Pursuant to a duly made and approved motion and a majority vote at a regularly
scheduled meeting of the Village President and Board of Trustees on 07/14/98 his Executive
Session was called to consider a Litivation matter.

LITIGATION
The Village Attorney brought the Village Board up-to-date ori the
status of Busse News & Video's litigation against the Village. The Village
Attorney stated that he and Special Counsel Ron Zamarin had appeared in
Federal court to defend the Village against the Temporary Restraining Order
(TRO) being requested by Busse News & Video. The TRO was being filed
to require that electrical and water service be reconnected at their property
located at Busse Road.
The Village Attorney stated that he believes the Village's right to shut
down the building based upon zoning and building violations will be upheld
by the court. A decision will be rendered on this issue during the week of
July 20.
