AMERICAN HOUSING PARTNERS AMLEZATION A R M NT
The consensus of the Committee was to approve of the
following items to be included in an annexation agreement with
American Housing Partners:
• a special use permit for the operation of an independent
senior housing facility,
• a variation to allow the reduction in required parking
spaces from 141 to 117 through the "land banking" of 29
parking spaces. All land banked parking is to be
constructed when the existing parking spaces are 750
occupied by vehicles registered to residents of the
development (89 spaces) ;
• a variation to allow the construction of a four-story
building;
• a cash payment equal to l0% of the purchase price paid for

payment will be paid at the time the purchase is closed,
• a dedication of sufficient land by American Housing Partners
to be used for a shared access with the property to the
north at such time that it is developed. The shared access
will be aligned with Dakota Lane and constructed at the
expense of the future developer of the property to the
north;
• to include language allowing the existing resident/business
owner to remain on the property for a period of 9 months
after closing or until the first building permit is issued;
• to remove language providing American Housing Partnership
(AHP) with a storm sewer recapture and replace it with a
requirement for American Housing Partnership to acquire
necessary easements and supply sufficient storm water
drainage on the property.
• acquisition of a cross access-easement with E1 Bethel Church
prior to the issuance of an occupancy permit; and
• payment of the sanitary sewer recapture at the time of
closing;
• language declaring all provisions of the annexation
agreement null and void 12 months after passage if the
property is not purchased prior to that time; and
