulevard - Grant a request to hold a warehouse sale of screenprinting and embroidery materials on August 10, 11, and 12 , 1994 from 11 :00 a.m. to 5 : 00 p.m. D. UPS Agreement - Authorize the Village President to execute a Letter Center Agreement with United Parcel Service (UPS) for the placement of two (2) letter centers on Village rights-of-way for the period from August 9 , 1994 to December 5, 1994 (SW corner Nerge and Bonaventure and 801 Chase Avenue) . E. Rotary Club - Grant a request to waive the $100 . 00 hydrant meter deposit and the $40 . 00 connection fee for the provision of water at the Elk Grove RotaryFest to be held from August 10-14 , 1994 . F. Finance Department-Data Processing - Award a contract 2 08-09-94 to HTE to upgrade the payroll software in the Finance Department in an amount not to exceed $14 , 990 . G. Metro Environmental Contractors, Inc . , Wheeling. IL - Approve the final pay estimate for Phase I of the Underground Storage Tank Project in an amount of $10, 695 .45 ; and Approve the Balancing Change Order for the removal of liquid waste from around the tank at the Charles J. Zettek Municipal Complex for a net increase of $3 , 490 . 00 from the contract price; and Approve the Balancing Change Order for the removal of a second tank at Pump House #9 (Brummel Avenue) for a net decrease of $1, 231 . 25 from the contract price. H. Eauipment-Public Works Department - Award a purchase contract to the lowest responsible and responsive bidder, Hoskins Chevrolet, Elk Grove Village, IL. for the purchase and installation of a 1995 Chevrolet 3/4 tone pick-up truck with plow in an amount not to exceed $23 , 792 . 00 , including the trade-in value of a 1986 Ford F-250 at $2, 665 . 00 . I . Rossi Contractors, Northlake, IL - Award a contract to the lowest responsive and responsible bidder to haul and dispose of non-toxic debris, accumulated at the Biesterfield, Landmeier and Dierking Terrace locations, in an amount not to exceed $7 . 98 per cubic yard for a total contract price not to exceed $40 , 000 . J. CBI-NaCon, Inc. , Plainfield, IL - Award a contract to the lowest responsive and responsible bidder to construct an elevated water tank (west side of Elk Grove Village - southeast corner of the Lexington Homes development) in an amount not to exceed $726, 400 . K. Watermain Installation-Landmeier Road - Award a contract to the Cook County Treasurer for the reimbursement of Elk Grove' s portion of watermain installation in conjunction with the Landmeier Road Reconstruction Project (Phase II) in an amount of $350 , 000 . L. Chapman and Cutler, Chicago, IL- Award a professional service contract to perform an updated bond arbitrage rebate calculation and prepare a new opinion on the Village' s arbitrage obligations in an amount not to exceed $1, 000 . M. Waste Management Northwest Contract - Adopt Resolution No. 44-94 entitled, "A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE CLERK TO EXECUTE A CONTRACT WITH WASTE MANAGEMENT NORTHWEST FOR RESIDENTIAL SOLIDWASTE, YARDWASTE AND RECYCLING SERVICE . Zettek Municipal Building. b. COMMUNITY SERVICE BOARD - TRUSTEE CZARNIK A meeting will be held on Thursday, August 18 , 1994 at 8 : 00 p.m. in Room C of the Charles J. Zettek Municipal Building. C. SUBURBAN O'HARE COMMISSION - The Commission has become active again in response to the receipt of a publication by the City of Chicago of the noise study report . That report indicated that there is reliance on federal regulations to move from stage 2 to stage 3 aircraft, which is certainly a status quo type of response from the City of Chicago. The Commission met last evening and will be meeting again in the next several days to plan further strategies for their response as to what can be done to object to that study. 15. ORDINANCES, RESOLUTIONS & COMMUNICATIONS CLASS "D" LIQUOR LICENSE - Request to amend the Village Code and increase the number of Class "D" Liquor Licenses and authorize the issuance of a license to Buster' s Billiards & Sports Bar, Inc. located at 2801 Touhy Avenue. Motion to adopt Ordinance No. 2385 entitled "AN ORDINANCE AMENDING TITLE 3 , CHAPTER 3 , SECTION 3-3-7 , NUMBER OF LICENSES OF THE VILLAGE CODE OF THE VILLAGE OF ELK GROVE VILLAGE BY INCREASING THE NUMBER OF CLASS "D" LIQUOR LICENSES (BUSTERS BILLIARDS & SPORTS BAR, INC. ) " MOVED: Trustee Czarnik SECONDED: Trustee Rettberg AYES : Trustees Chernick, Czarnik, Johnson, Petri, Rettberg, Tosto MOTION CARRIED 6 08-09-94 16 . UNFINISHED BUSINESS NELSON MARINE. 1200 E. Higgins Road - An ordinance was presented, which provides for the variation from the Zoning Ordinance and to further provide that there be a four year escrow, calling for the paying of four $10 , 000 payments which would begin March 31, 1995 and for the three years thereafter. The variation would be conditional upon those payments being made annually and if in fact the payments are not made the escrow would be dispersed and forfeited 501 to the Village and 50% back to the owner. Trustee Johnson questioned the lack of a provision regarding the interest accrued on the account . The Attorney' s response indicated that the interest would accrue to the owner of the property. Motion to adopt Ordinance No. 2386 entitled "AN ORDINANCE GRANTING A VARIATION OF SECTION 3 . 55B (2) AND 3 . 94B OF THE ZONING ORDINANCE PERTAINING TO THE SURFACE REQUIREMENT FOR THE PARKING OF VEHICLES TO PERMIT THE PARKING AND STORING OF BOATS AND/OR BOAT TRAILERS IN THE REAR YARD ON PROPERTY LOCATED AT 1200 EAST HIGGINS ROAD, ELK GROVE VILLAGE (NELSON MARINE) . ELK GROVE CENTER FOR THE PERFORMING ARTS - Live performances will be presented of Twelfth Night by William Shakespeare . This group consists of a large number of Elk Grove Village residents who will be performing the play at the Super K Mart location on August 19, 20 and 21 ; August 26, 27, and 28; and September 2 , 3 , 4, and 5, 1994 . Tickets will be sold for these performances . Since this is a local group it is hoped that a lot of people will attend and find it of interest . If there is interest shown by the community, the Center will continue with other programs of the same type of quality. AUDIENCE - 9 : 08 P. M. No response. 18 . NEW BUSINESS FIRE ADMINISTRATION REMODELING - Request to waive the permit fees for the remodeling work to be done on the Fire Administration Building in the amount of $4 , 000 . 00 . Motion to approve the request and waive the permit fees in the amount of $4, 000 . 00 for the remodeling of the Fire Administration Building at 101 Brantwood Avenue.
