HomeMy WebLinkAboutVILLAGE BOARD - 05/18/1965 - MINUTES OF THE REGULAR MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ELK GROVE VILLAGE HELD ON MAY 18, 1965, President Jack D. Pahl called the meeting to order at 8:06 p. m. in the Municipal Building in said Village and directed the Village Clerk to call the roll. Upon the roll being called the following Trustees answered "PRESENT" - Ronald Chernick, George C. Coney, Thomas A. Garrity, Ralph A. Lewis, George E. Mullen, Charles J. Zettek. Attorney Hofert was present at this meeting. Trustee Lewis requested that the minutes of the regular meeting of May 6, 1965 be corrected as follows: page 1 , bottom paragrpah, line two should read, "Administrator be directed to send a letter to Jet Die Casting Corporation transmitting the Village Attorney's and Village Board's". page 2, first paragraph, line two should read, "of annexing land east of Elmhurst Road, directly east of Jet Die Casting, north of Higgins Road and south of the Tollway". page 3, paragraph 6 should read; "Board members questioned Mr. Snead regarding the above question. Trustee Lewis asked whether or not they would agree to deleting the leasing aspect and Mr. Snead replied that he would have to check back with his employers before answering this question. page Q, the following sentence to be added to paragraph one, "Trustee Mullen said that a special use hearing could not be conducted for the use proposed by Mr. Helbig." It .was moved by Trustee Lewis and seconded by Trustee Zettek that the minutes of May 6, 1965 be approved as corrected and that the Board dispense with the reading thereof. The President direcxed the Clerk to call the roll on the motion and upon the roll being called the following Trustees answered "AYE" -- Chernick, Coney, Garrity, Lewis, Mullen, Zettek; "NAY" - none; "ABSENT" - none. Whereupon the President declared the motion carried. It was moved by Trustee Zettek and seconded by Trustee Coney that the mi.nutvs of the regular meeting of May 11 , 1965 be approved as submitted and that the Board dispense with the reading thereof. The motion was voted upon by acclamation; whereupon the President declared the motion carried. Attorney Hofert reported: 1 . That he met with the Village Administrator today and went over the proposed Village Manager ordinance. He said that the copy distribu'ed at this meeting was prepared on the basis of the changes discussed previously. 2. That there is enabling legislation before the State General Assembly as to licensing of contractors and he has written to the Illinois Municipal League for a copy of this bill. 3. That he has given the Board members a report on some of the current bills before the Legislature that have not been highlighted in some of the Illinois Municipal League Reviews which bills might have application to Elk Grove Village and that copies of the bills will be made available to the Board within the next week or so. Q. That a proposed ordinance has been submitted, as requested, on the open drainage question. Trustee Mullen reported that according to a newspaper article an ordinance has been adopted by the Village of Wheeling which prohibits a member n£ the VLJJaap, Rn rd nervingnn an apnninted Board or Cnmmigaion. Attorney Hofert was questioned as to whether or not a Village Board member is precluded by State Statutes from - 1 - Reg. 5-18-65 so suing, Mr, Hofert said he does not know of any absolute decisions in this regard, however he said he would think that recommending a decision as a member of a Board or Commission when said recommendation is to be acted upon by that same person as a member of the Village Board would be contradictory to the intent. He said that he would check the legality of such dual membership and report to the Board next week. Following comments by Trustee Lewis Attorney Hofert said he will report on the status of pending legislation every two weeks, President Pahl suggested that this be done on weekly basis since the legislative session is nearing adjournment, Mr. Hofert said he is a member of the Illinois Municipal League Legislative Policy Committee and will meet with them on Thursday and that if there is any new legislation which should be introduced, now is the time for so doing. Mr. Hofert also said that the legislators are in the Chicagoland area on Saturdays and Sundays now and that if the Board wishes an informal session can be arranged to discuss any particular legislation in which the Board is interested, President Pahl asked that this he done and that the Board be notified of the date, Village Administrator Majoros reported that he and Attorney Hofert have discussed the 4,20 water deposit reeuired for new customers and he will have a written recom- mendation distributed to the Board this week. Village Engineer Fletcher reported that he is waiting for a report from the Division of Waterways on the drainage problem east of Elmhurst Road, Mr. Fletcher said that he and Mr. Majorca discussed the problem with the Division of Waterways' Engineer and they feel it is not a serious problem at this time. However, Mr. Fletcher said that when all the property west of Route 83 is completely developed there may be a serious problem. As soon as this report is received, Mr. Fletcher said he will report to the Board. Regarding the storm drainage in Unit 22 (a matter of re-routing a ditch), Mr. Fletcher said he understood this problem has been taken care of. Mr.Majoros said he believes this has been accomplished. Mr. Fletcher reported that he has prepared cost estimates of the proposed Ridne Avenue improvement. The coat of curb and gutter along the east side of the street, widening of Ridge Avenue by 3 feet, two catch basins, extension of the 36" sewer along the east side, removal of damaged pavement, and the repaving of the entire street from Laurel to Howard Street will be approximately 432,000. If the curb and gutter and the widening of the street are omitted from the project, the cost will be reduced by about $10,000. Following discussion, Board members asked for a complete breakdown in writing and Mr. Fletcher said he will submit this within a few days, In reply to Trustee Lewis, Mr. Fletcher said that if the road is sloped preps,-]y toward the ditch there would be no danger to the sub-base of the road surface if the curb and gutter are omitted. Village Engineer Fletcher than read a letter submitting, with regret, his resi.ynation as Village Engineer of Elk Grove Village. He said that at the present time his work load is very heavy and a considerable amount of it requires personal attention. Mr. Fletcher said that the only serious problem he can foresee for the Village is that of an adequate water supply and recommended that the Village ! keep at leastten years ahead of the demand. He also recommended that the maximum pressure in the water mains be reduced from its present pressure to a maximum of 60 lbs. and a minimum of 50 lbs., and that the next Village Engineer be given all the responsibility of engineering for the water system and should work with the Water Superintendent to regulate, maintain and expand the system. Mr. Fletcher said he will continue as Engineer until a successor has been appointed and becomes acquainted with the pending work. President Pahl said he was very regretful that Mr. Fletcher has taken this step. Trustee Mullen opened discussion on the question of open drainage ditches in industrial areas. Village Administrator Majorca distributed copies of the proposed ordinances, prepared by Attorney Hofert, which relate to this subject. Trustee Mullen asked if there could be a positive distinction between a ditch and a swale. Engineer Fletcher said he will submit a definition to Attorney'Hofert. President Pahl asked that the Attorneys Engineer and Administrator work ,together on the preparation of - 2 - Reg. 5-18-65 r� this ordinance and if Board members have any thoughts they should be submitted to the Administrator. In the absence of the Street Department Foreman, the Village Clerk read the Street Department report for the month of April 1965, a breakdown of the total man hours spent on various aspects of the Department's work. In reply to President Pahl, Trustee Mullen said he will have a report in two weals on the proposed chanaes to the Suburban Building Officials Code. In response to President's Pahl questions there were no persons in the audience who wished to address the Board members. Trustee Lewis said that the management of the shopping center parking lots (The Grove and The Park ' n' Shop) should be notified that they are not complying with the requirements of the Municipal Code as to parking dividers, and he asked Mr. Majoros to do so. Trustee Zettek said that no action is being taken on the Fire Chief's recommendation for Fire Department District Chief desiggations pending further study of the Fire Department rules and regulations. Mm. Maforos said that he has a copy of a tentative set of amended rules prepared by Chief Haar and that copies will be made available to the Board members. President Pahl referred the consideration for construction of a bridge over Salt Creek at Clearmont Drive (formerly on the Streets Committee agenda) to the Budget Committee. The Clerk read the following: 1 . A letter from Richard W. .Mankej Real Estate, Arlington Heights, stating that he and a partner own approximately 10 acres at the southeast corner of Devon Avenue and Arlington Heights Road, that the frontage along Devon is now zoned commercial under the DuPage County Zoning Ordinance. He said they were disappointed in an earlier attempt to annex this land to the Village under a commercial classification, however, they would still like to do so and requested a reply from the Village as to whether or not this is feasible. Following discussion, President Pahl said he would advise Mr. Menke that until the comprehensive zoning ordinance is prepared no basic changes in the Village's present structure are being made. 2. A letter dated May 14, 1965 from Mr. D. R. White, General Tank Equipment Company requesting permission, as a contractor for Chicago Magnet Wire, to extend the present process water line. Trustee Garrity asked whether or not it has been established that they are a non-conforming use under the Zoning Ordinance. Attorney Hofert said that he will review all the records in relation to Chicago Magnet Wire and give the Board a report at the next regular meeting. Trustee Lewis reported that Mr. Reffner who is making the air tests for the Village regarding Chicago Magnet Wire feels that it is most necessary that he enter the plant to examine the control equipment, however repre- sentatives of Magnet Wire have been reluctant to admit him. Trustee Zettek suggested that Trustee Lewis call Mr. Rcb ert Negele of Chicago Magnet Wire and tell him that this is not in keeping with the spirit of cooperation with which Mr. Negele prides himself. Attorney Hofert said that this is an ultimate question of public health and the Village's consultant has every right to make an inspection. Trustee Lewis said he will call Mr. Negele on May 19th. 3. A letter dated May 12, 1965 from Arthur Anderson & Company submitting a proposal for the audit of the Village's financial records for the fiscal year ended April 30. 1965. Their charges would be at their regular - 3 - Reg. 5-18-65 per diem rates plus out-of-pocket expenses, and they expect that their fees would approximate . 2,500 for the Municipal Funds and 41 ,500 for the Waterworks and Sewerage Fund. It was moved by Trustee Coney and seconded by Trustee Mullen that the Board employ the firm of Arthur Andersen & Company to audit the books and records of the Village of Elk Grove Village for the fiscal year ended April 30, 1965. The President directed the Clerk to call the roll on the motion and upon the roll being called the following Trustees answered "AYE-k - Chernick, Coney, Garrity, Lewis, Mullen, Zettek; "NAY"- none; "ABSENT" - none. Whereupon the President declared the motion carried. The Clerk read a letter to the President and Board of Trustees dated May 18, 1965 from Fire Chief John J. Haar stating, "In the interest of the morale of the Elk Grove Village Fire Department, I hereby request that the rdduction in rank charges of Lieutenant Alvin Krasnow from the rank of Lieutenant to fireman, be withdrawn. However, I do hereby suspend Lieutenant Alvin Krasnow from duty for a period of 90 days from the date of this letter, for violation of the Rules & Regulations of the Elk Grove Village Fire Department." It was moved by Trustee Zettek and seconded by Trustee Lewis that the Board advise the Fire and Police Commission to suspend any further investigation as a fact finding body with regard to the action taken by Chief Haar against Lieutenant Krasnow. The President directed the Clerk to call the roll or the motion and upon the roll being called the following Trustees answered "AYE" -Chernick, Coney, Garrity, Lewis, Mullen, Zettek; "NAY" - none; "ABSENT" - none. Whereupon the President declared the motion carried. The Clerk read a letter dated May 16, 1965 from Louis A. Hartig, Commander-Elect of the Elk Grove Village Post 9284, Veterans of Foreign Wars, requesting a licppr license for June 3rd through June 6th, 1965 for the purpose of dispensing bee_ only for consumption on the premises at the Peony Pageant carnival to be held at the Grove Mall Shopping Center. It was moved by Trustee Lewis and seconded by Trustee Mullen that the Board waive the license fee for a liquor license for U.F.W. Post 9284 for June 3rd through June 6th, 1965 contingent on their providing proper dram shop insurance in the amount of 4100,000 to $300,000. The President directed the Clerk to call the roll on the motion and upon the roll being called the following Trustees ars veered "I.YE"- Chernick, Coney, Garrity, Lewis, Mullen, Zettek; "NAY" - none; "ABSENT" - none. Whereupon the President declared the motion carried. The Clerk read the following: 1 . A letter dated May 14, 1965 from Mr. R. Dale Yung, Assistant to Governor Kerner, stating that House Bill 105 was approved by the Governor on May 13th and will become effective January 1 , 1966. The Clerk said that this is the legislation which provides that land in a rural fire protection district is automatically disconnected from the rural district upon its annexation to a municipality; and that at the suggestion of Attorney Hofert, copies of the bill will be obtained so _ that the Village can take whatever action may be necessary as of January 1 , 1966. 2. A letter dated April 28, 1965 from Arthur J. Boyce submitting his resignation as Civil Defense Director, Trustee Zettek said he did an excellent job and the Village has a great many advantages, civil defense-wise, that very few other Villages have as a result of Mr. Boyce's work. A letter of appreciation will be sent Mr. Boyce for his services. 3. A letter dated May 17, 1965 from Warren Jacobsen recommending that the Playground and Recreation Board be increased by two people to give the Board additional flexibility for committee assignments in addition to more diversified representation at meetings. - 4 - Reg. 5-18-65 Attorney Hofert will check the State Statutes to determine whether or not the exact number of members is prescribed. 4. A Legal Notice of Public Hearing, Docket #892, to be held May 28th at the Mount Prospect Village Hall regarding a proposed change from R-3 Single Family Residence to R-6 General Residence for approximately 33 acres of land located on the north side of Algonquin Road approximately 877 feet east of Wilke Road. This was referred to the Plan Commission for attendance at this hearing. 5. A letter dated May 14, 1965 from Henry W. Maier, President of the National League of Cities, reporting that the "Congress of Cities" will be held in Detroit, Michigan July 24th through July 28th, 1965 and expressing the hope that the Village Board authorizes representatives to attend this conference. 6. A notice from the State Division of Highways of Motor Fuel Tax Allotment for the month of April 1965 in the amount of •,66,675.14. 7. A notice from the State Department of Revenue of Sales Tax to be remitted to the Village for the month of February, 1965 in the amount of X39,337.49. It was moved by Trustee Mullen and seconded by Trustee Coney that the Board hold a first reading of a proposed ordinance entitled "AN ORDINANCE AMENDING CHAPTER 4 OF THE MUNICIPAL CODE OF ELK GROVE VILLAGE RELATING TO THE POSITION OF VILLAGE MANAGER". The President directed the Clerk to call the roll on the motion and upon. the roll being called the following Trustees answered "AYE" - Chernick, Coney; Garrity, Lewis; Mullen, Zettek; "NAY" - none; "ABSENT" - none. Whereupon the President declared the motion carried. The Clerk then read the aforementioned ordinance. It was moved by Trustee Mullen and seconded by Trustee Lewis that the Board direct the Village Attorney to prepare an amendment to the Municipal Code changing the designation from officer to employee of the Building Inspector, Health Inspector, Superintendent and Foreman of Public Works, Electrical Inspector and the Superin- tendent of the Water and Sewer Department, thereby leaving as officers the following: Attorney, Prosecutor, Treasurer, Historian, Photographer and Village Administrator and that the Village Attorney review Chapter 9 of the Municipal Code and prepare an amendment making any necessary .ehanges thereto in relation to the above changes, The President directedrA&_ Clerk to call the roll on the motion and upon the roll being called the following Trustees answered "AYE" - Chernick, Coney, Garrity, Lewisj Mullen, Zettek; "NAY" - none; "ABSENT" - none. Whereupon the President declared the motion carried. Trustee Garrity said he has studied the proposed amendment to the zoningprdinance which would incorporate some of the provisions of the covenants thereby strenghten- ing some areas of the zoning ordinance. Trustee Garrity disagreed with the figures presented in paragraph 2 of this proposed amendment and said that the Zoning Board previously presented to the Board a recommendation regarding the minimum ground area of a single family residence. Trustee Garrity also had other questions relat- ing to the amendment. Following discussion, it was the consensus that this proposed amendment be forwarded to Tec-Search and the Plan Commission for consideration as to incorporation into the comprehensive zoning ordinance they will be working on soon. A copy of Mr. Norman Atkins' (Centex Industrial Park representative) recommendations also will be forwarded to Tec-Search and the Plan Commission, Regarding the 30" sewer line along Route 83, Trustee Mullen noted that in a letter from Engineer Fletcher he recommends that not only should the Village get the number of people employed in the Industrial Park, but that a v-notched weir should be installed to measure the flow in the line, in order to determine whether or not the line is of sufficient capacity. Trustee Mullen said he felt that the weir should be installed and Mr. Fletcher said he would see that this is done. - 5 - Reg. .5-18-65 Trustee Mullen questioned the size of the Jet Die Casting sewer line installation. During discussion it was noted that they have an agreement with the School District contingent on the sewer installation. Attorney Hofert will call the School District's Attorney and discuss this subject with him. Trustee Chernick presented a check in the amount of 1350 which has been donated by the Elk Grove Village Junior Woman's Club to the Village for the summer recreation program. It was me—n d by Trustee Lewis and seconded by Trustee Zettek that the meeting be adjourned.
