Pursuant to a duly made and approved motion and a majority vote at a regularly
scheduled meeting of the Village President and Board of Trustees on December 9, 1997,
this Executive Session was called to consider a Litigation matter.

Litigation
The Village Attorney informed the Village Board that a law suit
was filed against the Village by Busse News Video on various
constitutional matters, including free speech. The Village Attorney
stated that the plaintiff was seeking building and occupancy permits for
an adult book store in the industrial park. At the present time, permits
were not being issued due to the fact that the proposed use did not
meet the zoning requirement for retail sales in an 1-1 district.
Specifically, more than 20% of the building would be used for retail
sales.
Upon further discussion the consensus of the Committee was as
follows:
• to authorize the Village Manager to retain Ron Zamarin to
provide legal services in defense of the Village; and
• to direct the Village Attorney to research a change to the
Zoning ordinance concerning adult uses.
The meeting adjourned at 6:55 p.m.
