Pursuant to a duly made and approved motion and a majority vote at a regularly
scheduled meeting of the Village President and Board of Trustees on ril 14.this Executive
Session was called to consider a Litigation matter.

Litigation
The Village Attorney brought the Village Board up-to-date on the status of
negotiation of remediation costs related to the cleanup of the former Grove
Mall property.
The Village Attorney stated that the total cost of remediation for asbestos
and dry cleaning contamination was $390,000. According to the Village's
settlement agreement, Joe Serfecz was required to pay any amount over and
above $75,000. However, Serfecz has agreed to pay $297,000, due to some
concerns over disposal and Village incurred clean-up issues. The Village
Attorney recommended that the Village Board accept Serfecz' offer as it
would eliminate potential legal fees incurred by the Village.
Upon further discussion, the consensus of the Village Board was as follows:
• to accept Serfecz' settlement offer of$297,000; and
• to authorize the Village Attorney to file an agreed to court order of
the settlement at the 4/14/98 Village Board meeting.
The meeting adjourned at 7:05 p.m.
