AGRMT COMMITTEE OF THE WHOLE MEETING March 28, 1989 Elk Grove Village 7 p.m. MEMBERS PRESENT: Charles Zettek, village President Michael Tosto, Village Trustee Edward Hauser, Village Trustee James Petri, Village Trustee Ronald Chernick, Village Trustee Joseph Bosslet, Village Trustee MEMBERS ABSENT: Dennis Gallitano, Village Trustee STAFF PRESENT: Gary Parrin, Assistant Village Manager Julie Carius, Administrative Assistant Al Boffice, Village Engineer James MacArthur, Fire Chief Earle Kracht, Building Inspector Supervisor Norm Samelson, Village Attorney (7:30 p.m. ) OTHERS PRESENT: David Grossbery, Attorney representing Kimball Hill Glenn Richmond, Representative of Kimball Hill "TRS GREAT NORTHWEST SUBURBS" PUBLICATION Members confirmed their direction to place a full page ad in addition to the demographics section of the journal. KIMBALL HILL - AMENDMENT TO ANNEXATION AGREEMENT Members reviewed the revised amendment to the annexation agreement. Consensus was to resolve the open issues accordingly: 1. Open Space: Kimball Hill shall be allowed to include the additional parking spaces provided when determining open space. 2. Cash Donation: Developers shall contribute a total of$208,400 to the Village in lieu of a land donation. The additional two-tenths of an acre in park land shall not be deducted from this cash donation. 3. Letter of Credit for Park Boulevard road improvements: Each replacement letter of credit shall be adjusted to reflect changes in the Construction Cost Index published by American City and Country magazine (or a comparable index). 4. L�hting: Supplemental lights shall be provided where necessary in order to maintain adequate lighting throughout the development. 5. Sidewalk: The sidewalk along the north side of Devon Avenue will be constructed as part of the Kimball Hill development. -- please continue COW Meeting 3/28/89 -2- The 2-The developer's attorney was agreeable to all of the aforementioned methods of resolving the open issues.
