OF
Chairman Gayle B. Bantner called the meeting to order at 7:30 p.m. in
the Municipal Building, 901 Wellington Avenue, Elk Grove Village, and
noted for the record that the following were present: Alan J.
Shapiro, DDS, H. Robert Goldsmith.
It was moved by Mr. Goldsmith and seconded by Dr. Shapiro that the
minutes of September 21, 1992 be approved as submitted and that the
Board dispense with the reading thereof. The motion was voted upon by
acclamation; whereupon the Chairman declared the motion carried.
PRESENTATION AND APPROVAL OF INVOICES
Peter Felice & Associates $420.00
For professional services
rendered - retainers for:
August, September & October
at $140 ea.
It was moved by Dr. Shapiro and seconded by H. Robert Goldsmith that
the Board authorize the disbursement of funds for payment. The
motion was vote y acclamation; whereupon the Chairman declared the
motion carried.
EXECUTIVE SESSION
The Fire and Police Commissioners met with the Presidents of the
Pension Boards, Harvey Speiden, Fire and Ted Thompson, Police; the
Chiefs, Fire Chief MacArthur, Deputy Police Chief Schmidt, Dr.
Boyajian and Peter Felice to discuss ADA regulations. Peter
Felice took the minutes for this meeting.
One year probationary review was held for Police Officer Eric Perkins
and Officer Perkins has been granted permanent status with the Police
Department.

CORRESPONDENCE
Three letters of Written Reprimands were issued by Police Chief
Engelbrecht on three different dates to three different officers.
September 29, 1992 - Failure to operate Village vehicles in a safe
and prudent manner or to obey related traffic
laws.
October 6, 1992 - Making a false report written or oral .
October 22, 1992 - Incompetency or inefficiency in the performance of
duty.
A copy of a letter from Police Officer Charles Walsh requesting
extension on residency requirements to the President and Board of
Trustees. Memos from Police Chief Engelbrecht to Gary Parrin, from Lt.
John Bantner to Deputy Police Chief Schmidt requesting approval was
attached. Gary Parrin will have to make that decision.
Copy of a memo from Deputy Fire Chief Clark to Firefighter Bret C.
Cassata on his residency probation. Firefighter Cassata has
completed his twelve month probationary period and has six months to
move within the 15 miles radius required.
Two suspension were issued by Police Chief Engelbrecht in October.
1. October 5, for one day for failure to appear in court when
scheduled or required.
2. October 21, for two days for failure to be prompt for duty
assignment including roll call and court appearance.
NEW BUSINESS
Schedule Police Officer Carl Dover for his one year probationary review
for November 23, 1992 at 8:00 p.m.
The Fire and Police Commissioners have decided to use the Expert Panel
for the Fire and Police Lieutenants test. . Distribute the Study Sheets
when dates and times have been set with Dave Christensen of PCI.
The two Police Officers who have completed their six months probation
in December are to be schedule for December 21, 1992 at 8:00 p.m.
Orals for last two police applicants should be set for November 9,
1992. No word from Managers office or the Police Department on
position being requested.

OLD BUSINESS
Eligibility List for Fire Captain have been signed, post and send
copies to the Fire Department.
Next regular meeting will be held November 23, 1992 at 8:00 p.m.
ADJOURNMENT
It was moved by H. Robert Goldsmith and seconded by Alan J. Shapiro
that the meeting be adjourned. The motion was voted upon by
acclamation; whereupon the Chairman declared the motion carried and the
meeting adjourned at 10:30 p.m.

MEETING OF OCTOBER 26, 1992
A meeting was held in the conference room within the Village
of Elk Grove Village on October 26, 1992, at 8 p.m.
Persons present within said meeting were: Ted Thomson of the
Police Pension Board of the Village of Elk Grove Village, Charles
Boyajian, M.D. , Harvey Speiden, President of the Fire Department
Pension Fund of the Village of Elk Grove Village, Jim MacArthur,
Fire Chief and Steve Schmidt, Deputy Police Chief. Also present
were all members of the Fire and Commission, Gayle Bantner,
H. Robert Goldsmith and Dr. Alan Shapiro, as well as their
Attorney, Peter A. Felice.
The purpose of the meeting was to discuss the impact of the
Americans With Disabilities Act upon the respective commissions and
their rights and responsibilities. It was discussed as to whether
Charles Boyajian, M.D. for the Fire and Police Commissioners, and
being the initial medical examiner for all initial appointees,
whether it would be conflict for him to make his recommendations to
the Fire and Police Commissioners as well as the respective Pension
Boards.
After lengthy discussion and a discussion of Holmes v.
Illinois Retirement Fund 540 N.E. 2d 112 , 133 Ill.Dec.256, (1989) as
presented by Peter Felice, it was determined that a policy would be
instituted by the respective commissions; and that possibly Dr.
Boyajian would only present medical examination results as to
eligibility to be able to perform police duties would be certified
to the Police and Fire Commission; and that if the Police Pension
Board, and/or in the alternative the Fire Pension Board desires
copies of lab examinations as well as tests and conclusions from
Dr. Boyajian, they would present him with a separate request from
them as well as a release and consent from any prospective
applicant into their respective funds.
Furthermore, it was discussed as to whether a disclosure would
be made on the fact sheet presented to prospective applicants to
the Police and Fire Departments advising them as the possibility of
them being accepted as an employee of the Village and not being
eligible to participate in either one of the Pension Funds.
Peter Felice indicated that he would contact George Knickerbocker,
Village Attorney, to discuss this matter and what programs and what
benefits would be rendered to such employees who were appointed a
firefighter or police officer and not accepted into the Pension
Fund.
There being no further business, the meeting was adjourned
until such future notice would be sent to all parties.
