PROCHNO Village Trustee Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting of the Village President and Board of Trustees on December . this Executive Session was called to consider a personnel/litigation matter. Number of pages attached: 1 Date(s) of review for release: luly 1998 Date of approval for release: ;t7 '0/ j�` 12/9/97 Litigation/Personnel 6:56 p.m. The Village Attorney provided the Village Board with history regarding Bob Arnold's employment with the Village, including hiring date, date of disability, and current status. The Village Attorney stated that Arnold was declared fit for duty by the Police Pension Board on April 30, 1996. However, as of December 1997, Arnold had not been activated due to the fact that there were no available Sergeant positions, and the limitation previously documented by Arnold with respect to his ability to perform his normal duty functions. The Executive Session recessed at 6:59 p.m. for the Committee of the Whole meeting. The Executive Session reconvened at 9:40 p.m. The Village Attorney informed the Village Board that the Police Pension Board and Village were being litigated by Arnold, who has alleged that he is not fit for active duty and should remain on disability pension or return to active duty and receive back pay from May 1, 1996 up to the present date. The Village Attorney stated that the Village Board had three options. They were as follows: 1. Concur with the Police Pension Board and allow Arnold to return to work in a permanent light-duty status in the vacant Sergeant position created by the promotion of Sergeant Zimmerman to Commander. Arnold's salary upon reinstatement would be approximately $50,000. 2. Continue with litigation since Bob Arnold is not fit-for-duty because he cannot perform the essential functions of the job, and oppose the Police Pension Board in formal litigation. 3. Negotiate a settlement with Arnold equal to $41,000 for buying back 8 113 years of creditable service and allowing a 50% retirement pension for Arnold effective in 1999 and seek cooperation of the Police Pension Board to accept the settlement offer. Upon further discussion, the consensus of the Village Board was to select Option #3 (above). The Village Manager noted that it is his intent to promote Officer Hawkins ` to the position of Acting Sergeant so as not to fill the position with a permanent appointment pending the outcome of the litigation.
