HomeMy WebLinkAboutVILLAGE BOARD - 11/30/1982 - PUBLIC HEARING MINUTES OF A PUBLIC HEARING Of THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ELK GROVE VILLAGE HELD NOVEMBER 3D, 1982 President Charles J. Zettek called the meeting to order at 7: 15 p.m. in the Municipal Building, 901 Wellington Avenue, Elk Grove Village and directed the Acting Village Clerk, Ilafern Snick to call the roll in the absence of the Village Clerk, Patricia S. Smith. Upon the roll being called the following answered PRESENT: Trustees Joseph T. Bosslet, Ronald L. Chernick, Edward R. Hauser, James P. Petri , Michael A. Tosto, Stephen M. Uhlarik. Village Attorney, George Knickerbocker; Village Manager, Charles A. Willis; and a Court Reporter, representing Ernest W. Busch and Associates, were present at this meeting. President Zettek stated that for many years , various areas of the Industrial Park have experienced flooding and drainage problems which have resulted in economic hardships to affected businesses. Being aware of the need to resolve this situation, the Village Board retained the services of RJN Environmental Associates , Inc. to study the area which has experienced the worst problems in recent years and to propose alternatives to resolve the situation. This area (the Special Service Area) is bounded by Touhy Avenue on the north, Elmhurst Road on the east, Pratt Boulevard on the south, and Busse Road on the west. President Zettek further stated that drainage in the Special Service Area is provided, for the most part, by open ditches which are part of the adjoining private property. However, for these ditches to work properly, they must be kept clean and free of debris , sediment and weeds. Although some property owners have attempted to maintain the ditches on their property, many more have not. The Village must, therefore, intervene in what is essentially a private matter among the area property owners in order to protect the interests of all property owners , taxpayers and businesses. Village Attorney, George Knickerbocker gave the legal aspects of this endeavor. Richard J. Nogaj , President, and Richard Nelson, representatives from RJN Environmental Associates , Inc. , Consulting Engineers, gave a brief history of the problem, existing conditions , storm effects , a slide presentation of how the area could look after this project is completed, formulation of alternatives , and the selected plan for this project. Thomas Flatland, representing Flatland, Hinners and Company, Specialists in Public Finance, gave a financial presentation, a review of the summary schedule, and a review of the detailed bond schedules for 10, 15, and 20 year terms . Village Attorney, George Knickerbocker gave a summary of the rights of the taxpayers and stated that if 51% of legal owners sign a petition to express their dislike for the Special Service Area, the Village Board could take other action to install a Special Assessment District. If that were to be done, the Village probably would not contribute to the cost of this project. At this time the bond market is very favorable. President Zettek opened the meeting to the audience for their views and comments. It was the consensus of the audience that they require more time to hire a consulting engineering firm to look into this matter on their behalf. President Zettek stated a letter was received from J. J. Watkins, Assistant Vice President of Robert E. McKee, Inc. , Construction Real Estate, protesting this project. This letter was made a part of the minutes. At this time, 9: 18 p.m. , President Zettek, with the concurrence of the Board , recessed the meeting until Tuesday, February 1 , 1983 at 7:00 p.m. Ilafern Snick Acting Village Clerk arle J.
