HELD FEBRUARY 1,1 83 RECESSED FROM
NOVEMBER 30, 19 11t
President Charles J. Zettek called the meeting to order at 7:03 p.m, in the
Municipal Building, 901 Wellington Avenue, Elk Grove Village and noted for
the minutes that the following Trustees were present: Joseph T. Bosslet,
Ronald L. Chernick, Edward R. Hauser, James P. Petri, Michael A. Tosto, and
Stephen M. Uhlarik. Village Attorney, George Knickerbocker; Village Manager,
Charles A. Willis; Village Clerk, Patricia S. Smith, and Court Reporter,
Ernest W. Busch were present at this meeting.
President Zettek explained that the hearing tonight was a continuation of
the hearing held on November 30, 1982 to discuss the various areas of the
Industrial Park which have experienced flooding and drainage problems for
many years, and the Tax Levy to be imposed on this area to cover the cost of
providing special municipal services, including the construction of a storm
water collection facility and system. The President further stated the
Four and a Half -Million Dollars,from the Tax Levy, would be met with a
contribution of One Million Dollars from the Village and the maintenance of
the ditches henceforth. This Special Service Area is bounded by Touhy Avenue
on the north, Elmhurst Road on the east, Pratt Boulevard on the south, and
Busse Road on the west.
President Zettek recognized William Ryan, Attorney for the Greater O'Hare
Association of Industry and Commerce. Mr. Ryan called upon an expert
witness, Carl Kupfer, who in turn presented to the Board his Professional
Resume to be entered into the Hearing. Mr. Kupfer, owner and principal of
Site Planning and Civil Engineering Corporation, told the Board that he had
been hired by the Association to examine the reports of RJN Environmental
Associates, Inc. (Consulting Engineers hired by the Village of Elk Grove).
Mr. Kupfer then presented to the Board his findings and analysis of the
affected area. His opinion being there was a less costly alternative to the
project than the one offered by RJN; however, more study needs to be done
as to what levels are tolerable and acceptable.
President Zettek questioned Mr. Kupfer on various items and complimented
him on his factual presentation.
President Zettek asked if anyone from RJN Environmental Associates wished
to respond to Mr. Kupfer's assessment of the situation.
Richard J. Nogaj, President of RJN Environmental Associates, said he could
not respond until he has seen a written report of the presentation, although
some of the things presented were in line with Alternative Five of their
proposal. Mr. Nogaj stated that there should be a decision made as to
covering the ditches or just maintaining them. He showed a graph of the 24-
hour rainfall in December and explained the degrees of protection wanted and
needed. Mr. Nogaj also stated that a cost benefit analysis on flood drainage
is so subjective that you could probably not get any two engineering firms
to agree.
Discussion followed between the engineering firm representatives and President
Zettek regarding the level of tolerance to this situation.
Members of the Industrial Park, who were in the audience, also took part in
the discussion saying they were willing to take care of the ditches on their
property but wanted the Village to act as coordinator to help enforce those
delinquent property owners who will not cooperate.
President Zettek responded that the Village has not thus far been able to get
some owners to clean their own ditches, and asked if those present would be
willing to join in concert with the Village for a Class Action Suit against
those who will not conform?
President Zettek stated that the Village has spent $34,000 for RJN to study
a way to remove this problem as the Village is willing to do whatever can

be done for a reasonable amount of money to make sure that all businesses
can operate in a reasonable fashion without flooding. President Zettek asked
the Industrial Park owners to telt the Board what they want done as it is
the Village's responsibility to do so.
The President of Wayco Foods suggested a committee of men from the Industrial
Park get together with the Village and work together on the project.
President Zettek asked him to let the Village know when they will meet and
the Capital Improvements Committee and the Engineering Staff would also
meet with them.
At this time, 9:28 p.m., President Zettek, with the concurrence of the Board,
recessed the meeting until Tuedsay, March 29, 1983 at 7:00 p.m.
