Pursuant to a duly made and approved motion and a majority vote at a regularly
scheduled meeting of the Village President and Board of Trustees on December 17,2002 this
Executive Session was called to consider a Litigation matter.

The Village Attorney reported that the owners of 811 E. Higgins (Pecora property)have
filed a suit against Cook County on a zoning application. The landowner proposes to
construct 559 storage units, but the County is requiring R-5 residential zoning for the
property. The R-5 zoning requires that the owner petition the Village to connect to the
Village water and sewer utilities, although the property is outside Village limits.
The Village Attorney advised if the Village denies this request,the landowner has the
ability to use the denial as support for the storage unit proposal, and advised that the
Village consider approving his request. The worst case scenario in approving the
connection is that the owner would have the zoning to construct single-family homes on
minimum of 10,000 square foot county lots. The Attorney questioned if the landowner
would proceed with constructing single-family homes due to questionable profitability.
The consensus of the Board was to have the connection request approved.
