Pursuant to a duly made and approved motion and a majority vote at a regularly
scheduled meeting of the Village President and Board of Trustees on Sptember 23. 1997
this Executive Session was called to consider a Litigation matter.

LITIGATION
The Village Attorney brought the Village Board up to date on the
status of the Hampton Inn Special Use Permit public hearing. The
Village Attorney stated that the attorney for Hampton Inn had contacted
the Village and requested the opportunity to negotiate a settlement for
the removal of the billboard sign from their property. The billboard
property is currently leased from Hampton Inn through March of 1998
by Universal Billboard Signs.
Upon further discussion, the consensus of the Committee was to
authorize the Village Attorney to negotiate a settlement with Hampton
Inn subject to the following guidelines:
• that the Village be entitled to 50% of all revenues received by
Hampton Inns from Universal Billboard Signs for the period of
April 1997 through March 1998;
• that the Village's 50% of the revenue be put in escrow to be used
by Hampton Inns to litigate against Universal Billboard signs if
the existing billboard is not removed at the end of the lease,
March 1998;
• to set a public hearing for October 9, 1997 at 7:00 p.m. to
consider Hampton Inns special use permit if negotiations are
unsuccessful.
