PROCHNO Village Trustee Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting of the Village President and Board of Trustees on September 8. 1998 this Executive Session was called to consider a Litigation matter. Number of pages attached: 1 Date(s) of review for release: January 1999 Date of approval for release: A r) 0 moo' 3 r �j ti 9/8/98 7:35 p.m. LITIGATION The Village Manager and Village Attorney brought the Village Board up to date regarding the informational strike at the Oakton Street Fire Station construction site. The Village Manager explained that the Village had awarded the construction contract in a legal manner and the contractor said employees were being paid the prevailing wage in the State of Illinois. The Village Attorney stated that work has stopped at the site due to the informational strike being performed by the Bricklayers Union. The Bricklayers are opposing non-union masonry workers hired by the general contractor, McMillan Construction. The Village Attorney explained that the Village Board had three options for resolving the issue: 1. Expend approximately $20,000 to develop a "Reserve Gate" for the union to picket, with no guarantee of success; 2. Agree to pay additional costs under the contract for hiring union workers (est. $50,000); or 3. File litigation should the job be delayed. Upon discussion, the consensus of the Village Board was to authorize the Village Manager and Village Attorney to negotiate with McMillan Construction for the payment of additional funds to hire union workers in an amount not to exceed $50,000 and to have McMillan Construction pay any excess amount. The meeting adjourned at 7:55 p.m.
