Pursuant to a duly made and approved motion and a majority vote at a regularly
scheduled meeting of the Village President and Board of Trustees on August 20, 2002 this
Executive Session was called to consider a Land Acquisition matter.

Land Acquisition
Rodgers Park Retention Pond
The Director of Engineering &Community Development reported that his office has
studied drainage complaints and the results of heavy rains in the Industrial Park. There is
a considerable drainage problem on the far east side of the community due to inadequate
conveyance and storage.
The Rodgers Industrial Park on the far east end of the community had a pond that was
constructed in 1969 to serve as stormwater detention over a large part of the eastern end
of the Village. Rodgers' obligation to maintain the pond ended in 1976. The pond is no
longer functioning to store or convey stormwater due to this lack of maintenance.
The Engineering Department has determined that many businesses experience flooded
docks, lost inventory, and significant inconvenience due to the flooding caused by the
failure of the pond to function properly. The Engineering Department requested Rodgers
to donate the pond to the Village, so the Village could restore and maintain the pond to
reduce flooding of streets and businesses. Rodgers refused to donate the pond to Elk
Grove Village.
The pond water level is 3 feet too high. At this height, it fails to either convey
stormwater or store new stormwater. Pond repairs can likely be done in a week's time at
minimal cost with some on-going maintenance responsibilities. The Village does not
repair or maintain private detention ponds, only those that are owned by the Village.
The consensus of the Village Board was to adopt an Ordinance at the August 20 Village
Board meeting authorizing the Village to purchase the pond for fair market value based
upon an appraisal to be ordered by the Village Attorney. If purchase discussions do not
result in an agreement, the Village will proceed to acquire the property through
condemnation. In addition, the ICRC fund will be utilized to acquire the property as a
benefit to the business park.
It was further noted that Rodgers will save 51,100 per year in property taxes by selling
the parcel to the business park.
