ILLINOIS HELD AT THE CHARLES J. ZETTEK MUNICIPAL BUILDING
AT 901 WELLINGTON AVENUE ON TUESDAY, SEPTEMBER 13, 1994
Village President Dennis J. Gallitano called the meeting to order
at 8 : 09 p.m.

2 . INVOCATION
The Reverend Jack R. Cory, Pastor of Prince of Peace United
Methodist Church, delivered the invocation.
3 . APPROVAL OF MINUTES
Motion to approve the minutes of the Regular Meeting held on
August 23 , 1994 as submitted.

4 . REPORT OF THE VILLAGE PRESIDENT - DENNIS J. GALLITANO
1 . SOLID WASTE AGENCY OF NORTHERN COOK COUNTY - Attended a
meeting on August 30, 1994 to discuss the 404 permit
denial by the Army Corps of Engineers .
2 . COMMUNITY HEALTH - Met on August 31, 1994 with Brother
Philip Kennedy and Kelly Clancy of Alexian Brothers
Medical Center to discuss a regional approach to
improving community health in the area.
3 . CHICAGO AREA TRANSPORTATION STUDY GROUP - Met on
September 1, 1994 to discuss redefining subcommittee
tasks and transportation subcommittee matters .
4 . NORTHWEST COUNCIL OF MAYORS - Met on September 8, 1994
to discuss changing rules and procedures relating to
this organization.
5 . SOLID WASTE AGENCY OF NORTHERN COOK COUNTY - Met on
September 8 , 1994 to further discuss litigation options
in connection with the Army Corps of Engineers permit
denial .
6 . SUBURBAN O'HARE COMMISSION - Several members met on
September 10, 1994 with Lieutenant Governor Kustra to
discuss issues relating to the O'Hare expansion and the
hold pads .
7 . SOLID WASTE AGENCY OF NORTHERN COOK COUNTY - Met this
morning, September 13, 1994 , with members of the
industrial park to inform them about the recycling
ordinance that the Village will be putting into place
in October of this year.

8 . GROVE MALL - Several significant events have occurred
within the last two or three weeks :
1 . A lawsuit was filed against the Village on August
25, 1994 seeking to enjoin the Village from
condemning the property of Grove Mall . The
Village had not taken action at that time to
condemn. In the interim, an offer was made to
purchase the property from the owners of the Grove
Mall . There have been some recent discussions as
late as this afternoon on the premise that the
Village would entertain settling or discussing a
possible redevelopment with the existing owners
provided that the lawsuit against the Village and
all parties thereto was dismissed immediately. We
are pleased to report that as of this afternoon
the Village has received a notice of dismissal by
the attorneys representing the owners of the Grove
Mall that the action against the Village has been
dismissed. That will give the Village the ability
to enter into discussions with the owners of the
Grove Mall to seek the redevelopment of that
parcel on an amicable basis . One of the
conditions of the Village moving forward again to
even discuss settlement however was that fact that
the Village was going to have a first reading of
the condemnation ordinance tonight . ( The first
reading is not an approval of the ordinance but
simply a first reading and by doing that the
ordinance is entered into the record. ) Secondly,
all settlement negotiations on a redevelopment
agreement must be completed by September 30, 1994
and if settlement discussions are not concluded by
that time then the matter of condemnation would
again be brought before this Board for its
consideration.
The Village feels that good faith has been shown by the
owners of the Grove Mall by their dropping of the lawsuit .
Another condition of the redevelopment is that the financing
be in place by December 31, 1994 and the ground breaking
would occur by March 1, 1995 .
President Gallitano presented an ordinance of condemnation
of the Grove Mall property for a First Reading.
Motion to have a First Reading of an Ordinance entitled "AN
ORDINANCE AUTHORIZING THE ACQUISITION OF PROPERTY THROUGH
CONDEMNATION OR OTHERWISE IN ORDER TO ELIMINATE THE BLIGHTED
CONDITIONS EXISTENT THEREON" .

5 . APPROVAL OF ACCOUNTS PAYABLE WARRANT
Motion to authorize payment of invoices as shown on the
September 13, 1994 Accounts Payable Warrant in the amount of
$1, 339, 115 . 06 .

Trustee Rettberg requested that item D. consideration to execute
an agreement between the Village of Elk Grove Village and the

Suburban Bus Division (PACE) be removed from the Consent Agenda.
Trustee Tosto requested that item E . consideration of adopting a
smoking policy and rescinding a former smoking policy be removed
from the consent agenda.
6 . CONSENT AGENDA
A. Public Hearing-Special Use Permit - Authorize the Plan
Commission to hold a public hearing on the petition of
Office Depot to construct a retail shopping center in
an I-2 zoning district located at the southeast corner
of Devon and Busse .
B . Eden Road Watermain Project - John Neri Construction
Approve the Balancing Change Order for a net decrease
of $578 . 50 ; and
Approve the Final Pay Estimate of $20 , 206 . 50 for this
project .
C. Parkway Trees - St . Aubin and Brothers, Inc . , Kirkland,
Il . - Award a purchase contract to the lowest
responsive and responsible bidder to furnish and plant
three hundred (300) balled and burlapped deciduous
shade trees in an amount not to exceed $139 . 70 per
tree, and not to exceed a total amount of $20, 676 from
the General Fund and $21, 235 from the Capital Projects
Fund; and
Increase the Capital Projects Fund budget by $21, 235
for the purchase of 152 additional trees scheduled for
planting along Meacham Road.
F. No Parking, south side of Bonaventure - Adopt Ordinance
No. 2388 entitled, "AN ORDINANCE AMENDING THE VILLAGE
CODE OF THE VILLAGE OF ELK GROVE VILLAGE, SECTION 6-4-
5-3 , PROHIBITED AND RESTRICTED AREAS (BONAVENTURE) . "

VILLAGE OF ELK GROVE VILLAGE AND THE SUBURBAN BUS
DIVISION (PACE) OF THE REGIONAL TRANSPORTATION
AUTHORITY (DIAL-A-RIDE) " .

CONSENT AGENDA - ITEM E
Trustee Tosto commented on the proposed new smoking policy
which prohibits smoking in all of the Village facilities,
stating that he did not feel that the present smoking policy
was a problem. He further stated that he felt a designated
indoor smoking area should be provided so that employees did
not have to go outside the building to smoke .

E. ELK GROVE SMOKING POLICY - Adopt Resolution No. 48-94
"A RESOLUTION ADOPTING THE VILLAGE OF ELK GROVE VILLAGE
SMOKING POLICY AND RESCINDING RESOLUTION NO. 6-93" .

MOTION FAILED FOR LACK OF A MAJORITY - (President Gallitano
declined to vote stating that the policy, as presented,
should be modified for employee moral and referred the
matter back to staff for review of the ventilation system
and a recommended smoking area. A recommendation should be
made to the Committee of the Whole for modification to the
proposed policy. )
BOARDS AND COMMISSIONS
7 . CAPITAL IMPROVEMENTS COMMITTEE - CHAIRMAN TOSTO
A meeting of the committee will be scheduled at the next
Board meeting to coincide with the Youth in Government
program.
8 . JUDICIARY, PLANNING & ZONING COMMITTEE
CHAIRWOMAN CZARNIK
FENCE VARIATION - A meeting has been scheduled for October
3 , 1994 at 7 : 00 p.m. to review a recommendation of denial
from the Zoning Board of Appeal relative to the requested
variation for the construction of a solid fence on property
located at 97 Keswick Road; and the Parental Responsibility
Ordinance . Students in the Youth in Government program will
be invited to attend this meeting.
9 . PERSONNEL COMMITTEE - CHAIRMAN PETRI
A meeting will be scheduled during the Youth in Government
program.
10 . RECYCLING COMMITTEE - CHAIRMAN CHERNICK AND
VICE CHAIRMAN JOHNSON
A meeting was scheduled for Tuesday, September 20, 1994 at
6 : 30 p.m. The Assistant Village Manager, the Health
Coordinator and the Village Sanitarian were requested to
attend this meeting.
INDUSTRIAL & COMMERCIAL RECYCLING - A meeting was held this
morning with the business community to explain the ordinance
that will take effect this fall for recycling in the
industrial park and commercial establishments . There was
also a seminar to help educate the businesses of the
community as far as how to precycle, recycle and work on
waste reduction.
Attending that meeting were members of staff from the Health
Department and Anne Tennes from the Solid Waste Agency of
Northern Cook County. Guest speakers included some business
owners from the community, who originally were very
apprehensive about the recycling program, have found it to
be very successful .

13 . REPORTS OF OTHER BOARDS, COMMISSIONS & COMMITTEES
a. CABLE TV COMMITTEE - TRUSTEES PETRI & RETTBERG
PUBLIC EDUCATION GOVERNMENT PUBLIC HEARING - A letter is
being mailed tomorrow to all of the Cable Group communities
and schools notifying them of the public hearing to be held
on September 28, 1994 in the Council chambers of the Charles
J. Zettek Municipal Building at 7 : 30 p.m. A special notice
will be given to Elk Grove High School so they can have the
students be prepared to attend this meeting.
b. COMMUNITY SERVICE BOARD - TRUSTEE CZARNIK
MAKE A DIFFERENCE DAY - The plans for the Make a Difference
Day - Harvest Celebration are progressing nicely. Nearly 20
projects are being planned in Elk Grove Village to promote
this day of doing good. The Celebration will take place on
October 22 , 1994 from 1 : 00 p.m. to 5 : 00 p.m. at the Elk
Grove Village Park District Pavilion grounds.
SENIOR CITIZEN HOUSING SURVEY - A thank you is extended to
all the village residents who responded to the
questionnaire, the comments and input were greatly
appreciated.
The next meeting of the Community Service Board will be held
on Tuesday, September 15, 1994 at 8 : 00 p.m. in Meeting Room
C on the lower level .
14 . ORDINANCES, RESOLUTIONS & COMMUNICATIONS

15 . UNFINISHED BUSINESS
C . 1591 OREGON TRAIL - Petition for a variation from the
Zoning Ordinance to permit the parking of a
recreational vehicle that would encroach into the
required six foot distance between the structures and
lot line.
Motion to adopt Ordinance No. 2389 "AN ORDINANCE GRANTING A
VARIATION OF SECTION 3 . 55A(2) OF THE ZONING ORDINANCE OF THE
VILLAGE TO PERMIT THE PARKING OF A RECREATIONAL VEHICLE THAT
WOULD ENCROACH INTO THE REQUIRED SIX (6) FOOT DISTANCE
ADJACENT TO BOTH THE STRUCTURE AND LOT LINE ON PROPERTY
LOCATED AT 1591 OREGON TRAIL, ELK GROVE VILLAGE (ASCONE) " .

16 . REPORT FROM THE VILLAGE MANAGER
1 . FALL LEAF COLLECTION PROGRAM - The
information fliers have been distributed to
the Village residents by Waste Management
with their invoices . In addition to that
information going to residents the Village
will also be advertising on Channel 6 and the
Village message board. Extra fliers will be
available at the Municipal Complex and we
will check to see if they can be displayed at
the new Elk Grove Park District Pavilion.
Last year the Village tried to have only 3
collections, however this year there will
again be 4 collections as in the past .

2 . WATER TOWER CONSTRUCTION - The Village has had its pre-
construction meeting with the firm that will be
constructing the water tower on the Lexington Homes
property. The site work should begin some time in
October. The tower itself will be fabricated during
the winter months off site and brought to its actual
location during the month of February. That
construction will go on until July, then it will be
painted and operating in August, 1995 .
3 . TREE REPLACEMENT PROGRAM - The purchase of trees was
approved earlier this evening under the consent agenda
from St . Aubins and Brothers in Kirkland, Illinois .
The Village was able under the competitive bidding
process to attain very good rates this year which will
be extended to the public under the tree replacement
program. The trees this year will be $70 . 00 less than
last year. The trees will be selling for $160 . 00 which
includes tax and installation versus last years price
of $230 . 00 . Information will be given out to the
public on the trees .
4 . COMMONWEALTH EDISON - About one and a half years ago
the Village undertook an effort with the NWMC as well
as other municipal conferences to create a legal fund
to approach the Illinois Commerce Commission to obtain
an order that would have Commonwealth Edison revise its
rate structure as it applies to Chicago' s 416 franchise
fee . The City of Chicago has a franchise fee of 4% of
Commonwealth Edison' s gross revenue . That cost was
spread over not only Commonwealth Edison' s customers in
the City of Chicago but over their entire customer base
which included the suburban area also. This resulted
in a suburban subsidy of over $33 , 000, 000 annually to
the City of Chicago. The ICC ruling if it is upheld
will show a drop in the annual energy cost to
Commonwealth Edison from $8 . 00 to $12 . 00 a year for
Village residents . This equates to, just for the
Village of Elk Grove, a savings of approximately
$120, 000 to $180, 000 per year. Businesses will find a
greater savings on their bills . This all started with
a $350 . 00 investment by the Village to participate in
this program with the Northwest Municipal Conference .
